Those appearing in opposition were as follows: Alfred DeLattibeaudiere, 807½ Sanford Avenue, Sanford, Florida, appeared and eported a beauty shop is presently located on the property, and that customers of the shop ~ark in the alley and block the alley. Allie Williams, 806 Cypress Avenue, Sanford, Florida, appeared and reported that he beauty shop is open late at night, that she is constantly getting debris in her yard rom a beer garden on the other side of Cypress Avenue, and that she wants the neighborhood o remain residential. Rachael Lee, 813 Sanford Avenue, Sanford, Florida, appeared to oppose rezoning. A public hearing was held in accordance with notice published in the Evening Herald on January 14, 1983, as follows: (Item -D- on page 494, re: Evaluation and Appraisal Report.) The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the report. No one appeared. The Mayor announced that a second public hearing to consider said Evaluation and Appraisal report would be held on February 14, 1983. The next item of business was the discussion of property in the Lake Monroe Indus- trial Park, formerly owned by the City. E. K. van den Berg, Attorney, 16 South Magnolia Avenue, Orlando, Florida, appeared and reported he represents Bud Feather, who plans to con- struct a life care center on the property, that the state has indicated a decision will be made by January 28, 1983, whether to issue a Certificate of Need for the project, and fur- ther, to request the Commission to permit the following: 1. the deadline for commencement of construction be on or before March 1, 1984, 2. have the priviledge of extending said deadline for six months, upon payment of $5,000.00. 3. if the option is not exercised, will turn over to the City all documents for the life care center, such as the Certificate of Need, the study by Coopers and Lybrand, etc. 4. if 240 apartment units are not CO'd by December 31, 1986, then on February 31 of the following year the City will receive a $10,000.00 payment in lieu of taxes, and an additional $10,000.00 payment each February 31st, until 240 apartment units are CO'd, or 5. let Mr. Feather apply for a building permit for the first phase of construction, to include a sales office and a model. After discussion, Commissioner Smith moved to table consideration of same until meeting of February 14, 1983, and to ask Mr. Feather to submit the above proposals in writing. MINUTES City Commission, Sanford, Florida January 24 at 7:00 P. M. _19_83 Seconded by Commissioner Yancey and carried. Larry Blair, 2012 Holly Avenue, Sanford,. Florida, appeared to appeal the Planning and Zoning Commission's approval of a conditional use for a kindergarten at the Sanford Church of God of Prophesy, 801 West 22nd Street. He submitted a petition in opposition to the approval, and reported he is not opposed to the school, but is opposed to increased traffic and other problems he feels it would create in the area. Mrs. Hardy, 2020 Lake Avenue, Sanford, Florida, also appeared in opposition. Pastor Bill Thompson, representing the Sanford Church of God of Prophesy, appeared and reported they plan to increase the school in phases, beginning the first year with Kin- dergarten through third grade. Commissioner Keith moved to uphold the Planning and Zoning Commission's decision to approve the conditional use of a kindergarten in a private school at 801 West 22nd Street. Seconded by Commissioner Farr and carried. Commissioner Yancey moved to remove from table, discussion of an appeal of a deci- sion of the Planning and Zoning Commission, to deny a conditional use of duplexes at 2506 and 2508 Princeton Avenue, tabled at meeting of January 10, 1983. Seconded by Commissioner Smith and carried. The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the conditional use, and who did not speak at the meeting of January 10, 1983. Those appearing in opposition to the conditional use were as follows: Harold Alexander appeared and reported he owns two parcels of property at 2512 Princeton Avenue and 601 East 25th Street, adjacent to the property proposed for duplexes, that he represents other homeowners in the area, and that four families on three lots is too crowded. Rudy Royter, 2513 Poinsetta Avenue, appeared in opposition to the conditional use. Those appearing in favor of the conditional use were as follows: David Stump, Winsong Development Corporation, appeared and reported he has re- searched the tax rolls, and found that two pieces of property on that street are rental properties, that he has done a Comparative Market Analysis on the property in question, and that duplexes will upgrade the property, and preserve the residential integrity of the neighborhood. Further, that the present zoning of RC-1 would allow a convenience store, family game room, or such use, with up to 34 parking spaces. Commissioner Keith moved to uphold the Planning and Zoning Commission's denial of the conditional use of duplexes carried. Request submitted for a Cypress Avenue, Marcia E. Harper, on the property. The City Manager reported that the Greater Sanford Christmas Parade Committee has offered to purchase a Nativity scene in amount of $2,940.00, for the City to display at Christmas time, and store the rest of the year, and recommended the City accept same. Com- missioner Yancey moved to accept same, and to direct letters of appreciation to the individ- uals who raised the money for same, and to the parade committee. Seconded by Commissioner Farr and carried. The Commission autho- rized to discuss same at the next meeting. Commissioner Yancey moved to approve payment of the City Attorney's statement in amount of $1,202.50 for December, 1982. Seconded by Commissioner Smith and carried. On recommendation of the City Manager, Commissioner Farr moved to authorize the 2ity Attorney and staff to complete foreclosures on all municipal accounts receivable and ~rrange for a public sale of any foreclosed properties. Seconded by Commissioner Yancey and ~arried. On recommendation of the City Manager, Commissioner Yancey moved to authorize the City Attorney to prepare the proper ordinance for the City to file a claim in court at the Lime of an accident for all damages to city property, and to authorize filing by police Dfficers of damages, together with accident violations.
