The meeting was called to order by the Chairman.
A public hearing was held in accordance with notices authorized at meeting of
March 28, 1983, to consider condemnation of 19 structrues or buildings on Condemnation Group
No. 72, Reports Nos. 83-1076 through 83-1094. The Chairman announced that the Commission
would hear from property owners or representatives thereof. A review of each individual
report was as follows:

The Mayor reported that Mrs. McFadden, owner of property at 2476 Palmetto Avenue,
Condemnation Report No. 83-1090, had informed him that the structure had been demolished and
the debris removed. The Minimum Housing Code Inspector confirmed same and the Commission
removed said property from the condemnation list.
Susie Smith, representing Mattie Credick, deceased, owner of property at 1002 West
10th Street, appeared and requested time to repair the property.
Frankie Hayes, representing Elizabeth Brown, owner of property at 1018 Pine
Avenue, Condemnation Report No. 83-1085, appeared and requested time to repair the property.

Condemnation Report No. 83-1089, appeared and requested time tc repair the structure.
After consideration, Commissioner Yancey moved that finding the buildings under
Condemnation Reports Numbers 83 1076 through 83-1089 and 83-1091 through 83-1094 to be
unsanitary, unsafe and delapidated, that said structures be condemned and the owners glen 90
days in which to repair or demolish said structures; and if the structures are not repaired
or demolished within 90 days, to authorize the City to demolish same and levy a lien against
the property. Seconded by Commissioner Smith and carried.
A public hearing was held in accordance with notice published in the Evening
Herald on March 22 and April 1, 1983, as follows:

changes and amendments to the Zoning Ordinance, and amending the
Future Land Use Element of the Comprehensive Plan of the City of

Commissioner Farr reported the owner of the property is a client of his, and he
will file a conflict of interest form.
Hulan Black, 105 Forrest Drive, Sanford, Florida, appeared to request permission
for his group to permanently install a cross in the Memorial Park on Seminole Boulevard and
Park Avenue, with funds to be raised from private sources.
Zelda Siskind, 2072 South Grandview Avenue, Sanford, appeared to oppose the
erection of a cross in a city veterans park. She reported no objection to a cross or
religion, but believes the religious aspects should not be in a veterans memorial park.
Pat Baxley, 102 Skogen Court, Sanford, appeared and recommended if anything is put
in the Memorial Park, that it be a soldier or an enlarged flag.
Commissioner Farr moved to authorize the Reverend Black to permanently erect a

and Ninth Streets, on Ninth Street, between Park Avenue and Oak Avenue, and on Eighth
Street, West from Park Avenue, for 30 feet. Further, they have had installed an opening in
the fence at the corner of Ninth Street and Park Avenue, and
have an opening installed at the corner of Eighth Street and
only runs a short distance on Eighth Street.

Commissioner Smith moved to authorize the church to continue using the park under
the present lease, provided they install five foot openings in the fence, one at the
Northeast corner of the park fence, and one at the southeast corner of the park fence.

Commissioner Smith moved to remove from table, discussion of a request from Bob
Ball for water service to a lot outside the City, and abutting the City Limits. Seconded by
Commissioner Yancey and carried.
The City Attorney reported he had researched the question of whether or not the
City could deny water service to property within the City, and in his opinion, the City
could not legally deny such service, provided the City has the ability to serve the
property. Further, if a meter is set for property in the City, and the water is used
illegally, i.e., for property outside the City Limits, the City would have the right to shut
off the water until the infraction is corrected.
Commissioner Smith moved to deny Mr. Bob Ball's request for water service to
property at 2546 South French Avenue, outside the City Limits. Seconded by Commissioner
Farr and carried over dissenting votes of Commissioner Keith and Commissioner Yancey.
Phil Kulbes, City Manager, City of Lake Mary, Florida, appeared to discuss a
letter dated April 8, 1983, from W. E Knowles, regarding agreements whereby Sanford provides
water and sewer services to properties in Lake Mary. The letter further stated, new homes
and buildings in Lake Mary do not pay any development fee yet use Sanford reserves and plant

capacity the same as a Sanford building, which pays a development fee, and asking what Lake
Mary's plans are as to providing its own utility services. Mr. Kulbes reported he knows
Lake Mary is growing, and that Lake Mary will need its own water system.
The City Manager reported existing water contracts as follows:

The Commission authorized the City Attorney to prepare resolutions to the above entities
outside the City Limits and using City water, urging them to begin plans to develop their
own water source.

