The City Commission of the City of Sanford, Florida, met in regular session at the

Meeting called to order by the Chairman·
A. B. Peterson, Jr., Realtor, appeared on behalf of the owner of Lots l, 2 and 8 of
Block l, Wynnewood Subdivision and requested the City to abandon the existing utility easement
across the three lots and relocate it across the s_?utherly side of Lot 8, in order that a
dwelling can be erected thereon. He stated that the owner would grant the necessary easement
to make the change.
After discussion, and on advice of the City Manager that the proposed new location
wou~d be satisfactory, Commissioner Higglnbotham moved that the City abandon the existing
utility easement across Lots l, 2 and 8 of Block l, Wynnewood Subdivision provided the property
owner grants the City an easement along the southerly line of Lot 8. Seconded by Commissioner
Krlder and carried.
Gordon Frederick, Attorney, next appeared on behalf of the Seminole Memorial Hospital
Board and submitted the following list of off-site work reouired in connection with const~ct-

Mr. Frederick then advised that due to the Federal Government pnrtlcipating in the
cost of constructing the new hospital, they were not allowed to spend any money for off-site
improvements, and requested the City to do the work.
The Commission explained that the City had no aw~ilable funds to make the foregoing
improvements and suggested that they submit their request to the Board of County Commissioners
for assistance, since it is a county hospital. Also, that T. E. Tucker, Chairman of the Hos-
pital Board, had apoeared before the Commission several months ago and submitted ap~licatlon

After discussion the matter was referred to the City Manager to review the plans
to ascertain whether or not any portion of the off-site work is an obligation of the City,

A group of citizens residing7 on East side of Summerlin Avenue between North Street
and 2bth Street, with Mrs. Florence Gllm~rtln as spokesman, ne~-t apveared and. requested the
City to fill the open ditch in back of their homes, or, enclose it by installing a culvert
th~rein. Mrs. Gilmartin stated that the ditch is a health menace because of its sanitary con-
dition and breeding ground for mosquitoes and snakes. Sba said that the entire neighborhood
was so infesttd with mosquitoes that the children could dot play outdoors, and also pointed
out that the ditch acts as a natural drainage for filth fr-~m the ad jack, at dairy.
H. H. Collier of 1525 Summerlin Avenue, north of North Street, also reported on the
condition of the ditch back of his residence and stated that if the City did not take im-
mediate action to correct it, that he was going to fill that portion in back of his property.
The City Manager then explained that the east half of the ditch is outside the City
Limits, which is on private pro:~erty and out of the City's jurisdiction. Also, ~hat the
City had attempted to clean it out but was stopped by an adjacent pro,}erty owner. He also
advised that the City had secured engineer's estimate on cost of installing a culvert and
closing it, which amounm to ~24,000.00.
After considerable discussion, and in view of the east half of the ditch between
North Street and 2~th Street being located on Hardin's Dairy, which cannot be closed or re-
located without the owner's consent, the City Manager was directed to contact Mr. Hardin and
Mr. Brown Miller, County Commissioner of the district in w~ich the dltc~ ia located, and make
an investigation with a view to working out a joint project to correct the problem.
The Comm~.ss!~n next proceeded with the hearing on the complain of Attorney Gordon
Frederick against Municipal Ju~ge John G. Leon~rdy in the case of City of Sanford vs David
Prlugle, tried in Municipal Court on May 9, 1955, in which Mr. Frederick was attorney for the
defendant.
Attorney Frederick then referred to his letter of May 11, setting forth ~his com-
plaint and said that he did not feel it necessary to re-iterate the case. Said letter being
as follows:

