THIS AGREEmeNT, Made this 29th day of December, 195~, between CITY OF SANFORD,
a municipal corporation, hereinafter called "City", and CO~TY OF SEMINOLE, a polltl-

cal subdivision of the State of Florida, he-elnafter called "County",
WITNESSETH
%fHEREAS, in order to expedite the project for wld enlng and repaving of French
Avenue in the City of Sanford, Florida, it was desirable that City and County give the State
Road Department of Florida, hereinafter called "Department", assurance that City and County
would acquire and provide borrow otis and e~sements for drainage ditches necessary to perfor-
mance of the contract awarded by the Deo~rtment for said oroJect, and would indemnify Department
and its contractor against loss in connection with scm~lring and providing same, and such as-
surance has been given by City and County by Resolutions adopted by their respective governing
bodies on December 29th, 1954, and
WEEREAS, City had previously agre~'d with County and Department to acquire rights-of
way necessary for said project, and C~ty has agreed to assume sole financial responsibility for
acquiring said bor~ow pits and drainage ditch easements and for indemnifying and holding the
County as welI ss the Department and its contractor harmless from any loss or expense arising
therefrom,
NOW, THEREFORE, in conslderatlon of the oremlses and of the agreement of the County
to acquire solely at City expense, and with no expense to County, any such borrow pit or ditch
easement as shall require County action for acquisition, City has agreed and does k~ reby agree
that it assumes sole financial responsibility for acquiring and providing the said borrow
and drainage ditch easements, and that it will indemnify and hold County harmless from expense
or loss arlsirk~ therefrom, this Agreement being in addition to City's prior assurance to De-
oartment and its contractor to same effect ss applicable to them.

The City Manse'er next submitted the follow!ng schedule for adjustment of sewer
service

At the meeting of December 27, 1954, the City Com~isslon requested information
on sewer service charge adjustments with three (9) schedules based on total
a~Justments of (e) !~4,000 (b) $~,000, and (c) ,~2,000, with a $200.00 leeway
to arrive at easily handled percentages. It was suggested that the schedule
also be computed on a varying oercentaCe basis for average montl~lY sewer bills
from ~5.00 to $10.00 and for bills $10.00 or more.

There are 105 commercial w~ter accounts that average ~5.0 or more
The total amount over $5.60 for these accounts is $670.20. 11 of these
acco~mts, however, are not conoected to sewers and therefore, ~$65.79 is
lost ,~s sewer revenue. This reduces the number of accounts to 93 with an
average monthly revenue of 60~.41 or f~7,252.92 per year.

Commissioner Cordell concurred with Commissioner Krlder.
Mayor Higglnbotham pointed o~t that the estimated revenues to be derived from
sewer service chs rges were based on rates compiled and fume. shed by the Fiscal Agents and Con-
sultlng Engineers, which did not anticipate any bills to exceed ~30.00 peTmonth, and that he
had consulted with former Commiss~.oners who were on the Board at the time the rate schedule
was adopted and it was not their intent to impose charges in e~:cess of those anticipated
by the Fiscal Agents an5 Engineers. He further stated that in view of the excessive bills
being lmoosed under the rate schedule adopted, of wi:lch some exceed $50.00 per month, he felt

