The City Commission of the City of Sanford, Hall in the City of Sanford, Florida, at 8:00 o'clock P. Present: M. November 8, Florida, met in regular session at the City 1954. Brooks, Jr., to promote professional baseball next appeared with reference to the Meeting called to The meeting was then ooened with "Prayer" by Rev. W. Members of the Baseball Committee recently formed spring training in Sanford, with J.~. Davis as spokesman, City's plans for such a program. Thereupon the Mayor reported on letter received from Richmond Virginians Baseball Club advising of their plans to return again in 1955, and also of the plans of New York Giants to bring their Indianapolis farm team to Sanford for spring training. He also advised that ar- rangements had been worked out for housing both teams, and that the only requirement on part of the City, other than furnishing the memorial stadium facilities, is to put the old baseball diamond in good playing condition. After discussion Commissioner Kader moved that the City offer both clubs a contract for use of the City's facilities on same terms and conditions as last year's with Richmond Club, and that they be turned over to the Baseball Committee for further negotiations. Seconded by Commissioner Krider and carried. The said Baseball Committee consists of the following: J. C. Davis, W. J. Peacock, Robert J. Bauman, J. D. Cordell, Zeb Ratliff, W. G. Kllbee, Forrest Breckenridge and Fred A. Dyson. A letter in behalf of the Commission was next directed to be sent to the New York Giants, expressing appreciation of their being in Sanford, commending them for their splendid operation of the Mayfair Inn and the golf course, and to extend a cordial invitation for their baseball clubs to train in Sanford again. Letters next submitted from the City Physician and Municipal Judge, recommending that the sentences imposed against O. Allen Register by the Municipal Court on October 10, 1954, be remitted and that he be released because of his physiclal condition. The said prisoner having been convicted in Municipal Court for "Drunkenness", "Reslstlng Arrest", and "Begging", and sentence to pay fines of $60.00 and cost or serve 75 days in Jail. After discussion, and upon recommendation of the Chief of Police, Commissioner Krider moved the acceptance and approval of the foregoing recommenda~ons of City Physician and Municipal Judge. Seconded by Commissioner Cordell and carried. Wilson Holt of Goodbody & Company, fiscal agents, and Robert M. Angas, consulting en- gineer, next appeared with reference to the proposal to adjust the sewer rates for eom- m~rclal usages. Mr. Holt then advised that the sewer rates, as established and adopted in Sectlon 3.04 of the Bond 0rdinance, was a binding contract between the City and the bondholders to impose a~ collect same, and that in his opinion the City has nc legal authority to change or reduce the initial rates until the covenants of the bond ordinance have been fully comp~ed with and it is shown thor sufficient revenue ~ being~llected, over and above such requirements set MINUTES 315 November 8 at 8 P.M. 54 City Commission, Sanford Florida .................... ~ .......19 j whether or not a reduction in rates could be made until after a year's experience on revenue collections under the initial rates. ~-~ The City Nanager concurred with Mr. Holt and advised that by using the actual figures from first month's billing as a basis for computing the estimated revenue from sewer charges, the revenue for 195~-55 would be approximately $9,000.00 less than the engineers estimate, which would leave a surplus of less than $1,000.00 from first year's collections. He further stated that it would not be feasible to make any reduction in rates for the first year and meet the commitments against the sewer revenue, but that after the first ~ar, possible ad- Justments could be made. Engineer Angas then explained how they strived at the sewer rates and estimated revenue '-' to be derived therefrom by making a thorough analysis of all water consumers' bills for year ~ 1953 and taking the average over twelve months period. He also advised that water consumed for certain types of commercisl usages, such as air conditioning, could be discharged into storm sewers by separate metering, which would eliminate the excessive charges for such usages. ~- Engineer Angas further stated that he would like for the City to have at least three months actual e~perience on revenue collections from sewer charges for comparison with his estimates before making any recommendations for adjustments or reductions in the initial rates. Commissioner Kadet stated that on their excessive sewer charges, and He pointed out that the fiscal agents there are certain