Re: David Prlngle
Pursuant to your request of the evening of Monday May 9, 1955, I wish to
restate my grievances with respect to the violation of the above named
person's rights in the Municipal Court in an(] for Sanford, Florida.
At the regular session of the Municipal Court on May 9, 1955, the above
named person, ~eing the Defendant in a case charging him with driving
while intoxicated, did enter his plea of "not Guilty~ to the said clm rge.
Upon said Defendant having entered hlsplea of not ~llty, the Court heard
the testimony of Patrolmen Arnold Williams sad Ben Butler. Mr. Williams
testified as the Patrolman who had made the arrest an~ was on the scene
a.t the time of the said violation. Mr. Butler purportedly testified as
an expert witness with respect to the drunk-o-meter, and certain tests
performed by him upon the Defendant.
Counsel for Defendant exercised his right of cross-examination of both
officers, particularly with respect to Patrolman Butler's qualifications
as an expert, the basis for his conclusions, and his knowledge of the
effect of alcohol upon indlviduels, etc.

it was the finding of tl~ Court that Defendant was guilty as charged,
and the Judgment and sentence of the Conrt was levied upon the Defendant.
At the time t!~e Court first made a statement as to the Defendant's guilt,
Counsel for Defendant advised the Court th.~t ";fa have not yet presented
our defense", and again upon the Court's having stated that the Defendant
hsd been found ?ullty Counsel for Defendant stated, "If the Court please,
the Defendant has the right to present hlsdefense", but notwithstanding
these recuests the Defendant was not oerm~tted to present his defenses
to the Court.
In view of the City Commlsslon's decision to air t!~is matter et a future
meeting, I wish to ~dvise that there were in the Courtroom and in the
range of hearing, although I could not state exactly what they heard,
the following persons:

Others were present in the Courtroom, including Mrs. Apoleby whom I
mentioned in my aopearance before the Commlssi~, however I am advised
that Ers. Appleby is not co~nlzant of wN~t took place in the trial of
David Pringle.
With resoect to the oroposed open meeting upon the quest!oas I 'nave raised,
I would li~e to st~te that I have merely called to the attention of the
Commission the existing problem. I stand ready to again make the same
statements I have orevJo;sly made. I DO NOT propose nor intend to :assigns
the position of persecuting any group or Indiv~ual because of the con-
dition which e.~ists. The pro]~lem belongs to the City of Sanford, or
more particularly to the City Com~,-lsslon as the executive body of the
City of Sanford, and ± respectfully request a thoughtful investigation
of the matter.

Judge Leonardy next gave

Policeman Ben Butler, witness in the case, testified that
entire trial, and that Attorney Frederick did not recuest the Court

he had considered the c~se closed and was leaving the Court when the request was made.
Policeman Arnold Williams, witness in the case, testified that he was oresent during
the entire trial and f~:lt that Judge Leonardy ?ranted Attorney Frederick ample time to present
his defense and allow the defendant t.o testify.
Policemen Jack Hickson and Richard C~sgrave also testified that they were oresent
during the trial but ~ere not listening at the concluslon of the case.
Joe Corley testified that he was present dur!ng the entire trial and that Judge
Leonardy did not grant the defendant an opportunity to present his defense before passing
judgment sad sentence.
There being no further testimony, the Commission closed the hearing and excused all
witnesses.
The City Manager next reported that A. B. Peterson had advised that the ~roposed
easement for road across the City's well field oroperty north of Lake Ada would not be satis-
factory because the County cannot accept maintenance of the road unless it has a deed for the
right-of-way. Action deferred.
The City Manager next reported that the State Road Department plans to pave 27th
Street and has requested a letter from the City agre=ing to remove or relocate its utilities
from the street right-of-way.

