092655-Regular Session444 The City Commission of the City of Banford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M., September 26, 1955. Williams MINUTES ....... September 26, 1955 at 81~. M. City Comm,ss~on, , _ · Absent: Commissioner John S. Krider, Sr. Meeting called to order by the Chairman. Volie A. Williams, Br., owner of business property on West side of Magnolia Avenue between 2nd and 3rd Streets, next appeared and requested the City to install parking meters in balance of this block on both sides of the street. He pointed out that it would only require 14 additional meters, which he said would solve the parking problem in this area that is caused by the existing one-hour parking restrictions being badly abused by the public. After discussion the matter was taken under advisement, pending survey by the City Manager. Brailey Odham of Odham & Tudor, Inc., developers of Pinecrest Heights and South Pinecrest subdivisions located outside the City Limits, next appeared and requested the City to install street lights in these developments and deduct the operating cost from first year's payment due them on lease purchase of their utility system, which the City has agreed to take over. He also r~quested the City ~o consider furnishing this area a guaranteed fire protection service on an annual dwelling unit cost basis, which could also be deducted from the aforesaid payments. After discussion, action was deferred, pending further consideration. Foster Smith next submitted application for renewal in his name the beer and wines license issued Fred Heath to operate a beer garden at corner of 13th Street and Mangoustime Avenue advising that he owned the business and Fred Heath had left the city. On recommendation of the Chief of Police, and on motion of Commissioner Higginbotham seconded by Commissioner Scott and carried, the aforesaid application was approved. On recommendation of the City Manager, and on motion of Commissioner Ratigan, seconded by Commissioner Scott and carried, the Commission next authorized the discontinuance of bill- boards on City owned property on west side of French Avenue north of Commercial Street, and the cancellation of lease agreement with Zimmer Poster Service for the space on which they are located. On motion of COmmissioner Ratigan, seconded by Commissioner Higginbotham and carried, the Commission next made the following temporary appointments, effective October l, 1955: Pur- chasing Agent - Mrs. Rosa Rotundo; Superintendent of Public Works - City Manager for a period not to exceed 30 days; Superintendent of Utility Department - City Manager for a period no~ to exceed 60 days. It being understood that the City Manager will not come under Civil Service status during the period of the aforesaid temporary appointments. PASSED AND ADOPTED, this NOW THEREFORE, be it resolved by the City Commission of the City of San~rd, Florida, that the City of Banford does hereby respectfully request and urge the State Road Department of the State of Florida that it proceed at the earliest possible date with the resurfacing of Park Avenue in its entirety and with the widening of that dangerous portion as above described A RESOLUTION OF THE CITY OF SANFORD REQUEBTING THE STATE ROAD DEPARTMENT OF FLORIDA TO RESURFACE AND PARTLY WIDEN A PORTION OF STATE HIGHWAY 15 (U S 17-92) IN THE CITY OF BA~ORD, FLOHIDA. WHEREAS, that portion of State Highway 15 (US 17-92) lying within the City of Banford, Florida with its northern terminus at Lake Monroe and its southern terminus at French Avenue (State Highway 15 alternate), also designated as Park Avenue, ~s a main artery of traffic for North and South-bound traffic through the center of the state, and a traffic count between the cities of Sanford and Orlando has shown this section of the hi gh%~y, which is a continuation of the above port~on, to be one of the most heavlly traveled in the State of Florida, and WHEREAS, in the southern portion of Park Avenue, existing between 23rd Street and its southern terminus, there is a narrow and congested area w~dch presents an extreme traffic hazard and which has been the scene of many serious automobile accidents, some of which have involved fatalities, and it appears that action should no longer be delayed toward elimination of this dangerous condition by the widening of said section of Park Avenue within its present right-of-way boundaries, and WHEREAS, the unduly heavy traffic to which this avenue is subjected because of its double service both as a s~tlon of State Highway 15 and as a main artery of traffic for the caused it to suffer deterioration ac