Williams Meeting called to order by the Chairman. On motion of Commissioner Higginbotham, seconded by Commissioner Scott and carried, minutes of regular meeting of August 8, and special meeting of August 15, 1955, aporoved. The first order of business being a Public Hearing to consider rezoning certain districts of the Zoning Ordinance, the Chairman directed the following legal notice to be read, which was published in the Banford Herald on August 2, and 9, 1955: NOTICE OF PUBLIC HEARING ON PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DIS- TRICTB AND BOUNDARIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at the office of the City Commission in the City Hall in the City of Ssnford, Florida, at 8:00 o'clock P. M. August 22, 1955, to consider the following changes and amendments to the Zoning Ordinance of the City of Banford, Florida: (a) The property zoned in District R-1-A (Single-Family), located on the North side of 25th Street between Park Avenue and Banford Avenue, is proposed to be changed to C-N CONNERCIAL-RETAIL (Neighborhood Shopping) District. Said property being more legally described as Lots 5, 6, ?, 12, 13, 14 and 19, of Edgewood Subdivision. (b) The property zoned in District R-1 (Single-Family), bounded on the North by 3rd Street, East by Pump Branch, South by 4th Street Ex- tended, West by Cypress Avenue, is proposed to be changed to C-1 (Commercial-Retail) District. Bald property being more legally described as all of Block 17, and that part of Block 19 lying West of Pump Branch and North of Sth Street Extended, of Chapman & Tucker's Addition. All parties in interest and citizens shall have an op~oortunlty to be heard at said hearing. By order of the City Commissim of the City of Sanford, Floride, this 1st day of August, 1955. H. N. There being no objections registered, Co~missloner Scott moved that the property be rezoned as advertised. Seconded by Commissioner Higginbotham and carried. R. I. Elam, Harry N. Weir, John Burke, Walter H. Neheney and others residing in Pinecrest Heights, spoke in favor of annexation to the city but voiced their objections to the proposed increase in water rates. They pointed out that the residents in said subdivision were already connected to the sewer system and paying the sewer service charge, and did not feel .water that their/bills should be increased. T. V. Brown of 2826 Magnolia Avenue, spoke in behalf of the realdente in his area that do not have sewer service. He said they were not appearing to oppose annexation but to find out what the City had to offer them in connection therewith, such as services and improvements. Mr. Brown further stated that he felt the Commission was using the proposed increase in water rates as a whip to force them into the City. Commissioner Ratlgan then addressed the aforesaid group, stating that they were mix- ing the question of water rate increase with annexation, and that it was not the intent of the Commission to use the water bills as a whip to annex the area in question. He explained that the City had spent a considerable sum of money for water improvements and tH t it was only fair for the people using city water outside the city to help pay for the system. Com- missioner Ratigan also advised that at the time the proposed rate increase was discussed, the Commission did not take into consideration that the residents of Pinecrest Heights were al- ready paying the sewer service charge, and that he would recommend that the rate increase not be applicable in such instances. He further advised that said area could only be annexed by referendum of the citizens residing in the area, which was authorized by Special Act of 1955 Legislature, and he would suggest that the City withhold the proposed water rate increase until 50 days after such election, and if the citizens should decide not to vote themselves into the City, the increased rate would then go in effect. Art Harris then advised that he was willing to pay his share for services rendered outside the city, but could not decide whether or not he was in favor of annexation until he knew Just what the City had to offer, relative to improvements. Mrs. Edna Heeler voiced her objections to the proposed increase in water rates, it to be unfair and discriminatory. Also, that she was not in favor the City had not given them any assurance of any improvements in the stating that she felt of annexation because near future. R. I. Elam then spoke again and asked the Commission how soon could the City start making improvements in the area, such as sewer and water extensions, ftrehydrants, street