Brailey Odham & Tudor, Inc., Builders, ne×t appeared and outlined their proposal to
erect a~)proximately 60 homes on a 21 acre tract of land southeast of Pine Crest Schoolcn 27th
Street, which is outside the City Limits. He then requested the City to furnish water and
sanitary sewerage facilities for the housing development by extending mains to the property
line. Mr. Odham sumbltted cost estimate of approximately *17,000.00 for constructing the
sewer line, consisting of 1,29h ft cast iron pressure pipe and lift station; and $2,700.00
for ~xtenslon of 6-inch water main. He also submitted a revenue estimate of $3,90~.00 annually
that the City could derive from the combined utility.
After considerable discussion, in wdich the City Attorney advised h
t,~t the City did
not have legal authority to extend its sewer s?'stem beyond the corporate limits, the matter
was taken under advisement, pending the passage of the proposed annexation Bill which has
been submitted to the Legislative representatives.
The City Attorney next advised that the new annexat~.on Bill, authorized by the Com-
mission at regular meeting of May 9, ~lad been oreoared, . and submitted to the ~e~islative * ~' delega-
tion, but that they had informed him they would not pass it with the referendum to include the
voters inside the City as well as those in the area to be annexed.
After discussion it was decided to arrange for a delegation, together with representa-
tives from the City, to go to Tallahassee onThursaay,' May 26, and s ubmlt a request to the
Representatives to pass the Bill as presented by the City.
A Resolution of the Board of Public Instruction of Seminole County relating to the
extension of water and sewer mains by the City to the new school at 27th Street, ne×t presented
for approval of the City Commission.
Thereupon Commissioner Higglnbotham moved that it be approved and accepted, and that
the ~fayor and Clerk be authorized to execute same on bar, all of the City. Seconded by Com-
missioner Krider and carried.

The City Manager next reported that John Angel Md submitted his resignation as
Summer Recreatlon Director, and was authorized to employ someone to fill the vacancy.

Mrs. Carols Sanford Dow, relative to transferring General Sanford's library, etc., to the City,

CAROLA SANFORD DOW, of Derby, Conecticut, as Donor, and CITY OF SANFORD, FLORIDA, a municipal
Corporation, as Donee, for the transfer and conveyance by Donor to Donee u~r the conditions
recited in sald Agreement of the Library, paintings, antiques, works o~ art, and manuscript
collections of the late General Henry Shelton Sanford, and l~ is the intent and desire of the
undersigned grandchildren of the said late General Henry Shelton Sanford that such Agreement
be confirmed and that any interest of the u~ersigned in the property referred to in such
Agreement be fully vested under the ~greement in the City of Sanford, Florlda:
NOW, THEREFORE, in consideration of the premlses and of the undertakings on the part
of the C~ty as set forth in said Agreement, the undersigned do here by confirm and ratify said
AEreement, and do further hereby re]ease, assign, transfer, and convey to the City of tanford,

On motion of Commissioner Ratigan, seconded by Commisslon~r Hig~lnbotham and carried,
the Commission ne>~t authorized payment of $4,~66.75 to Sullivan, Long & Hagerty for work com-
pleted to May l, on Contract No. 5, and $12,178.35 for work completed on Contract No. 6, of the
sewer improvements.
On motion duly carried, the Commission nezt authorized payment of ~554.00 to F. H.
Price for furnishing and lnstalllng a counter type desk in the Police Station.

Meeting cslled to order by the Chairman who announced that the meeting had been
called to consider the Annezatlon Bill, as proposed to be enacted by the State Representatives.
Commlss~omr Ratigsn then reported on the meeting ~n Tallahassee with Senator Douglas
Stenstrom, and Representatives Mack Cleveland, Jr., sn~ Volle Williams, Jr., advising t~at it
was also atzended by a delegation opoosing the annexation bll], which turned into another
public bearing on the issue. He aSvised that as a result of the meeting, the Representatives
agreed that in view of the proposed enlargement of the Naval Air Station the e~:panslon of the
City was now necessary, and that the method of referendum proposed by the City was fair and
Just, and that they woul~ pass the bill on one condition, that it be subject to stipulation
that the proposed area to be annexed be exempt from the City's current bonded indebtedness.
Commiss!on~r ~tlgan then volced his object,ohS to the proposal to exempt the area
from t~e bonded indebtedness because he felt it would be unfair to the ot~r citizens and prop-
arty owners of the City.

After a lengtftv discussion without reaching a decision, in which Com~Isslon~r~
Cordel2 and Scott exoressed their views but felt tb~t they should have more time to consider
the matter, Commissioner Krider moved that the meeting adjourn until 7:30 P.M. May lOth, 1955.
Seconded by Commissioner Scott and carried over the dissenting vote of Commissioner Ratigs~ w~o
felt the Commiss!on should meet at an earlier date to consider such an important issue.