After further discussion, the roll was called on the motion of Commissioner Stemper,
which carried over the dissenting vote of Commissioners Cordell and Krider.
On motion of Commissioner Krider, seconded by Commissioner Cordell and carried, '~
minutes of regular meeting of December %3, and adjourned meeting of December 22, Regdlar Nesting
of December 27, and adjourned meetingof December 29, 1954, next approved.
There being no further bus~ness to be ~ransacted by the outgoing Bo~rd, Commissioner
Stemoer moved that the meeting adjourn sine die. Seconded by Commlssloncr Kadet and c~rried.
At this time Commissioner Hlgglnbotham exoressed his thanks and appreciation to the
other members of the Commies~ on, the employees in the various departments, the citizens, radio
and press for their splendid cooperation during his term as Mayor.
Commissioners Kadet and Stemper also expressed their appreciation for the coopera-
tion from the foregoing during their terra as Commissioners.
The Commission then reconvened for the purpose of organization, Commissioners
Jack Ratigan and F. D. Scott signing the oath and ac(~eptance of office and being seated as
Commissioners of the City of Banford, Florida, for three year terms.
On motion of Commissioner Cordell, seconded by Commissl~r Ratigan and carried,
Commissioner Higginbotham was next appointed temporary Chslrman, pending the election of a
Mayor.
The first order of bus,ness beingthe election of a Mayor for t~ ensuing year,
Commissioner Cordell nominated Commissioner Krider.
Commissioner Krider declined the nomination because .of business reasons, and then
nominated Commissioner Cordell.
Commissioner Ratigan moved that the nominations be closed and that the Cl~rk be
instructed to cast a unanimous ballot forths election of Commissioner Cordell as Mayor of
the City of Sanford for the ensuing year. Seconded by Commissioner Krlder and carrled
unanimously.
Thereupon Commissioner Cordell signed the oath and acceptance of office and was
duly installed as Mayor of the City of Sanford for~e year 1955.
Letter next read from the Kansas City Athletics agreeing to use the baseball
for a two weeks try-out period during February under the conditions offered by
facilities
the City.
The City Manager then reported that he had worked out satisfactory arrangements
with the American Legion Fair Association to use other City property in connection with their
fair, whlch will be conducted during the baseball try-out period, and that neither would
interfere with the other.
After discussion and on motion duly carried, the Commission approved the use of
the baseball facilities for the aforesaid try-out period, and the City Manager was authorized
to work out the necessary arrangements.
The following proposal next submitted from Consoer, Townsend and Associates, Con-
suiting Englneers, for reviewing the City's sewer improvements program:

The City Manager then advised that the aforesaid engl~ers had made a survey, study

did not feel that this minor port!on of the program would warrant an expense of $750.00 for out-
side consultant engineering, which he did not feel was necessary.
After discussion the Commission ack, coted the recommendatlan of the City Manager.
The City Manager next reported th.t he had received a copy of the contruction
plans for French Avenue, and t~t it will ~e necessary for the City to relocate the 6-1nch
water math in the street so~th of 25th Street and elthr lower aporo×Imately 5~00 feet of the
la-lnch tr. nk llne between the water plant and 25th Street or relocate the entire line of ap-
oro×Im~tely 6000 feet· He then advised that the City could relocate the 6-1rich m~In with its
own forces, which w~ll recu~re the ~urchose of aporo~lmately ~5,500.00 of materials, but
could not lower or relocate the l~-lnch line because of not having the proper equipment. He
further advised that H. J. Cr~ggs Construction Company, who has the contract for reconstructing
French Avenue, had submitted a tentative price of $2.00 per foot for lowering the 12-1nch
line, and $2.75 per foot to relocate it, the City to furnish all materials. The Manager then
recommended that he be given a~thorlty to purchase the necessary materials for relocatin~ the
6-inch line without advertising for bids, in order to ezpedlte the work, and t~t th~ City

After discussion ~nd in v~ew of the emergency, Commissioner Hig~lnbotham moved that
t!~ City employ Craggs Const~ction Company to relocate the 14-inch trunk llne at cost of
$2.75 per foot, so ns to remove it from underneath the street pavement, and that the City
M~nager be ~otkorlzed to purchase the necessary materials to meet th~s situation as it comes
up. Seconded by Commissioner Kr~der and carried.

7th Street, and advised that Mscasohalt Corporation had s~ree~ to ~old off on resurfaclng it
in or, er to g'ive the City sufflclent time to w~Sen it to 13th Street if the City so desire.
After discussion, and in v~ew of the congested traffic on Sanford Aven~ from 13th
Street north, Commlssi~ner Kr!~er moved that the City Manager be aut~ized to widening it south
to lSth Street, if the work can be done without laterferlng with other work already scheduled
for the Street Department. Seconded by Commissioner Scott and carried.
