020854-Regular Session The City Commleelon of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. February 8, 1954. Knowles Police Captain Roy Tillts Meeting called to order by the Chairman. The meeting was then opened with "Prayer" by Captain V. Hall. On motion of Commissioner Kadet, seconded by Commissioner Stemper and carried, the Commission next authorized an advertisement placed in the annual mall-away edition of the Banford Herald at cost of T. O. Brown, Jr., next appeared with reference to his offer of $500.00 accepted at meeting of January 25, on parchase of a strip of land 25' x 100', of the City owned property adjacent to east end of his concrete plant on N. French Avenue, and advised that after a fur- ther survey it was found that he would need the entire south 100 feet of the City's property, size 100' x 163' for his expansion program. He then submitted an offer of $1,200.00 for pur- chase of same. After discussion Commissioner Stemper moved that the previous authorization be with- drawn, and further moved the acceptance of Mr. Brown's offer of $1,200.00 for the tract of land, size 100' x 163'. Beconded by Commissioner Kadet and carried. Said property being described as: Beginning at a point 259 ft E and $~9 ft N of the SE corner of Block I-N, Tier 9, E. R. Traffords Map, run E 163 ft., N 100 ft., ~ 163 ft., S 100 ft to point of beginning. Mr. Paul Johnson of the consulting engineering firm of Consoer, Townsend and Associates, next reported that he had already started on the survey and study of the proposed water and sewer improvements, including field inspections, and would take all available reports, plans and specifications, etc., back to their Chicago office for further study and analyzing. Petition next submitted from the adjacent property owners for City to cover the drainage ditch located at rear of Block D of Buena Vista Subdivision, and after discussion Commissioner Stemper moved that the matter be referred to Engineer Angas for an opinion. Beconded by Commissioner Kadet and carried. On motion of Commissioner Btemper, seconded by Commissioner Kadet and carried, the Commission next deferred action on applications of Deluxe Cabs, Streamline Cabs and Arnold Bentlery for parking spaces until next regular meeting. Letter next submitted from Chase & Company offering to lease the City the lot at southeast corner of Oak Avenue and Second Street for a public parking lot for a ~erlod of two years, provided the City will construct a suitable barrier around the adjacent lot to the Bouth and maintain it aea private parking lot for their customers and employees, and also pay them annually an amount equal to the sum of all City and County taxes on both lots, which amoun~ to approximately $190.00, Matter taken under advisement. Mayor Hlgginbotham next gave a report on status of French Avenue project, in which he advised that the State Road Department had given assurance that its construction would be included in this year's budget. ~he Mayor also reported that Attorney Crews had advised that J. Yowell was purchasing the Bus Station property from J. A. Calhoun, together with the ticket agent franchise, which they had approved. On recommendation of the City Manager that W. l~th Street be designated as a thru street over Persimmon Avenue, and McCracken Road a thru street over N. Persimmon Avenue, Commissioner Stemper moved that the necessary ordinance be prepared to provide for the three stop signs, Seconded by Commissioner Kadet and carried. Thereupon the roll was called on the final passage and adoption of said Ordinance No. 538, the vote being as follow~: Commissioner Hlgglnbotham Aye # Cordell Aye " Kadet Aye m Krlder Aye ~ Stemper Aye Thereupon the Chairman announced that the City Commission of the City of Sanford, Florida, by unanimous vote had passed and adopted said Ordinance No. 538, entitled: AN ORDINANCE OF THE CITY OF BANFORD, FLORIDA, VACATING, CLOSING AND ABANDONING A PORTION OF THAT CERTAIN ALLEY SHOWN BY E. R. TRAFFORD'S MAP OF BLOCK ?, TIER 9, OF THE TOWN OF BANFORD, IN THE CITY OF SANFORD, FLORIDA. In connection with reorganization, Commissioner Krider next moved that A. Edwin Shinholser be re-appointed as City Attorney. Seconded by Commissioner Cordell and carried. Commissioner Kadet next moved that Attorney Gordon Frederick be appointed aa Municipal Judge. Seconded by Commissioner Stemper but failed to carry. Commissioner Krider then moved that Attorney John G. Leonardy be appointed aa Municipal Judge for one year, effective as of February l~th. Seconded by Commissioner Cordell and carried over the dissenting vote of Commissioners Kadet and Stemper. Don Rider, Chairman of Junior Chamber of Commerce Safety Committee, next appeared with further reference to the traffic sign on Park Avenue immediately north of 25th Street, which was installed by State Road Department, and reported of another serious accident caused by vehicle running into the sign, He stated again that it was the opinion of the Jayceee that the sign created a traffic hazard and should be removed. Marion Harman, Chairman of the Traffic Committee, concurred with Mr. Rider, and advised that the Road Deoartment had promised to remove the sign from the street and replace it with an overhead sign. After discussion Commissioner Kadet moved that the City Manager convey the recommendations of the Jaycees and Traffic Committee to the State Road Department. Seconded by Commissioner Stemper and carried. On motion of Commissioner Stemper, seconded by Commissioner Krlder and carried, the Commission next authorized sewer laterals for Block 18 of Ban Lanta Second Section to be in- cluded in the plane and specifications for constructing sewerage facilities for Ozier-Weller Homes, Inc., and Wellborn Phillips, Jr., ~ousing developments. Request next received from Seminole County Chamber of Commerce and Seminole County Sportsmen Association to block off Seminole Boulevard in back of the swimming pool on February 12, for a marksmanship exhibition, and on motion of Commissioner Kadet, seconded by Com- missioner Stamper and carried, same was granted, the sponsors to assume all responsibilities. Letter of appreciation next submitted from Randall Chase, former Mayor and City