The City Commission of the City Hall in the City of Sanford, Florida, of Sanfor~, Florida, met in regular session at the City at 8:00 o'clock P. M. January 25, 1954. Present: Commissioner Earl Higginbotham, Mayor " J.D. Cordell " John L. Kader " John S. Krider, Sr., " W. H. Stamper City Attorney A. Edwin Shinholser City Clerk H. N. Sayer City Manager Thcs. L. Lemon Chief of Police R. G. Williams Meeting called to order by the Chairman. The meeting was then opened with Prayer by Rev. John Miller. Geo. A. Maffett next appeared on behalf of the Boy Scouts and requested perml~ion to use the baseball park again for their annual field day activities on night of February 6, and on motion of Commissioner Stamper, seconded by Commissioner Cordell and carried, same was granted on same basis as last year. Karlyle Housholder next appeared on behalf of the American Legion Fair Association and requested permission to conduct their annual Fair in Senford during week of March let thru 6th at same locstlon and under same terms and conditions ss in cast, and on motion of Commissioner Cordell, seconded by Commissioner Krider and carried, will also be under same supervision as in the past. Attorney Crews next appeared on behalf of J. E. same was aoproved, conditioned that it Jones and requested that the hearing on revocation of his beer and wines license be extended until next regular meeting of February 8, and on motion of Commissiomr Cordell, seconded by Commissioner Krider and carried, same was granted, provided he close his place of business as of thie date and remain closed until after the hearing. Fred A. Dyson, building contractor, next appeared and gave a report on condition of reservoir roof at water plant, advlsing that he had made a thorough inspection of it and found that most of the heavy timber structure and rafters could be salvaged and probably one-third of ~he sheathing, but that some of ~he ~ost were completely decayed, which was causing the roof to sag in places. He stated that the entire roof should be removed in order to make the necessary repairs and replacements to the supporting structure, and that such cost would amount to almoe~ as much as a complete new structure, the cost estimate being from $12,000.00 to $15,000.00, and recommended that the contract be awarded on cost plus basis because of no~ being able to determine the exact extent of reol~cements. Thereupon after considerable d~scussion, and in view of no funde being appropriated in current budget for rebuilding the reservoir roof, Commissioner Krider moved that the City start immediately with its crew to repair the structure, and continue to completion as funds are available. Seconded by Commissioner Stemper and carried. Cecil Ozier of Ozier-Weller Homes, Inc., next appeared relative to information as to when the City would start constructing the sewer line to serve their housing development which was authorized by the Commission at meeting of January ll, in order that they may schedule their building program accordingly. After discussion and on advice of the City Manager t b~t Engineer Angas had advised by letter that the plans and speciflc~tions woul~ be completed an~ mal]ed to the City on January 27, Commissioner Kadet moved that the City advertise for b~ds for the construction work as soon as the specifications are available. Gentlemen: With my deepest regret I make the followerlng proposal concerning the Greyhound Lines Agency v~lch is presently operated in The Sanford Bus Stat] on Inc. Due to the fact that Conditions beyond my control have come about I have only the revenue from the sale of bus tickets and commission on cypress left. After the loss of lunch stops ~n December the Frill bas become a liability. I made a trio to Jacksonville yesterday with a very grim view in mind. I had it set up with my wife t~ if I could not get some agreement with the greyhound llnes, to move the agency to another location that I would call her and have the agency closed st once. I bought t}is station after I was injured in a train wreck thlnklng that I would not be able to work on the road anymore, and it only took about two years for me to find out that I had made a bad deal, so I went back to work under a very painful condition having to wear a steel brace in order tk~.t I would have enough revenue to make these payments and keep thc agency open. Also you will have to admit that the City Commissioners who donated the City property for the buf. lding made a bad deal in donating the land not knowing that there would be s continued revenue enought to finish paying for the oroperty. The fact that thls condition has become so serious is that the R. F. C. is in a state of liquidation. I ma~e a trip to Atlanta after losing my last revenue asking about some relief on the oayments, and they informed me that no matter how bad they woul~ like to help that their han~s were tied, and they also showed me the law handed down from Washington vtich stated that only six weeks would be allowed for lack of full payments when due. I have been in a very fateful state of mind every since, and I ,hav~ not made any payments since that notice and do not have any intentions to do so. I have two weeks left after the 23rd of this month. This is not intended to high pressure you gentlemen agreeing to a new