On motion of Commissioner Rstigan, seconded by Commissioner Higginbotham and carried, minutes of regular meeting of March 28, 1955, approved. J. M. Blythe, owner of the W~ of Block 1 of Tier 8, E. R. Trsffords Map, located between Laurel and French Avenues and Commercial and Fulton Streets, appeared and requested the City to close and abandon the west portion of the alley dividing said property in order that he may erect a building thereon. He offered to convey to the City a 14 ft right o~ way off the east end of the north half of said property for a public alley, and grant a 14 ft. utility ease- ment across the east end of the south half in exchange therefor. After discussion, and on recommendation of the City Manager, Commissioner Higginbtham moved the acceptance of the proposition of Mr. Blythe, and that the City Attorney prepare the necessary Ordinance to vacate and abandon the alley between ~he W~ of Block 8 of Tier l, E R Trafford's Nap. Seconded by Commissioner Ratlgan and carried. Edgar Vickers, representing Miss Jeannette L~ng, owner of colored tenant houses at 404, 406 and 408 Pine Avenue, next appeared with reference to notice received from the building Inspector condemning said houses because of inadequate plumbing facilities, including kitchen sinks. He requested the Commission to ~?ive the reou~rement for installing sinks in the houses, claiming that the tenants would not use them. Mr. Vickers also pointed out the number of similar houses in the City that do not have sink facilities and stated that he felt they were being discriminated against. After discussion Mr. Vickers was advised that Board of Adjustments and ~ppesls, in accordance with the Bu~.lding Code, but in view of the terms of the Commission granted him 90 days from date Notice of Appeal to the Board of Adjustments following bids ne~t submitted his appeal should be submitted to the provisions of Section ll2 of the office of all members of said board having expired, The Department: ORANGE STATE 0IL COMPANY PURE OIL COMPANY of appointment of new members in which to file and Appea}s for furnishing oremlum gasoline for the Police BIDS .2~5~ per gal. .2475f " " PHILLIPS "66" (Mac's Oil Company) .233 " " GULF OIL COMPANY .253 " " Note: Bid of Phillips does not include the furnishing of any dispensing equipment. After comparison of the bids submitted, Commiesloner Higglnbothsm moved the acceptance of bid of Orange State Oil Company st price of 22.~5~ per gallon. The C~ty Manager next reported on survey of the property requested by Seminole County Post ~282 of Veterans of Foreign Wars for a site for their proposed C~ub House, in which MINUTES City Commission, Sanford, Florida, Aorll 11 st 8 ?. Seconded by Commissioner Iiatigan and carried. On motion of Commisalomr Higginbotham, seconded by Commissioner Ratigsn and carried, City Manager Knowles was next authorized to attend a Short Course for City Managers to be held in Naples, Florida, on April 2~-26, and City Clerk Sayer appointed ae acting manager during his absence. Letter next submitted from Mrs. Lucy W. Moughton, tendering her resignation as Librarian of the Sanford Public Library, effective April 15, 1955. ~fter discussion Commissioner Ratigan moved that Mrs. Moughton's resignation be ac- Cepted with regrets, and that she be presented with a Resolution from the City Commission, to- gether with a Scroll an~ Silver Plate, in recognition of her 26-years of service as L~brarian for the City. Seconded by Commissioner Scott a~ carried. Commissioner Migginbotham then moved appointed as Librarian to f~ll the vacancy to be Seconded by Commissioner Scott and carried. that Mrs. Sara King, Asslstant~Librarlan, be created by resignation of Mrs. Moughton. Bill of Craggs Construction Company in amount of $4,945.50 for furnishing and in- stalling ~21 lin. ft. of 36-inch storm pipe of French Avenue, next submitted for payme~, and on recommendation of the City Manager, Commissioner Hlgglnbotham move8 that it be paid from the budget appropriation for sewer extensions. Seconded by Commissioner Scott and carried. On motion of Commissioner Scott, sec6nded by Commissioner Ratigan and carried, cur- rent invoices and payrolls ne~t approved, as evidence8 by General Fund Sanford Atlantic Na- tional Bank Vouchers Nos. 7051 thru 7183; General Fund Florida State Bank Vouchers Nos. lll5 thru 1147; Water & Sewer Revenue Fund Banford Atlantic National Bank Vouchers Nos. 15 thru 1~; Water & Sewer Construction Fund Sanford Atlantic National Bank Vouchers Nos. 32 thru 36; and Water & Sewer Construction Fund Florida State Bank Vouchers Nos. ql and ~2. On recommendation of the City Manager, and on motion of Commissioner Higginbotham, seconded by Commissioner Scott and carried, the Commission ne×t appointed Dr. T. F. McDaniel as temporary City Physician during the illness of Dr. J. N. Tolar, City Physician. Bill of Robert M. Angas & Associates in sum of $2,99~.03, approved by the C~ty At- torney an8 City Auditor, for balance of engineering fees ~ue thru April 8, 1955, in connection with the water and sewer improvements program, next submitted, and on motion of Commissioner Rstigan, seconded by Commissioner Hlgginbotham and