Mrs. Clifford Wilson and Mrs. Mabel Bishop appeared with reference to the provision of the water and sewer bond ordinance authorizing the improvements and extensions to the sewer system, which require all property owners to connect to the new sewers as soon as they are in- stalled and made available. Mrs. Wilson advised that they had Just purchased a new home on Bouth Bummerlin Avenue with new septic tank and did not feel that they should be required to connect to the new sewer that ia being installed to serve that area until such time their septic tank ceases to function properly. Also, that there are approximately twenty other new homes with septic tanks in that area, which would work a hardship on all of them to have to connect to the sewer at this time. Commissioner Kadet then suggested that exceptions be made for property owners with satisfactory septic tanks by allowing them to pay the monthly sewer charge but not connect to the sewer until the tanks require maintenance. Mayor Higginbotham then explained that the sewer improvements program was strictly a health measure for the protection of all citizens and not for their convenience, and that since there are so many unsatisfactory septic tanks within the City that need eliminating as soon as possible, the City could not make exceptions because it would have no way of knowing Just when the others may become a health menace and should be eliminated. Commissioners Krider and Stemper concurred with Mayor Higglnbotham and also explained their views on the sewer improvements program. After further discussion, both Mrs. Wilson and Mrs. Bishop said they understood the City's problem and why no exception could be made for them or anyone else. On recommendation of the City Manager and Water Superintendent, and on motion of Com- missioner Kadet, seconded by Commissioner Krider and carried, the Commission authorized the renewal of water tank maintenance contract with L. L. mJack" Sharps for a period of six years at cost of $~O0.O0 per year. Letter next read from Dr. L. Munson submitting his resignation as a member of the Board of Bond Trustees, and on motion of Commissioner Stamper, seconded by Commissioner Kadet and carried, same was accepted with letter of regret, and appreciation for services rendered. On motion of Commissioner Stamper, seconded by Commissioner Kadet and carried, action on the proposed ordinance to repeal the special garbage pick-up fee was next deferred until next regular meeting. Commissioner Krlder next introduced Ordinance No. 556, prescribing the rates and charges for use of the sanitary sewer system, and same was placed on first reading and read in full. City Manager was next authorized Manager's Association to be held to attend the 40th Annual Conference of the International City in Bt. Petersburg, Florida, on December 5-8, the expenses in connection therewith to be borne by the City. On motion of Commissioner Stemper, seconded by Commissioner Kadet and carried, cur- rent invoices and payrolls, as evidenced by General Fund Ssnford Atlantic National Bank Vouchers Nos. 5845 thru 5977, General Fund Florida State Bank Vouchers Nos. lO21 thru 1025, and Water & No. 1 next apDroved. The following General Fund Vouchers Bewer Revenue Fund Voucher/in excess of $200.00 included in ~he foregoing approval, represented purchases and services rendered under contract: Nos. 5858, 5862, 5903, 5926 and 5959. The matter of setting up and handling a mPayroll Bavings Plan for U. B. Bavings Bonds# for employees who wish to participate in such plan was next brough up for consideration, and on motion of Commissioner Stemper, seconded by Commissioner Krider and carried, same was approved over the dissenting vote of Commissioner Kadet who stated that he did not feel that the City should be required to keep books for the Federal Government. Letter next submitted from the Board of Public Instruction requesting water and sewer service and fire protection for tb~ new school building to be constructed at 27th Street and Laurel Avenue. The City Manager then submitted, cost estimate of $12,500.00 to extend water main and sewer line to the school. After discussion, and in view of the City not having sufficient funds to complete the proposed extension of sewers within the City under the present sewer improvements program, the City Manager was directed to advise the School Board that the City would not be in posit~on to participate in the cost of extending municipal water and sewers service to this new school, but would be favorable to working out an agreement for them to tie on to the water and sewer system. In connection with a proposal of the Hospital Board to grant the City a sewer easement across the hospital property provided the City will connect the new hospital to the sewer, Com- missioner Stamper moved that the City Manager contact the Board for determination of a more def- inite proposal, and to make recommendations to the Commissioner the next regular meeting. Seconded by Commissioner Kadet and carried. On motion of Commissioner Kadet, seconded by Commissioner Stamper and carried, the Commission next authorized payment of $1,457.10 to Peninsula Construction Company for work completed to July 17 on Contract No. 2 of the water and sewer improvements program; $20,295.58 to E. H. Holcomb, Jr., for work completed to July 31 on Contract No. 3; $35,912.86 to Bumby & Btimpson, Inc., for work completed to August 4, on Contract No. 7; and $1,037.99 to Robert M. Angas & Associates for balance of engireering fees due to August 7 in connection with said water and sewer improvements. Commissioner Krider next introduced Ordinance No. 547, amending the Zoning Ordinance so as to extend the time for converting non-conforming