Williams Absent: Commissioner John S. Krider, Sr., Meeting call. ed to order by the Chairman. The meeting was then opened ~th "Prayer# by Rev. Henderson. The first order of business being a Public Hearing to consider rezoning certain district of the Zoning Ordinance, the Chairman directed the following legal notice to be read, which was published in the Sanford Herald on March 26 and April 5, LEGAL NOTICE NOTICE OF PUBLIC HEARING ON PROPOSED 195~: CHANGE AND AMENDMENT IN CERTAIN DISTRICT OF THE ZONING OR- DINANCE OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held ~t the office of mission in the City Hall in the City of Sanford, to consider the following change and amendment Florida: the City Com- Florida, at 8:00 o'clock P..M. April 12, 1954, to the Zoning Ordinance of the City of Sanford, The property zoned in District R-1 (Single-Family). located on West side of Sanford Avenue between 10th and 12th Streets, and more particularly described as Lots 1, 2, 3, 4 and 5 of Block 12, Tier 1, and Lots 1, 2, 3, 4 and 5 of Block 13, Tier 1, of E. R. Traffords Map of Sanford, is proposed to be changed to C-1 (Commercial-Hetsil) District. Ail parties in interest and citizens shall hmve an opportunity to behest at said meeting. The Chairman then announced t hat the Commission would be glad to hear from interested parties in favor of, or against the proposed rezoning of the property described in the fore- going notice. There being no objections registered, Commissioner Stamper moved that the pro~rty be rezoned to C-1 (Commercial-Retail) as advertised, and that the City Attorney prepare the necessary ordinance for adoption. Seconded by Commissioner Kadet and carried. Mr. and Mrs. A. Commissioner Stamper next moved Request next received from R. T. Hunt for a "15 Minute" parking space in front of his store at ll8 B Banford Ave., instead of the loading zoned authorized by the Commission. Thereupon after d~ cussion Commissioner Stamper moved that a 12 minutes parking meter subject to ~urther negotiations with Mr. Hunt. Seconded that parking meters be installed on West s~e of Banford Avenue from Second Street north to the Alley, when the meters are available from stock. Seconded by Commissioner aader and carried. Letter next submitted from Municipal Judge Leonardy recommending that the balance of 30 days Jail sentence imposed on Ben Joe be suspended and served under probation because of hie physical condition, as evidenced by attached examination certificate of Dr. Geo. H. Btarke. Bald prisoner havir~ been convicted in Municipal Court on March 26, 1955, Case No. 50880, for brandishing a fire arm in threatening manner, and sentence to pay a fine of $200.00 and cost an8 to serve a period of 30 days in Jail. After discussion and on motion of Commissioner Cordell, seconded by Commissioner Stamper and carried, the foregoing recommendations of the Municipal Judge were accepted and approved. Upon letter of recommendation from City's Auditor, Gordon P. Blitch, and on motion of Commissioner Stamper, seconded by Commissioner Kadet and carried over the dissenting vote of Commissioner Cordell, the Commies ion next authorized and directed the advertising for bids for furnishing a validating machine for the Tax Collector's office. On recommendati~ of the Traffic Committee, the City Manager and Chief of Police, and on motion of Commissioner Kadet, seconded by Commissioner Btemper and carried, the City Attorney was next authorized to prepare the necessary ordinance designating Elm Avenue as a thru street for traffic from First Street south to 20th Street, except at 3rd, 9th and 13th Streets. Consideration ne~t given to recommendation of the City Manager that the $150.00 de- ductable collision insurance coverage on City's fleet of motor vehlclee be eliminated except for the Fire and Police Departments, and after discussion the matter was taken under advise- ment, pending report on number of claims col2ected since such insurance has been in effect. Appraisal report next submitted from J. W. Hall and P. J. Chesterson, local realtors, of their opinion as to the current fair market value of six parcels of City owned property which the Commission authorized to be appraised at meeting of March 29. Thereupon after careful study and disc~sion of same, the Commission felt that the ap- prelects' values were too low, and set the following values on the following parcels of property and authorized it to be sold by advertising for seal bide to be received and opened at regular meeting of April 26. M. 54 The City Attorney next submitted copies of the proposed changes made in certain ordlnanceg for adoption in the new code, and after discussion, several changes were made by the Cpm- : mission and approved. ~ Ordinance No. 540, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, VACATING, CLOSING AND ABANDONING A CERTAIN ALLEY BETWEEN LOTS 83 AND 84, OF ROSE COURT