Com- missioner, for the Resolution of commendation from the Commission. In response to complaints from residents within vicinity of Higgins Terrace against the fast traffic on W. Third Street since it has been designated as a thru street, Com- missioner Stamper moved that #Children at Play" sign be erected on south side of Third Street between Olive and Avocado Avenues, and another on north side near Poplar Avenue. Seconded by Commissioner Krider and carried. A petition from twelve residents within vicinity of Second Street and Tamarind Ave., for installation of street light at said intersection, was next referred to the City Manager and Chief of Police for recommendation. Request from Hunt's Tuxedo Feed Store at 118 Sanford Avenue for a 15 minute loading zone in front of the place of business was also referred to the City Manager and Chief of Police. Commissioner Krider next introduced Ordinance No. 539, entitled: AN ORDINANCE OF THE CITY OF BANFORD, FLORIDA, VACATING, CLOSING AND ABANDONING A CERTAIN ALLEY AS SHOWN BY PLAT OF COTTAGE HILL BUS- DIVISION, IN THE CITY OF BANFORD, FLOHIDA. and same was placed on its first reading and read in full. On motion of Commissioner Cordell, seconded by Commissioner Krider and carried, minutes of regular meeting of January 11, and adjourned meeting of January 15, were next approved. Consideration next given to publishing or posting the 1953 delinquent tax list in ac- co,dance with the terms of the Charter, and on motion of Commissioner Krider, seconded by Commissioner Cordell and carried, the Commission authorized and directed that the 1953 de- linquent tax list be #Postedm in accordance wi~h the legal requirements of the Charter, and also that a display notice of such posting be published in the Sanford Herald. Request next submitted from W. A. Adams to purchase the City owned property described as Lots 1 thru 5 of Block 1 of Tier 9, V. Check's Amended Plat, located on west side of French Avenue between Commercial and Fulton Streets, for the purpose of erecting a bonded warehouse thereon, and after discussion Commissioner Stemper moved that it be referred to Sanford In- dustrial Board for report and recommendations at next regular meeting. Seconded by Commissioner Kadet and carried. On motl cn of Commissioner Kadet, seconded by Commissioner Cordell and carried, the Commission next authorized the removal of fence around the miniature race track in Fort Mellon Park, provided it ie not being used any longer. A delegation, with Volle A. Williams, Jr., as spokesman, next appeared on behalf of Seminole County Historical Society with further reference to their proposal to erect a General Sanford Memorial Museum to house the personal library and furnishings of General Sanford, which h~ve been offered to the City by his daughter, Mrs. Ethel Dow, providing a suitable building is constructed to secure same. Mr. Williams advised t~ t the expiration date on the limited time in which the Historical Society would have to meet the requirements was drawing near, and that they would like to be able to send Mrs. Dow a telegram advising that they had secured the. site for the museum. Knowles Police Captain Roy Tillie City Meeting called to order by the Chairman. The meeting was then opened with "Prayer" by Rev. Herbert J. Bass. T. E. Tucker, President of Fernald-Laughton Memorial Hospital Association next ap- coated with reference to the proposed park~g area around the hospital site on East First Street. He advised that the Diane and soeciflcatione of the new hospital provide for off-street parking on First Btreet side, and requested permission to remove the curb in order to construct a park- ing area of sufficient depth for angler parking of vehicles, which he stated would require a cooperative agreement with the City to cover same because of Federal funds being used toward financing construction of tb~ hospital. Thereupon after discussion Commissioner Krider moved that the City grant the hospital association permission to remove the curb for the aforesaid purposes, subject to approval of City Manager and the Police Department, and that the City Attorney be authorized to prepare the necessary cooperative agreement. Seconded by Commissioner Cordell and carried. Ralph Cowan, Chairman of Banford Industrial Board, next appeared and gave a progress report on the activities of the Board, and of recent organization meeting at which by-laws were adopted and several committees appointed. He then advised of special Joint meeting with Banford Industries, Inc., at which it was agreed to coops rate in establishing a dis- tribution warehouse in Banford for Great Lakes Steel Corporation, manufacturer of Strand Steel Products, and that Banford Industries, Inc.. had signed an agreement, whereby, Gulf Port Steel Company, their state distributor, will furnish the steel for constructing the warehouse building, and Sanford Industries will furnish the site, construct the floor and erect the building, which will become the property of Sanford industries in lieu of three yeal rent. Mr. Cowan then requested the City to convey to Sanford Industries, Inc., for con- elderation of $1.00, t~ property described as Lots 6 thru 10 of Block 1 Tr 9, V. Check's Amended Plat, located on East side of Maple Avenue between Commercial and Fulton Streets, for a site for the warehouse. After considerable discussion, Commissioner Krider stated that he had no objections to the proposal but felt that the City should establish a policy which will provide for all properties conveyed under grant to revert to the City, if and when it ceased to be used for the purpose conveyed. He then asked Mr. Cowan if Sanford Industries, Inc., would adopt a resolution providing for such reversion, and Mr. Cowan agreed to submit such request to the Board of Directors. Commissioner Kadet then moved that the City convey the aforesaid property to Banford Industries, Inc., for consideration of $1.00, with request that if the building is not erected thereon they will convey it back to the City, also, with request that they adopt the prerequisite resolution. Seconded by Commissioner Btemper and carried. Mr. Cowan next submitted report and recommendations of Sanford Industrial Board on the request of W. A.