lights, paving and sidewalks. Mayor Cordell then advised that the City was going to set up a five year program for such improvements, so as to give the Pe'ople in the proposed area to be annexed, the facilities the people inside the city are now enjoying. Brailey Odham of Odham & Tudor, Inc., developer of Plnecrest Heights Subdivision, next spoke in favor of the proposed annexation. He pointed out that there has been a lot of misunderstanding over the issue, and that most of the citizens within said area would come into the City if given a choice, but resented the City using the water rates as a political tool to force them in. He then suggested that the City hold the election and list the improvements on the ballot that it has to offer, so that the people will know Just what they will get. Commissioner Krider advised that should the City decide to hold the election, that he would be in favor of listing what improvements and services the City had to offer. Also, that he was not in favor of holding off the proposed increase in water rates until after the election because such action would be misconstrued, stating if such an increase is Justifiable, that it should go in effect immediately. Mayor Cordell then thanked the group for appearing and discussing both problems, and exoressed his hope of being worked out to the best of all concerned. Ordinance No. 559, entitled: AN ORDINANCE OF THE CITY OF SANFOi~D, FLORIDA, RELATING TO THE PLATTING AND DEVELOPMENT OF SUBDIVISION WITHIN THE CITY AND PRESCRIBING REQUIRE- MENTS THEREFOR, INCLUDING INSTALLATION OF UTILITIES OR PROVISION FOR SAME, AUTHORIZING THE CITY MANAGER TO PRESCRIBE STANDARDS ~ND SPECIFI- CATIONS FOR SUCH INSTALLATIONS, PERMITTING VARIATIONS TO THIS ORDINANCE BY THE CITY COMMISSION ON CERTAIN CONDITIONS; PROHIBITING THE SALE OF NON-PLATTED LOTS AND PRESCRIBING THE PENALTY FOR VIOLATION OF SUCH PRO- HIBITION; FIXING THE LIABILITL FOR PAVING COSTS IN DEVELOPED AND UN- DEVELOPED SUBDIVISIONS ANDAREAS IN THE CITY; AND REQUIRING SUBMISSION TO THE ZONING AND PLANNING COMMISSION OF CERTAIN MATTERS RELATING TO STREET RIGHTS OF WAY, PUBLIC LAND AND PUBLIC BUILDINGS. introduced and placed on first reading at regular meeting of August 8, 1955, was next placed on its final reading. Commissioner Krider next introduced Ordinance No. 560, entitled: AN ORDINANCE OF TH~ CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NUMBER 362 OF SAID CITY, AS AMENDED, SAID ORDINANCE BEING AN ORDINANCE ESTA- BLISHING A ZONING PLAN WITHIN THE CITY OF SANFQRD, SAID AMENDMENT ADDING A NEW SECTION THERETO, TO BE KNOWN AS SECTION lh.1, SUCH SECTION RE- QUIRING THE PROVISION OF OFF-STRE~T AUTOMOBILE PARKING FACILITIES IN CONNECTION WITH VARIOUS PROPERTY USES. and same was placed on its first reading and read in full. Commissioner Scott then moved the waiver of the requirements of second reading of said Ordinance No. 560, and that same be placed on its final passage and adoption. Seconded by Commissioner Krider. Thereupon the question recurred on the waiver of the second reading. Thereupon the Chairman announced that the City Commission of the City of Sanford, Florida, by unanimous vote had passed and adopted said Ordinance No. 560, entitled: AN ORDINANCE OF THE CITY OF BANFORD, FLORIDA, AMENDING ORDINANCE 362 OF SAID CITY, AS AMENDED, SAID ORDINANCE BEING AN ORDINANCE ESTABLISHING A ZONING PLAN WITHIN THE CITY OF SANFORD, SAID AMEND- MENT ADDING A NEW SECTION THERETO, TO BE KNOWN AS SECTION 14.1, SUCH SECTION BEQUIRING THE PROVISION OF OFF-STREET AUTOMOBILE PARKING FACILITIES IN CONNECTION WITH VARIOUS PROPERTY USES. On recommendation of the City Manager and Chief of Police, and on motion of Com- missioner Higginbotham, seconded by Commissioner Scott and carried, the Commission next discontinued the "Loading Zone" in front of Ace Glass Comoa ny store at due to ssid company being ou~ of business. Action next deferred on application of W. E. Cherry for oermit at 1018 French Avenue, pending further investigation. There being no fur%her business, Commissioner Higginbotham moved that the meeting sdjourn until 8:00 o'clock P. M., August 29, 1955. Seconded by Commissioner Scott and carried unanimously. Commissioner Scott then moved that W. C. Hutchison, Jr., be appointed as City Attorney to fill the vsc~ncy created by the resignation of A. Edwin Shlnholser, effective October 1, 1955. Seconded by Commissioner Ratig~n end carried. The Commission then proceeded to a further study and discussion of the proposed budget of revenues and expenditures for flscsl year 1955-1956, after wblch the meeting ad Journed.