ADDITION, IN THE CITY OF BANFORD, FLORIDA. introduced and placed on first reading at regular meeting of March 22, was next placed on its second reading. Thereupon the roll was called on the final passage and adoption of said Ordinance No. 540, the vote being as follows: Commissioner Higginbotham Aye " Cordell Aye " Kadet Aye " Stamper Aye Thereupon the Chairman announced that the City Commission of the City of Sanford,Flcrida, by unanimous vote had passed and adopted said Ordinance No. 5~0, enttled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, VACATING, CLOSI~ AND ABANDONING A CERTAIN ALLEY BETWEEN LOTS 83 and 84 OF ROSE COURT ADDITION, IN THE CITY ~ BANFORD, FLOHIDA. On motion of Commissioner Stamper, seconded by Commissioner Kadet and carried, the petitions for street lights in Wynnewood Subdivision and on Virginia Avenue between 2nd and 8th Streets were next referred to the City Manager and Chief of Police for survey as to locations, and if feasible for installation, to be placed on priority list for consideration in next fiscal year's budget appropriation. The petition for City to pave balance of streets in Wynnewo~ Subdivision was next referred to the City Manager to contact the abutting property owners to ascertain whether or not they will be willing to pay their pro rata of cost of the paving by depositing the cash in advance. On motion of Commissioner Cordell, seconded by Commissioner Kadet and Carried, minutes of regular meeting of March 22, adjourned meeting of March 23, and special called meeting of March 29, 1954, ne×t approved. The City Manager next advised that Perry N. Teeple will terminate his services with Robert M. Angae and Associates on April 17, as resident engineer on the water and sewer improvements program, and recommended that the City employ him to secure the necessary ease- ments and dirt piling permits from the property owners that will be required in connection with the construction work. After discussion and in view of Mr. Teeple being familiar with the locations of all the sewer and water mains for the entire project, Commission er Stamper moved that he be employed at salary of $100.00 for first week, and that a progress report of his first week's work be submitted at the next regular meeting. Seconded by Commissioner Kadet and carried. On motion of Commissioner Stemoer, seconded by Commissioner Cordell and carried, the Commission next authorized the Ourchase from C~barlie Beck of the three well sites from h~ rpoperty along the old Lake Mary road at price of $1,000.00, in accordance with terms of the option agreement which expires on April 2~, On motion of Commissioner Stamper, seconded by Commissioner Kadet and carried, the matter of amending the grazing animal ordinance was next postponed from April 19, to next regular meeting of April 26. 23O MINUTES April 12 at 8 P.N. 19 .5.~. Kadet Aye , Stemper Aye Said Resolution No. 830 being in words and figures as followS: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFGqD, FLORIDA, APPROVING CONSTRUCTION OF A SEWAGE TREATMENT PLANT WITHIN THREE YEARS TO BE FINANCED BY PARI PABSU REVENUE CERTIFICATES PLEDGING ONLY COL- LATERAL PLEDGED FOR PRIOR AUTHORIZED WATER AND SEWER REVENUE CERTIFICATES. WHEREAS, the City of Sanford, Florida, has heretofore authorized and approved a program of additions, extensions, rehabilitation, and improvements to its water and sewer system and authorized the issuance of $1,175,000.00 water and sewer revenue certificates for such purpose and a Final Decree of the Circuit Court of the Ninth Judicial Circuit in and for Seminole County, Florida, has been entered, validating such issue; and WHEREAS, it has been proposed, in addition to the aforesaid program heretofore ap- oroved and authorized, that the City also make commitment for construction of a sewage treat- ment plant and from the estimates of the engineers and the represen~tives of the fiscal agents it h~s been made to appear to the City Commission that within three years from this date it will be possible, with the issuance of pari passu revenue certificates based only upon the col- lateral pledged for the aforesaid revenue certificates already authorized and validated, to construct such a treatment plant or have same under construction, and the City Commission considers that construction of such sewage treatment plant on such basis Is both desirable and expedient end are agreed that the commitment proposed should be made; NOW, THEREFORE, BE IT BESOLVED by the City Commission of the City of Sanford, Florida, that it is hereby agreed, euthorized, and aoproved, that a sewage treatment plant will be con- structed or under construction by the City of Sanford, Florida, within three ~ears from date hereof, to be financed by pari passu revenue certificates based only upon the collateral pledged for the original revenue certificate issue presently authorized.