uses of ali lands and buildings for an additional five years, and same was placed on first reading and read in full. AN ORDINANCE AMENDING SUBSECTION (e) OF SECTION 15 OF ORDINANCE NO. 362, AS AMENDED, SAME BEING THE ZONING ORDINANCE OF THE CITY OF BANFORD, FLORIDA, SAID AMENMENT E~TENDING TO 15 YEARS THE TIME IN WHICH NONCON- FORMING UBEB BHALL BE CONVERTED INTO CONFORMING UBEB. Commissioner Krider next reported that the Board of County Commissioners had appro- $3,800.00 in their next fiscal year's budget for the Joint development of the proposed for priated Colored Recreation Center, in which he advised that it would be necessary to set up plans the long range program, which would involve some expenses in connection with preparing such plans. On motion of Commissioner Stemper, seconded by Commissioner Kadet and carried, the City Manager was next authorized to advertise for bids for reeurfacing First Street with black-top from Sanford Avenue east to Mellonville Avenue, and Banford Avenue from 5th Street south to 25th Street. On motion of Commissioner Krider, seconded by Commissioner Stemper and carried, the City Manager was next authorized to widen First Street from San C~rlos Avenue east to Mellon- rills Avenue to conform with width of balance of said street, using City labor. The work to be done upon the availability of such labor. The Commission next directed letters of commendation to be sent to the Street and Sewer Departments for the splendid work they are performim~ and for the accomplished improve- ments made by the respective depertments. The following letters next submitted from Sanford Port Terminal & Warehouse Association advising that they do not wish to exercise their option expiring July 1, 1955, to lease a certain portion of the City's lake front property for a period of 99 years, and requesting the Com- mission to rescind its motion of April 28, 1952, authorizing said option: Sanford, Florida July 2?, 1954. Hon. Mayor & City Sanford, Florida Commteelon, Gentlemen: At a regular meeting of the Sanford City Commission held April 28, 1952 a motion was made, seconded and carried to grant to Sanford Port Terminal end Warehouse Association, an option to lease land bounded on the East by Holly Avenue, on the South by Fulton Street, on the West by Mill Creek and on the North by Seminole Blvd., together with land necessary foraturning basin West of Mill Creek, for a period of 99 years, said option to expire July 1, 1955; also an option to lease the property between Holly Avenue and Maple Avenue, option to be for a period of 5 years. Financing arrangements were not completed by This A~soclation; however, we understood that the Sanford Terminal Company has financing arrangements pending and since the objectives of the Sanford Terminal Company and of this Association are similar, the Sanford Por~ Terminal and Warehouse Association does not want to exercise said options. It is respectfully requested that the motion of April 28, 1952 pertaining to this matter be rescinded by motion of the City Commission. Hartwlck, operator of Sanford Bowling Alley at 206 Magnolia Avenue, next appeared and requested tbs Commission to repeal the City ordlnance prohibiting minors and females from frequenting pool rooms, in order that he may lnst~ll pool tables in his place of buslnesa so aa to provide more complete recre~tlon facilities for young people. He advised that many of his customers are ~adles, and also men from the local Naval Air Stetlon who ere under 21 years of age. The City Attorney then advised that the City's ordinance coincides with the State Law, which restricts females and minors from entering any place where billiard and pool tables are kept for hire. A Committee then appeared and protested repealing the ordinance. Rupert W. Strlckland, reoresenting Seminole County Youth Council, at, ted that the request was in competition with the Youth Council's program; that he had no objection to children playing cool, but felt that they should not be allowed to play or visit in public pool halls because of the environment. Rev. Milton H. Wyatt, pastor of First Methodist Church, also spoke against repealing the Ordinance, stating that the Churches are seeking, to promote a program for the youn~ people and that such change would appear to be working against it. He stated in his opinion that bowling and pool should not be placed in the same category. Harold Heckenbach, representinF Seminole County Ch'ldren's Commission, next advised of receiving several telephone calls the ordinance, and recommended that action so as to do what is best for from parents who see~ed very much alarmed over reoeallng the matter be Investigated thorouFhly before taking any the children and not for any one individual. Mayor Hlgginbotham then appointed a committee, consisting of Rupert W. Strickland, Harold Heckenbach, Commissioners Krider and Cordel], and Chief of Police Williams to make a study of repealing the ordinance with recommendations to the CommisSion. Offer next submitted by B. G. Harriman to purchase a portion of the municipal golf described as lot 1 of Lvch Arbor,but same w~s declined because of the pro~erty course prooerty/be~ng under lease to Mayfalr Inn, Inc. John A. Llvock next ~ppeared with reference to immediate need for reoairln~ sanitary sewer in back of his dwelling at 2~03 Sanford Avenue, and same w~s referred to the City Manager who advised that a work order h~d already been issued for such repairs. Application ne×t submitted from the Food Mart for permit to sell beer and wines, to be consumed off premises, at 2~71 Park Avenue, and on motion of Commissioner Krlder, seconded by Commissioner Kadet and carried, same was approved upon recommendation of Chief of Police.