commercial users that need relief now suggested an adjustment for them on a percentage basis. had advised the Commission when submitting the proposed rate schedule that there would be certain commercial usages subject to adjustment, and that such adjustments should have been taken in consideration and provided for in estimating the net revenues. Commissioner Stemper concurred with Commissioner Kadet. Commissioner Krider recommended a minimum and maximum rate for al~ commercial users of 50,000 gallons of water or more. Mr. Holt then advised that adjustments for'particular commercial usages probably were taken in consideration in arriving at the estimated net revenues to be derived from sewer charges, but recommended that a re-survey be made from the actual billings on commercial users to determine whether or not the actual revenues are ma-e or less than the estimate before setting up a formula for adJustments. After further discussion the fiscal agents and consulting engineers were authorized and directed to make a complete re-survey and computation of the sewer revenues, based on actual billings for commercial usages, and to project the net revenues on that basis. A group of citizens from Goldsboro with Herbert Cherry as spokesman, next appeared to fine out if sanitary sewers will be extended in certain areas of tl~ section under the present sewer improvements program, and after discussion the inquiries were referred to the City Manager to furnish them a map showing the locations of the proposed sewer e×tensions. Henry Caldwell next appeared with reference to outside toilet facilities he recently had installed for his tenant houses in Goldsboro, which do not meet the City's sanitary code and which were installed without a permit. He requested a permit to use these toilets, claim- ing that Roy Wall, plumbing contractor, installed ~Hem under contract while he was away on vacation and he thought the contractor would make all arrangements for permit and City ap!~roval before doing the work. After discussion he was advised that the City could not grant him to use the facilities because of not conforming to the sanitary code, and referred him to Mr. Wall to ~rk out some 316 MINUTES City Commission, Sanford, Florida, November 8 at 8 P.M. .19..~?.. the Commission next authorized an expenditure of $25.00 for an advertisement in the High School Year Book. Ordinance No. 551, entitled: "AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NUMBER q62 OF SAID CITY, AS AMENDED, SAID oRDINANCE BEING AN 0R- DINANCE~ESTABLISHING A ZONING PLAN WITHIN THE CITY OF SANFORD, SAID AMENDMENT TRANSFERRING CERTAIN TERRITORY IN DISTRICT R-1-A TO DISTRICTS R-1 AND R-2 IN SAID CITY, AND ALSO ANENDING SUB-SECTION A OF SECTION 8 TO PERMIT PROFESSIONAl, OFFICES IN THE R-2 DISTRICT UNDER THE CONDITIONS HEREIN SPECIFIED." introduced and placed on first reading at regular meeting of October 25, was next .placed on 1ts final reading. Thereupon the roll was called on the passage and adoption of said Ordinance No. 551, the vote being as follows: Commissioner Hlgginbotham Aye " Cordell Aye " Kadet Aye " Krlder Aye " Stamper Aye The Chairman then announced that the City Commission of the City of Sanford, Florida, by unanimous vote had passed and adopted said 0r~inance No. 551, entitled: "AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NUMBER 362 OF SAID CITY, AS AMENDED, SAID ORDINANCE BEI~AN OR- DINANCE ESTABLISHING A ZONING PLAN WI?HIN THE CITY OF SANFORD, SAID AMENDMENT TP~NSFERR~ CERTAIN TERRITORY IN DISTRICT R-1-A TO DISTRICTS R-1 AND R-2 IN SAID CITY, AND ALSO AMENDING SUB-SECTION A OF SECTION 8 TO PERMIT PROFESSIONAL OFFICES IN THE R-2 DISTRICT UNDER T~ COMDITI©NS ~UEP£IN SPECIFIED." On recommenda~on of the City Manager, and on motion of Comn~Isaloner Krlder, seconded by Commissioner Stamper and carried, the pension of J. B. Quattlebaum, retired policeman, was authorized to be increased from ~87.25 to $100.00 oar month. The City Manager next submitted letter from Sa~ord Housing A~thorlty advising that they are withholding~ayment of City's pro rata of shelter rent on the hous~& projects for lest fiscal year, pending City repairing and resurfaclng the streets around Castle Brewer Project. He then advised t~hst survey and estimate had been made on such street improvements and that the work would proceed Im~edlately. The cost estimate for street materials bei~ $2,200.00. On motion of Commissioner Stemper, seconded by Commissioner Cordell and carried, the Commlss!m next aut~orlzed an afvertlsement placed in the Pollcemen's Annual at cost of ~25.00. On motion of Commissioner Stemoer, seconded by Commissioner Kadet and carried, the ~j Manager City Attorney, City Clerk and Cltv Commissioners were nezt