that its continuance in that its entire length, as aforesaid, should be immediately re- 446 MINUTES Sonford, Flor ao,. ....... SUCH SECTION IMPOSING A FEE FOR THE COLLECTION OF REFUSE, AS DEFINED THERE- IN, PRESCRIBING THE AMOUNT OF SUCH FEE AND DEFINING USAGES UPON WHICH SUCH FEE IS BASED, AND PROVIDING THE METHODS OF BILLING FOR SAME, AND PENALTY FOR FAILUEE TO PAY SUCH FEE. Bill of Robert M. ~ngas & Associates in sum of $575.12, approved by the City Attorney and City Auditor, for balance of engineering fees due thru September 12, 1955, in connection with the water and sewer improvements program, next submitted, and on motion of Commissioner Ratigan, seconded by Commissio~r Higginbotham and carried, same was approved and payment authorized. Commissioner Ratlgan next called attention to the Board that the 30-year franchise granted Florida Power & Light Company to maintain and ooerate an electric distribution system in Sanford will come up for renewal within two years, and recommends8 that the C?mmission investigate the advisability of the City distributing and selling power ~fter sa~d franchise expires. After discussion Commissioner Rstigan then moved that the City investigate the matter of engaging a firm of engineers for the purpose of making a survey to determine whether the City of Sanfo~ could properly take over the distribution and eel ling of power within the city limits, and ~ether or not it would return e fair dividend to the .City. Seconded by Commissioner Scott and carried. Commissioner Ratigan next moved thet the City Manager's salary be increased $600.00 per year, effective October 1, 1955. Seconded by Commissioner Higginbotham and carried. Commissioner Ratigan ne×t introduced Resolution No. 8~9, and after being read in full, moved its passage and adoption. W~REAS, the City Commission of the City of Sanford, Florida, deems it necessary, expedient, and for the best interest of said City that any une~pended cash surplus astor September 90, 1955, of the operating revenues of said City for the fiscal year 1954-1955 be appropriated for the ordinary purposes and operating expenses of said City in the budget for the fiscal year 1955-1956, NOW THEREFORE, BE IT REBOINED by the City Commission of the City of Sanford, Florida, that any unexpended cash surplus as of September 30, 1955, of the operating revenues of said City for the fiscal year 1954-1955 be, and the same is hereby, appropriated to the Department of General Government of said City for the ordinary purposes and operating expenses of said City for the fiscal year 1955-1956, and said cash surplus shall be incorporated in the budget of revenues and expenditures of sam City for said fiscal year 1955-1956 for the ordinary purposes and operating expenses of said City. Resolution No. 848, and after being read in full, by Commissioner Ratigan and carried by the following Commissioner Cordell Aye " Higginbotham Aye " Ratigan Aye " Scott Aye Said Resolution No. 848 being as follows: A RESOLUTION OF THE CITY OF SANFORD, FLORIDA, IN RECOGNITION OF OUTSTANDING SERVICERENDERED BY H. JAMES GUT TO SAID CITY. WHEREAS, H. James Gut has tendered to the City of Sanfo~d his resignation as a member Zoning Board of Adjustment a~ as a m~m~e~ m~ ~ X~m~x8 ~ear~ ~ ~mem$ and as a member of the Zoning and Planning Commission, and it is appropriate that the city recognize his splendid service as a ~ember of such Board and such Commission as well as his previous outstanding service to this community, and WHEREAS, H. James Gut served as a member of the City Commission for three consecutive terms from 1939 through 1947 which term embraced the strenuous duties of the war years and during his term on the Commission, Mr. Mayor of this City, and in addition to the aforesaid Board and Commission, Mr. Gut served for two years, namly 1956 and 1947, as his service as commissioner and mayor and member of Gut h~s served as a member of the Board of Bond Trustees and as a member of the Charter Revision Committee, and has served for many years, and continues in availability, in an advisory capacity as an insurance consultant for the city and further has served and assisted in surveys and studies relative to the City's underground water supply, and in connection with this latter work, was instrumental in getting the assistance of the state and county in making surveys on the underground water supply throughout the county, and WHEREAS, in the performance of each of these undertakings by him in behalf of this community, Mr. Gut has conscientiously applied himself and assumed his work in a most 447 448 MINUTES Seotember 26 at 8 P.