location for the agency. It is to ]et you understand that the agency will be closed regardless of the out come of your decision. The original agreement between the City of Sanford and the orlgional builders of the station wss cancelled when the R. F. C. took over the mortgage. The only location that I have been able to locate is the Kent building across the street from the station, and when I get through closing in and painting up it will be up to the stsndards to other stations in cities the size of San ford. I have tried to force the issue on the Company to make them buy the station, but since the greyhound corp in Ch~.cago took over the Florida Greyhound Lines it ia impossible to get them to do anything. They are now turning almost all of their Company operated stations into commission stations, and most of them are rented stations. I can see t~t this will be a blow to you gentlemen,, and I also hope that you gentlemen can aporeclate the blow that it is to me. I expect to lose $20,000 any how if not more. So you can see that I am not trying to pull anything for my own interest. I would like to Nave the chance in s period of time to make some of my loss back. Calhoun Commissioner Krider then pointed out that the City gave the property in goo~ faith under agreement with the Greyhound Bus Lines that it would be maintained and operated as a public bus station, and he felt that they should live up go their agreement. After further discussion, in which Mr. Calhoun assured the Commission that he would reno- vats the Kent building into an attractive station with adequate facilities, and would also attempt to secure the bus station property after it has been disposed of by Reconstruction Finance Corporation, the mortgage holder, Commissioner Stamper moved that permission be granted Mr. Calhoun to move the bus station to the Kent building providing he will make every effort to improve the conditions. Seconded by Commissioner Kadet and carried. Mr. Calhoun then requested that the City provide two parking spaces for busses on the sidewalk and parkway area in front of the new location and also restrict vehicles from parking on north side of Commercial Street in front of the building. Thereupon Commissioner Krider moved that the ~olice Department be authorized to mark off a space on the sidewalk in front of the Kent building for two busses, and also to provide for "No Parking" of vehicles on north side of Commercial Street in front of it. Seconded by Com- missioner Stemper and carried. T. O. Brown, Jr., next appeared and submitted an offer of $500.00 for purchase of a strip 25 feet in depth and 100 feet in w~dth, of the City owned land Joining the east end of his con- crete plant property on north French Avenue, and on motion of Commissioner Stemper, seconded by Commissioner Cordell and carried, same was accepted. Ss ld property being described as: ~eg. at a point 2h9 ft E and ~59 ft N of SE Cot. of Block 1-N of Tier 9, E. R. Trafford's Map, run E. 25 feet N 100 ft W 25 ft S 100 ft to point of beginning. Consideration next given to the application of Deluxe Cab to rent s parking space on north side of Third Street west of Sanford Avenue; Arnold Bentley to rent a space for his taxicabs on south si~e of Third Street west of Sanford Avenue for loading groceries; and the Streamline Cabs to rent space on west side of Sanford Avenue south of Third Street, and also one on north s~de of Third Street in front of Newsom's Radio Shop. Thereupon after considerable discussion, Commissioner Stamper moved that the situation stand as is, including the temporary spaces granted, until ne×t regular meeting, and that the space in front of Newsom's Radio Shop be designated as and In and Out for all c~bs until then; and that the City Manager and Chief of Police make a further survey and recommendations and also contact the manager of Piggly Wiggly Store on Third Street relative to designating loading spaces for taxicabs on~eir private parking lot. Seconded by Commissioner Krider and carried. A committee representing the Colored Business, Profession & Civic Club, with Steve Cherry as spokesman, next appeared and submitted the follo~ng letter with further reference to the proposed Colored Recre~tlon Center: City Commission of 8anford, Sanford, Florida. Dear Commissions: January 20, 1954 The interest in establishing a permanent Recreation Center has gained momentum in the Gol~sboro and Georgetown areas. Nany hours have been spent in seeking a suitable site from the suggestions of the City Commissioners along with the County Commissioners and the County school board. 192 MINUTES So o a, lo ao, ......... asked the committee reoresentlng The Business Professional and Civic Club to help in selecting a site. In making a survey of the east and west side of town, the committee's recomendation was the track of land extreme south of Goldsboro Primary School extending east into Mr. George Spear's property adjacent to 20th Street. There was another s~.te suggested for the City Commissioners felt the proposed one was too low, nevertheless they were to m~ke a genera! survey and possibly have the program in onerat~on Isst spring. The Committee went back to the city commissioners on several occassions for the decision but fa~]ed to get one. We have been promised results but no encourage- ment what-so-ever has been sho%m. There .has been money placed in tM budget over and over as to speak but nothing is ever sald~out the use for which it was appropriated. The Negro citizens are making this request as before: 1. A plot of land be set ssi. de for a permanent Recreation Center. That this plot of land be large enought to include if possible, a baseball diamond, swim~,~ng pool, co~cession stand., shuffle board, tennis and volleyball courts, swings and Merry-Co-Round and etc. ~. That the plot of land be prooerly fenced to insure a trained and re~ulsted Recreation orogram. 