WORK SESSION
The City Commission of the City of Sanford, Florida, met in Work
Session on Monday, June 11, 2012, at 4 PM, in the Railroad Depot Room, Second Floor,
City Hall, 300 North Park Avenue, Sanford, Florida.

1. Discussion — Amtrak station and Auto train by United States Congresswoman

City Manager Bonaparte said that this item will be rescheduled.
2. Discussion - Charter Amendment — Run Off Election; Term of Office
[Commission Memo 12 -092] (RM 7.G)
At the May 14, 2012 Work Session the City Commission discussed
various alternatives and determined to send ballots to overseas citizens in accordance
with the MOVE Act, hold any necessary Run Off Election in January, and change the
beginning and ending of the term of office of members of the City Commission from the
second Monday in January to the fourth Monday in January (second regular meeting).

The proposed change of the term of office of members of the City
Commission to the fourth Monday in January will provide sufficient time to hold and
certify a Run Off Election so that the winner can assume office on the fourth Monday in
January. The 60 day after the Regular Election in November falls on the first Saturday
in the following January, which is 16 or more days before the fourth Monday. City Clerk
Dougherty confirmed that she ran the calendar out twenty years and 16 days is the least
number of days and some years it is more than that. Action will be taken on this item at
tonight's regular meeting. [City Clerk Dougherty left the meeting.]
3. Update re: right of way use activities in SC -3, Special Commercial zoning since
Ordinance No. 2011 -4258 was adopted six months ago. [Commission Memo 12-
093]
Christine Dalton, Historic Preservation Officer and Community Planner,
reported that there have been no applications from 4COP establishments so there haven't
been any issues since the ordinance was adopted six months ago. There has been a lull
in permits and attempt has been made to get everybody into compliance and on a
permanent renewal schedule of October 1; historically a permit has been renewed a year
from the date it was issued. The opportunity for the outdoor entertainment permits has
been well received by the merchants.
Ms. Dalton said there are two businesses which have an old right of way
use agreement allowing a sidewalk presence that was issued before the sidewalk cafe

regulations were adopted. She asked if they should be taken away because they are old
and are not on the same page as the other merchants. Mr. Colbert said he will need to
look at the permits before making a decision on how to proceed.
4. Regular Meeting Agenda Items — additional information and /or questions.
City Manager Bonaparte asked that Consent Item 6.0 be continued to the
next meeting. Regarding Regular Item 8.B, he clarified that there is not a grant
application fee but the grant preparer is being paid $4,000.
5. Briefing items.
• Safety Incentive Program [Commission Memo 12 -096] (RM 8.H)
Fred Fosson, Human Resources Director and Risk Manager, gave an
overview of the Safety Incentive Program.
6. City Manager Comments.
Mr. Bonaparte distributed the Agenda for the 2012 Budget Retreat to be held
on June 14, 2012 and for the Special Work Session regarding the FY 2012/2013 Budget to be
held on July 2, 2012.
Mr. Bonaparte said that work continues on the new website; he expects it to
roll out by late August. The results of the community survey should be able to be provided
in about two weeks. An agreement is being finalized with a firm to facilitate the community
visioning process. Work is continuing on the property swap with the Sanford Lofts.

Commissioner M made reference to discussion had at the last work
session regarding the Police Chief in Daytona buying bus tickets to Sanford for the homeless.
Mayor Triplett said that they denied it was being done but they have been put on notice and if
it continues a formal letter will be sent.
Commissioner Williams said that she has received correspondence from the
legal team about possible law suits regarding public records requests and wants to make sure
that the law is being followed. Mr. Bonaparte said it will always be our intent to follow the
law.
Mayor Triplett reconfirmed commitment regarding First Amendment rights,
Sunshine Laws, and transparency and open government. He said that we have to make sure
that we reconfirm our commitment to transparency in public records and that we do
everything in our power to get what is requested out. He suggested a phone call be made to
the requestor to possibly redefine the request in order to expedite it quicker.
Vice Mayor Mahany thanked Mr. Bonaparte and Interim Chief Myers for the
CALNO presentation.
City Attorney Colbert said that under his report tonight he will ask for an
Attorney /Client session to be held prior to the next meeting to discuss two pending
lawsuits: Maece Taylor (Mayfair Golf Course) and another one regarding public records.