authorized to attend the annual convention of the Florida League of Municipalities in Tamps on November 21-23, the expenses in connection therewith to be borne by the City. Bill of Robert M. Angas & Associetes, consulting engineers, in sum of $2,113.40, sp- oroved by the City Attorney and City Auditor, for balance of engineering fees due thru November 5, 195~, in connection with the water and sewer improvements program, neyt submitted, and on motion .of Commissioner Kadet, seconded by Commissioner Cordelt and carried, same was approved and payment authorized. On motion of Commissioner Kader, seconded by Commissioner Cordell and carried, the Com- mission next authorized payment of $1A,073.22 to E. H. Holcomb, Jr., for work completed on Contract No. 3; $23,332.71 to Hubbard Construction Company for work completed on Contract No. 4, $38,827.83 to Sullivan, Long & Hag~'erty for work completed on Contract No. 5; $646.87 to Sulli- van, Long & Nsggerty for work completed on Contract No. 6; and $26, 550.68 to Bumby & Stimpaon Inc., for work completed on Contract No. 7. MINUTES 317 City Commission, Sanford, Florida, .....~...o.~..e..~..'g...e.?...~....~..'9.....8.....~..:...~., .......... 19....~..~ Street and Cedar Avenue, next submitted, and on motion of Commissioner Krlder, seconded by Commissioner Stamper and carried, the following resolution was adopted: Be it resolved by the City Commission of the City of Sanford, Florida, in regular meet- ing assembled, that the Mayor-Commissioner be, and he hereby is, aut~mrized to enter into an agreement with the Atlantic Coast Line Railroad Company, and to sign same on behalf of said City, whereby the said Railroad Company gives and grants unto the said City the right and privilege to lay and maintain, for the purpose of a sewer main, a line of 30-1nch reinforced concrete pipe across the right of way and underneath track of the Railroad Company et Sanford, Florida, st Second Street, at a point 1933 feet northwestwardly, of the Railroad Company's Track #3, from the point of switch st with the Railroad Company's main track, which point of switch is measured along the center line the Junction of said Track #3 5,238 feet southwardly from mile post 766; as particularly described in said agreement, which agreement is dated October 29, 1955. Commissioner Stemper next brought up matter of erecting a portable stage for the memorial stadium in order that it may be utilized more for band concerts, musical orograms, etc., and after discussion same was referred to the City Manager for cost estimate. Commissioner Kadet next brought up matter of itinerant ~hotogrsphers doing business in Sanford without paying a municipal license, and was advised by the City Attorney that those representing out-of-state concerns were e~pt from such license tax under the provisions of the Interstate Commerce Law. After discussion the City Manager was instructed to take such action as necessary to force itinerant photographers to comply with the City's Code. Wilson, together with R. T. Milwee as spokesman, next appeared with further reference to the City furnishing wator and sewer facilities for the new ellmentary School bulldlng which is being constructed outside the Cit? Limits at 27th Street and Laurel Avenue. The City Manager submitted cost estimate of $5,326.00 for redesigning the proposed sewer extension from 2hZh Place to the city limits in order to service the school, $5,258.55 for extending a sewer from City Limits to the school property, and $4,318.20 for extending 6-inch water main from City Limits to the property, s total cost of $14,902.75 for both water and sewer lines. He also advised that the extension of sewer from 24th Place to the City limits was not lnc}uded in the present construction program but was one of the deferred extensions in the bob-tailed.program. Supt. Milwee then advised that the School Board would be willing to pay the cost of $9,576.75 for extending the water and sewer lines from the City Limits to the school property provided the City will reimburse them by applying the school's monthly water bills and sewer service charges toward such cost, but d~d not feel that they should be required to pay for re- designing the line inside the City. After discussion, and at the suggestion of Commissioner S~emper that the School Board submit a request for the Board of County Commissioners to participate in the cost for provid- ing the aforesaid facilities for the school, since it is located outside the City and will serve county children as wel~ as those residing inside the City, action ~s deferred, pending a Joint meetln~ of the School Board, the Board of County Commissioners and City Conmi~sioners to discuss the facts and figures of the program.