4. That the Recreation Canter be maintained by the city and county with the aid of the various clubs and organizations. ~he Business Professional Club is ask!nF the city commissioners to give the citi- zens s reply in wrY,lng to this most worthy project. Where ever the s~te is selected, east or west side we shall sc~ept. Our object is to make a better Sanford of tomorrow through its refined citizenry. Secretary Hubert Cherry ) Willie Miller ) J~mes D H~gen ) Members of Committee After considerable discussion of the matter, in which Commissioner Stamper pointed out that the City had shown the need for such a recrestlon center, and had indicated its desire and willingness to cooperate in its development by aporopristing and setting aside the sum of ~,775.00 for the oroJect, Mayor Higginbotham appointed a committee of three, consisting of Com- missioners Krider, Cordell and Stemper, to further study the situation, touork out a solution and bring a report back to the Commission. Letter next submitted from Dorothy A. Powell requesting the City to vacste the unused deadend alley running from Cook Avenue east to Lot "C" of Dodd, Lord & Dean's Subdivision, which bisects her property described as Lots 32 Dhru ~1 of Cottage Hill, advising that she intends keeping the entire prooerty intact for her home place. After discussion and uoon advice t~t the aforesaid alley will not be needed for City services, Commls~:ioner Corde!] moved that the City Attorney prepare the necessary ordinance for vacating same, with reservations f or utility easement. Seconded by Commissioner Stamper and carried. The City Manager next brought up matter of purchasing a second hand Todd fogging machine from R. H. Beckham st price of $?00.00 to replace the old machine used for spraying alleys, which is in bad state of repair. He advised, the, th~ machine was purchased new by Mr. B¢ckham's brother st cost of aooroximately $1,600.00 end used only a few times before his death, and th st the City would not Rave to pay for it until ne~t fiscal year. Thereupon Commissioner Krlder moved the approval for ourc hase of the fogging machine from R.H. Williams, Jr., next appeared and reported on final acquisition of rights of way for widening French Avenue, in which he advised of follo~.ng settlement on the parcels of property in the condemnation suit: Settlement out of Court - Margaret Kirtley and Sarah Nero ~200.00; Chester Miller ~510.93; Gladys Smith and Jean A~ams $475.00; Mary D. Senn $100.00; M. ~. Glnder $225.00. A~mrded by the Court - James Riser $1,200.00; ~. B. Riser $100.00; Owen J. Lally $200.00; E. C. Waler $4~0.00; Frank Mercier $5.00. Mr. Williams then recommended that immediate request be made to the State Road Department to expedite completion of the plans and specifications for reconstructing French Avenue in order tkmt the project may be included in this year's budget. Johnson Commissioner Kadet then asked for an expression from the Commissioners as to whet~r or not they intended following the recommendations of the consulting engineers, and received a negative reply. Commissioner aader then moved that the Commission follow the recommendations of the Con- sulting Engineers Consoer, Townsend and Associates, if it is possible, whatever the recommenda- tions may be. Seconded by Commissioner Stemper but failed to carry. Commissioner Hlgglnbotham stated that he voted naye because the motion was unnecessary and served no purpose. Commissioner Kadet stated that he made chance for the Commissioners to get together the motion becaue he felt that it Was the last on the sewer project. On motion of Commissioner Kadet, seconded by Commissioner Cordell and carried, current invoices and payrolls, as evidenced by Vouchers Nos. 681 thru 80~, next approved. The City Attorney next advised that the State Board of Health had filed objections with the Circuit Court on the validation of the $1,175,000.00 water ao~ sewer revenue certificates. In brief, such objections being, first, th~,t plans and soec!fic, tlons for the improvements had not been submitted and aooroved by the Commission at the time of adoption of the ordinance, and, secondly, that such plans and specifications had not been submitted to and approved by the State Board of Health at the time of the sdootlon of the ordinance. in light of thes~ developments, he had presented to the Circuit Court a of the matter to allow until February 19 for the City to file pleadings tlnuance of the h~arlng until February 26th. Commissioner Kadet stated that he voted for the motion because he felt that the City would not accomplish snyt~lng by defend i~g the suit at thls time, that it would cost additional money which could be avoided by delsy~ns' the su~t for another tv-o weeks. After further discussion Commissioner Cordell moved that the City Attorney be authorized to employ an associate counsel at a fee not to exceed !