The City Attorney submitted a deed to Seminole County, authorized at meeting of
March 28, 1983, for property to be used as a library, described as follows:

Commencing at the intersection of the West line of Palmetto Avenue with
the north line of First Street in the City of Sanford, Florida, and according
to E. R. Trafford's Map of Sanford, as recorded in Plat "B", Page 111, of the
public records of Orange County (of which the County of Seminole was
formerly a part) and the point of beginning for this tract; thence run north
along the west line of Palmetto Avenue 140 feet, thence west 80 feet,
thence south 140 feet to the north line of First Street, thence east 80 feet
along the north line of First Street to the point of beginning, being a parcel
of land at the southeast corner of Block 2, Tier 2, as per E. R. Trafford's
Map, abovementioned.
PARCEL B.

The City Attorney reported he had corresponded with Atlantic Bank, and they need
further information for the marina operator's loan.
The City Attorney submitted Resolution No. 1345, supporting efforts to exempt
municipalities from paying the 5% sales tax on the purchase of fuel. Commissioner Keith
moved to authorize the Mayor and City Clerk to execute same. Seconded by Commissioner Smith

A RESOLUTION OF THE CI27 OF SANFORD, FLORIDA, SUPPORT-
ING THE EFFORTS OF TItE SEMINOLE COUNTY LEGISLATIVE DEL-
EGATION TO REPEAL SECTION 62 OF SENATE BILL 8 A THEREBY
EXEMPTING MUNICIPALITIES FROM PAYING THE 5% SALES TAX
ON THE PURCItASE OF FUEL.
k~IEREAS, the Legislature of the State of Florida in a special
session passed Senate Bill 8 A which created a 5% sales tax on the pnrchase
of fuel; and
W]tEREAS, Section 62 of Senate Bill 8 A provides tbat effective
October 1, 1983, municipalities shall be subject to said 5% sales tax;
and
%4HEREAS, the City Commission of the City of Sanford, Florida,
determines it to be in the public ~nterest to conserve city funds for
the use and benefit of its citizens, particularly in a time of dwindling
seurces of revenue; and
WHEREAS, members of the Seminole County Legislative Delegation
bave indicated their support of effort~ to repeal Section 62 of Senate
Bill 8 A thereby exempting municipalities from paying the 5% sales tax
on the purchase of fuel.
NOW, THEREFORE BE iT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SANFOR~, FLORIDA, that the City Conmission of the City of Sanford,
Florida supports the efforts of the Seminole County Legislative Delegation
to repeal Section 62 of Senate Bill 8 A, thereby exempting municipalities
from paying the 5% sales tax on the purcbase of fuel.
BE IT FURTHER RESOLVED that copies of this Resolution be presented
to the members of the Seminole County Legislative Delegation, and that a
copy of same be entered in the minutes of the proceedings of the City

