On motion of Commissioner Krider, seconded by Commissioner HigglnBtham and carried, minutes of regular meeting of April ll, 1955, approved. Clifford McKibbin, Jr., Chairman of Chamber of Commerce Industrial Committee, next appeared and outlined the plans of two local men to establish a plywood plant in the community, which would represent a capital investment of approximately $250,000.00. He advised that the proposed 62 acre site for the plant is located outside the city limits south of 27th Street between Sanford Avenue and the Railroad, in the Southwest Quarter of Section 6, Township 20 South, Range ~l East, and requested that the Commission go on record as recommending that this property not be annexed to the City for the next ten years. The Commission then advised that the City had alreaSy submitted a request to the Legislative delegation to grant it authority to annex Certain territory by Act of 1955 Legis- lature, which included the corporate limits 3~0 ft south of 2?th Street. After dlscusslon, in which Mr. McKibbln advised that the proposed annexation to include part of tNe proposed site would no,be objectionable, Commissioner Higginbotham moved that the Commission recommend against annexing for the next ten years the remainder of the property in Southwest Quarter of Section 6, Township 20 South, R~nge 31 East, commencing 330 feet south Of 27th Street between Sanford Avenue and the Railroad. Seconded by Commissioner Krider and carried. Mr. McKibbin next submitted a request for the residents on West side of Mellonville Avenue between 24th and 25th Streets for the City to extend a sewer line from the new sewer main on Bay Avenue to the back of their property, instead of requiring each one of them to run a line to said sewer. After discussion, and in view of said sewer line on Bay Avenue having been eliminated from the sewer extension program by action of the Commission at meeting of February 21, 1955, and was constructed without authorization from the City, the Commission deferred action on the foregoing request of Mr. McKibbin. Commissioner Krider then moved that the City withhold payment to the contractor for constructing the sewer on Bay Avenue until the Commission secure information from Engineer Angas as to authority for construction after it had been eliminated from the program. Seconded by Commissioner Scott and carried. A. B. Peterson, Jr., and M. L. Raburn, Jr., next appeared on behalf of the Junior Chamber of Commerce and outlined their proposal to erect a replica of Fort Mellon as near as possible Zo the original site, and requested the City to furnish the land. Major Wheeler, owner of Lot ~8 of M. M. Smith's 2nd Subdivision abutting on a platted un-named ~0 feet street between 15th end 16th Streets, next appeared with reference to his dwelling extending five feet over in said street, which was discovered by a recent survey. He requested the City to vacate the street sad sell the oroperty to him, since it has never been opened for public use, so as to eliminate having to move the dwelling. After discussion, end in view of City having no legs], authority to sell property that has been dedicated for street purposes, Commissioner Krider moved t.hat the City vacate the West 10 feet of the aforesaid street in order to clear the dwelling for Major Wheeler, and that the City Attorney prepare the necessary ordinance for adoption. Seconded by Com- missioner Higginbotham and carried. M. L. Goodrich for furnishing 2½-1nch 400# test (Jupiter) Fire Hose at $1.70 per ft., and the bid of ~erican-LsFrance for furnishing l~-lnch 400# test hose at $1,26 per ft., the total of the two bids not to exceed the budget appropriation of $1,7~0.00, the quality of each size to be as recommended by the City Manager and Fire Chief. Doudney in sum of $191.~8, for $4.70 each, and ~6 neckties at $1.00 services rendered in surveying school property on W. 16th Street for the proposed Colored Recreation Park, next submitted, and on motion of Commissioner Ratigan, seconded by Commissioner Scott and carried, same was approved and payment authorized from the funds reserved for such purpose in the Public Project Fund. Upon request of the Chief of Police, and on motion of Commissioner Higginbotham, seconded by Commissioner Scott and carried, the Commission next authorized employment of special counsel to prosecute the lottery and liquor cases pending in Municipal Court at a fee not to exceed $25.00 per case, to include carrying to conclus*on any cases that may be appealed. Commissioner Scott next introduced Resolution No. 845, and after being read in full, moved its passage and adoption. LUCY W. M~GHTON, AS LIBRARIAN FOR THE CITY OF SA~'ORD. Whereas, Mrs. Lucy W. Moughton has tendered her resignation as Librarian of the City of Sanford after twenty-six years of faithful service in that capacity; and Whereas, in the oerform, ance of her duties ~uring the years she has served in that capacity she has applied herself diligently to the work at hand, has maintained an active and enthusiastic interest in keeping the standards of the Sanfor5 Library at the higest level, has met t~-,e public with gracious courtesy, and in all chases of her work has rendered perform- ance over and abo~e the simple call of duty, and by the nature of such performance should have official recognition in behalf of this community and its citizens; Now, Therefore, Be It Resolved by the City Commission of the City of Sanford that the Commission, in behalf of itself and in behalf of tbs citizens of Ssnford, as well as all others MINUTES 393 City Commission, Sanford, Florida, April 25 at 8 P.M. 9 55 hereby express to Mrs. Lucy W. On motion of Commissl'm~r Hig~lnbotham, seconded by Commissioner Krlder and carried, the Com~nission next authorized an expendltu:-.e not to exceed $125.00 ~r payment of one-half of cost of purchase and installation of electric water fountain in the Tourist Building. Said e~penditure to be paid from the budget appropriation for summer recreatbmprogram. On motion of Commissioner Scott, seconded by Commissioner Krider and carried, the City Clerk and City Attorney were next authorized access to Safety Deposit Box No. 177 at Sanford Atlantic National Bank for the purpose of securing and presentin~ for payment, $3,000.00 U. S. Government Bonds held by the ~nsurance Fund and $1,500.00 U. S. Government Bonds held by the Water Meter Deposit Fund, which matured on April l, 1955. On motion of Commissioner Krider, seconded by Commissioner Ratigan and carried, the Clerk was next aut_horized to re-invest the said funds in sum of $~,500.00 in U. S. Government, 2.76%, Series "K" Bonds, maturing 12 years from date of issue. There being no further business the meeting adjourned. On motion of Commissioner Krlder, seconded by Commis~ner Scott and carried, minutes of regular meeting of April 25, 1955, approved. Petition next submitted from twenty-six residents within radius of two blocks of the park in Wynnewood Subdivision, requesting the City to fill the pond in said park because of it being hazardous to the children in the neighborhood, and also a breeding ground for mosquitoes and snakes. The City Manager then advised that it would be too expensive to fill the pond im- mediately, but that it could be filled over a long range program from street sweepings and sur- plus dirt from new streets withou~ much expense to the City. After discussion, and upon advice of the City Attorney that the City has legal authority to fill the pond if it is declared a health menace, Commissioner Krider moved that the City take steos to fill the pond from street sweepings and surplus dirt. Seconded by Commissioner Ratigan and carried. Attorney Gordon Frederick ne×t apoeared and registered a complelnt against Municipal Judge John G. Leonardy for the manner in which he conducted the Court in the case of City of Sanford vs David Pringle, tried in said Court on May 9, 1955, in which he was the attorney for the defendant. Mr. Frederick claimed that the Court denied the defendant his constitutional rights to present his defense by refusing to let him testify, end passed Judgment and sentence after denying due process of law. He stated that as a result of such procedure the defendant is nov? confined in Jail because of no money to pay the fine or appeal the ease. that after Attorney Frederick defendant to him with request Chief of Police Williams then advised the Commission, accused the Court of an unfair trial, he offered to release the that the case be re-opened, but he ~oul5 not consent to it.