~750.00 to assist him in the validation ~ult. Seconded by Commissioner Krider and carried over the dissenting vote of Com~issioner Kadet and Stamper. Commissioner Kadet stated "I voted nays because it is a waste of money". Wright were next appointed as members of the Planning Board. The City Attorney next submitted s deed from Lee Rosen, et ux, and Joseph Homart, et ux for right of way ourposes to oermlt extensl n of 8th Street westward from Pomegranite Avenue to Persimmon Avenue, advising that the consideration was that they would not be sssessed for any street or sidewalk Imorovements in connection with the right of way abutting their remaining prooerty. Thereupon Commissioner Stamper moved the acceptance of the deed with the foregoing provisions. Seconded by Commissioner Cordell and carried. Commissioner Krlder next brought up matter ,~f new appointment for Municipal Judge, stat- ing that in view of Volie A. Williams, Jr., present Judge, having announced for public office and is also acting as campaign manager for Bralley Odham who is running for Governor, he felt that it would be for the best interest of the City to apooint someone that is not conducting a political c~moalgn. After considerable discussion Commissloaer Krider then moved that the services of Volle A Williams, Jr., as Municipal Judge, be terminated as of February 15, and that the City ask for applications to fill the position. Seconded by Commissioner Cordell and carried over the dissenting vote of Commissioners Kader and Stamper who stated that they felt that Mr. Williams was doing a very good Job. Commissioner lrlder next moved the acceotance of the ~signation of City Manager Lemon with regret, along with suitable compensation for services rendered. Calhoun to move the bus station to the Kent the sidewalk in front of the building is in need of repair before being used for such purpose. Thereupon Commissioner Stemper moved that the City Man~ger be authorized and directed to notify the owner of the Kent Building by letter that the City will be unable to mark off the spaces for busses until the sidewalk is repaired. Knowles Meeting called to order by the Chairman who announced that the meeting had been called for the purpose of determining the Justification for moving the Bus Station from its present location. H. James Gut, former City Commissioner and Mayor at the time the Bus Station site was conveyed by City to M. F. Loftln for the Durpose of constructing and operating a public bus station thereon, then gave a brief summary of the negotiations and agreement worked out with Mr. Loftln and the Sreyhound Bus Lines in connection with utilitlzing the property for this purpose. He pointed out that the reasons and Justifications for such action by the City were to eliminate the traffic hazard that had existed up until that time by buses having to load and unload from the street, to provide puhllc rest rooms for both colored and white, which the City had under consideration to constl~uct in downtown area at that time, and also to pro- vide a modern bus station for the community. ~r. Gut also read extracts from minutes of several meetings of the Commission pertinent to said negotiations, agreements and conveyance of the property, which he said was done in good faith, and he felt that the property should be main- tained for the purpose for which it was conveyed. Andrew Carraway, president of Seminole County Chamber of Commerce, who was aleoa member of the City Commission at the time this property was conveyed, next spoke in favor of maintaining it for the bus station. He pointed out that all the citizens had an investment in it thru the City, and requested the Commission to give the matter careful consideration with a view to protecting this investment. W. C. Hill, another member of the Commission at that time, also concurred with Mr, Sut and Mr. Carraway. J. A. Calhoun, local bus agent, who is buying the bus station property under mortgage contract held by Reconstruction Finance Corporation, then pointed out again his reason for having to give up the property, stating that he could not continue the monthly mortgage pay- merits of $300.00 because the gross revenue had dropped to $?00.00 monthly. He stated that the balance owing on the mortgage contract amounted to $22,037.00, and that he was forfeiting ap- proximately $25,000.00 already paid on it. After discussion it was suggested to Mr. Calhoun that ways and means be worked out to refinance the balance of t~ mortgage with much smaller monthly payments. Commissioner Krider then suggested that the Commission take the matter under advise- ment for another week before taking any definite action so as to give everyone concerned more time to give it careful consideration. Mr. Calhoun then stated that he would not be interested in the proposal to have the monthly payments reduced, and that he would like for the Commission to take some definite action at this meeting. Commissioner Cordell then of January 2~, 19%$, be rescinded. Stemper refrained from voting stating he felt that moved that all action concerning the bus station at meeting Seconded by Commissioner Krider and carried.