The City Manager reported that on April
tentatively approved definitions of two "adult congregate living facilities',, and
recommended adoption of same into the Zoning Ordinance. Commissioner Farr moved to
authorize the Planning and Zoning Commission to advertise and hold a public hearing to
consider same. Seconded by Commissioner Smith and carried.
The City Manager reported that Seminole County could begin road work and
installation of a traffic signal on Airport Boulevard at Southgate Road by June, 1983, and
requested the City Commission authorize a transfer in amount up to $10,000.00 from
Contingency for the City's share of the installation. Commissioner Yancey moved to
authorize said transfer. Seconded by Commissioner Smith and carried.
The City Manager reported that construction has begun on the new warehouse at the
Public Works Complex, and the City will need to have a deed prepared by June 1, 1983 for the
01d city warehouse on West Sixth Street. Commissioner Yancey moved to authorize the City
Attorney to prepare the proper instrument. Seconded by Commissioner Smith and carried.
The City Manager reported that the unpaid occupational licenses have been paid up
or records cleared as the businesses are closed.
The City Manager reported that property located in Orange County, owned by the
City, was sold at a tax deed sale, with $24,244.57 overbid, but Sanford can not obtain the
~oney because the law calls for distribution to all lienholders, and an agreement or Court
Drder is needed. On recommendation of the City Manager, Commissioner Keith moved to
authorize the City Attorney to begin recovery procedures. Seconded by Commissioner Smith
and carried.
7, 1983 the Planning and Zoning Commisslo~
The City Manager reported he had appointed Russell Kitner, 1806 Holly Avenue to
:he local Public Employees Relations Commission to fill the remaining portion of a four year
term to expire in January, 1985. Commissioner Yancey moved to confirm the appointment.
Seconded by Commissioner Keith and carried.
On recommendation of the City Manager, Commissioner Yancey moved to appoint Mr. E.
C Harper to the Code Enforcement Board to fill the remaining portion of Mr. Lee Scott's
term to June, 1985. Seconded by Commissioner Farr and carried.
The City Manager submitted proposed annexation guidelines and the Commission
authorized to discuss same at meeting of April 25, 1983.
The City Manager reported that HB 282 has been filed, and it "specifies that homes
for the aged financed through public entitity bonds shall be exempt from ad valorem
taxation". Further, that at the meeting of March 28, 1983 the City Commission indicated
approval of a 94 unit, $5 million senior dwelling complex and adopted Resolution No. 1344 to
sponsor a revenue bond issue for the complex. Also, passage of HB 282 would affect this
romplex and the Life Care Center proposed by Robert G. Feather in the Lake Monroe Industrial
Park. The City Manager recommended the City Commission notify the parties involved in these
projects that the City wants an agreement in writing, prior to city approval, for payment in
lieu of taxes, or no development except by conventional financing methods. The Commission
~uthorized the City Manager to notify the parties involved.

The City Manager submitted a request from the abutting property owners, to vacate
the north-south portion of the "T" alley between First Street and Second Street and between
Cedar Avenue and Holly Avenue. He reported the alley is not open or used by vehicles, but
does have a power line, gas main, utility storage building, fence and a garden located in
it, also a city manhole and a sanitary sewer system. Commissioner Yancey moved to authorize
a public hearing to be held on May 9, 1983 to consider the vacating. Seconded by
Commissioner Smith and carried.
The City Manager reported that the Planning and Zoning Commission has approved
final plats of Hidden Lake, Phase III, Unit IV, and Hidden Lake Villas, Phase III. On
recommendation of the City Manager, Commissioner Fart moved to authorize the Mayor and City
Clerk to execute these plats. Seconded by Commissioner Yaneey and carried.
The City Manager submitted a request from The Dividends, Seminole County School
Volunteer Program, to waive the fee for a mobile trailer sign at the Fina Station at 25th
Street and French Avenue and a sign at the Sanford Plaza, to advertise Kindergarten Roundup.
Further, that the owner of the property at the location of the sign can request a mobile
sign permit and put any message on the sign face, but use of a mobile sign at a particular
location would be a use under the time limit and six months would be required between uses
of mobile trailer signs at that location. Commissioner Farr moved to waive the fee for the
signs. Seconded by Commissioner Yancey and carried.
The Mayor reported that Anthony Grant, 1118 Magnolia Avenue, had complained about
the 24 hour a day, seven days a week operation of the 7-Eleven Store located at the corner
of 12th Street and Park Avenue, and submitted a petition for same. The Commission
authorized to discuss same at meeting of April 25, 1983.
There being no further business, the meeting was adjourned.