carried, same was approved and payment authorized. After discussion, it ~ was the opinion of the Commission that the City should not undertake to take over the maintenance of th~ aforesaid streets until such time they are defined by legal descrlotion. Commissioner Ratlgan next introduced Resolution No. 8~4, and after being read in full, moved its passage and adootion. The City Attorney next eubm~tted his revised recommendation and oolnlon concerning the recommendation of Chief of Polloe Williams that Section 16 of the Charter be amended by 1955 Leglslat~re so aa to grant the ~unlcipal Court authority to impose a fine up to ~500.00 for violat~ons of certain gambling ordinances. Me stated th~,t after further considering the matter and taking into consideration the current vslue of dollar ae compared w~th the dollar value at time the Charter was last amended, that it wee hie revised recommendation to concur with the Chief of Police. Commissioner Hlgglnbotham then etated that he was not in favor of increasing the fines in Municipal Court and would oppose granting it aut~rity to impose fines up to $500.00 un]ess it wss restricted to certain types of gambling, euch as bo~ta and lottery, which the Commission agreed to do by appropriate ordinance. After further discussion Commissioner Ratlgan then moved that the City Attorney pre- pare a Bill, for passage by 1955 the Municipal Court authority to and carried. Legislature, to amend Section 16 of the Charter eo as to grant impose fines up to $500.00. Seconded by Com~issioner Scott On recommendation of the Civil Service Board, and on motion of Commissioner Scott, seconded by Commissioner Ratlgan and carried, the Commission next authorized the following amendment to be included in the Bill to amend certain sections of the Civil Service System, authorized by the City Commission at meeting of March 14, 1955: To amend Section 6 to read as follow~: In the event of a vacancy of any Grade of the Police Department or the Fire Department, said Civil Service Board shall hold an examina- tion among those members of the next lower grade who ahaI1 have completed not lees than two years service as Patrolman First Class ~ Fireman First Claes witht he City, as the case may be, for a promotion to said vscancy and make recommendation of eligibles therefrom, if they pass the required examination and eecur~ the g~ades required by rules prescribed by the Civil Service Board. If all the qualified members of such lower gra~e desire not to stand examina- tion for promotion, or if none of such members are, after exsmlnatlon, found to be eligible for appointment to said vacancy, an examination open to the other members of the next lower grade, the general public, and other members of the department shall be held by the Civil Service Board. Further consideration next given to ways and meane of financing the existing police and fire oenslon systems in order to ~ace them on an actuary s~nd basis, After a lengthy discussion it was felt that it would be impossible to work out a solution in time for adoption by the 1955 Session of I,egislature, but in order to increase the revenue for the Police Pension Fund, and to strengthen its plan, it was moved by Com- missioner Ratigan, seconded by Commissioner Scott and carried, that a Bill be prepared for passage by 1955 Legislature to enact the following amendments to said pension fund: To Amend Section ~ so that the monthly contribution of three percent of the salaries of the members of said Police Department may by Ordinance adopted by the City Commission be increased u~ to and including five percent of such salary on the sole condition that the amount of any such increase shal~ be matched by City funds authorized by the City Commission in said Ordinance to be paid into ssld pension fund. To Amend Section 9-A so as to require any members of the Police Deoartment to have attained the age of fifty-five years, and shall have served for a oeriod of twenty-five years before being eligible for retirement. 388 MINUTES Aoril ~1 at 8 P M. lQ 55 City Commission, Sanford, Florida, . ................................................................. by motion duly adopted, the Commission authorized a Bill for passage by 1955 Legislature to empower the City to make payments and contributions out of municipal funds to said Firemen's Relief & Pension Fund, as the same is now constituted or at any time hereafter may be lawfully constituted, the times of making such payments and contributions, the amounts of same, whether the same shall be made, and the sources from which the funds shell be derived, to be within the sole discretion of the Cltf Commlss~ on. On motion of Commissioner Hlgglnboth~m, seconded by Commlss~oner Ratlgan and carried, the Commission next authorized and directed that the City oresent James A. Wright with a "Silver Plate", with aporoori~te wording, in recoFnltlon of bls services rendered to the community in assisting in securln~ French Avenue reconstruction project. Commissioner Ratigan next moved that Mr. Harry C. Seibold, of Rlc~nond, Va., be made an "Honorary Mayor" of the City of Sanford for his expressed interest in the recreation and welfare of the community.
