This issue has raised several questions and tried the patience of many
people. The equating of professional planning methods with public emotions
has come into conflict. The City Commission will find itself in the middle
to settle a question of which no existing answer will satisfy both sides.
The municipal staff was a~ked to develop a means to answer both sides
and to develop a workable zoning for the years ahead. A new zoning district
is proposed as the answer. The new zoning that will provide for single family
residences but also allow the "elderly widow apartment house" to continue
and to be utilized.
This was previously suggested to the Planning and Zoning Commission
by the City Manager at an open meeting but they did not seek to pursue it.
The new zone is a multi-residential owner occupied (MRO) zone.
It is truly a transitional zone of restricted multi-residential use to
single family use. It is tailored for the existing structures in this
area with the already existing uses.
Coupled with'this is suggested clarifications of the licensing
ordinance by creating the definitions.
This is proposed as a compromise. (A compromise is s~mething that
neither side likes but can live with).

SUBJECT: Recommendations for Additions and Amendments
, to the City Code and Zoning Ordinance
These additions and amendments are r%commended for clarification where
presently there exists some uncertainty as to definitions and require-
ments of the law.
The creation of a new zone whfch we chose to title MRO for multiple-
family residential owner occupied is in~ended for the downtown residential
area. The purpose of the zone is to allow those existing MF dwellings to
continue operation, but to prohibit further development, enlargement or
increased numbers of MF units in. the downtown area unless the units are
owner occupied. This is aimed at establishing on site owner responsi-
bility and accountability for their property. Under this zoning,
property owners who for many years have lived in their homes and rented
out other portions of the property for income could continue to do this
and still be in compliance with the zoning. Absentee landlords (property
· owners) would become non-conforming uses, and thereby could not enlarge,
indrease number of units or improve the multiple family proper~ty.

living unit with independent entrances, (common stairwells
shall be prohibited), utilities and garages. Each' unit
attached to another unit shall be separated by a two-hour
fire wall which extends to the roof.
Swimming pools, tennis courts, playgrounds and other
recreation uses may be permitted within town house and
cluster home projects, provided the recreation uses are
located in areas retained in common ownership. Nothing
in this provision will prevent an individual owner
from owning and maintaining any similar use on his or her
individual lot, provided the city's setback standards
are followed.

Standard Building and National Fire Codes
Existing multiple family dwelling units within the MRO district
shall be required to install smoke detectors and fire extin-
guishers in accordance ~ith the Standard Building and National
Fire Codes within sixty (60) days following the effective date
of this amendment to this Zoning Ordinance.
Existing multiple-family dwelling units within the MRO district
shall be required to construct one (1) hour fi~e resistant
tenant separation in accordance with the Standard Building and
National Fire Codes within two . (2) years following the effective
date of this amendment to this 'Zoning Ordinance.
(3)
Any new construction, enlargement of existing multiple-family
dwelling units or increase in the number of units within the
MRO district 'shall require immediate compliance with the
Standard Building and National Fire Codes.
(4) Failure to meet the requirements as set forth in this section
shall render property a non-conforming use.
Commissioner Farr moved to authorize the property to be rezoned from RMOI and MR-2
to an SR-1 modified. Seconded by Commissioner Smith and carried over dissenting vote of
Mayor Moore.
The Commission authorized to meet at 4:30 P. M. on September 28, 1983 to further
consider modifications to the SR-1 District and the proposed MRO zoning classification.

On recommendation of the City Manager, Commissioner Farr moved to authorize a
public hearing to be held to consider the vacating, and proper notices, subject to Ms.
Malcolm installing, at her expense, piping acceptable to the City in the existing drainage
flow line which extends east-west along the northerly boundary of the property. Seconded by
Commissioner Keith and carried.

Seconded by Commissioner Smith and carried.
The City Manager submitted the site plan for a new elementary school on East
Eighth Street. Commissioner Farr moved to table approval of the site plan until the traffic
is routed to Celery Avenue. Seconded by Commissioner Yancey and carried.
The City Manager submitted estimates for street projects with local option gas tax
revenue as follows:
a. Sanford Avenue Boulevard to 25th Street - resurfacing only at $104,000.00.
b. West 20th Street French Avenue to Old Lake Mary Road - widening at
industrial area; resurfacing other areas. Estimate at $178,000.00.
City Manager was authorize to obtain cost estimates for resurfacing sections of
The
Mellonville Avenue.
Request for annexation submitted from Superior
portion of the property lying North of and abutting East
Avenue and Sanford Avenue, further described as follows:
Construction Company, Inc., for a
29th Street and between Palmetto
Lots 5 and 6, Block 1, Rosalind Heights, according to the Plat thereof
as recorded in Plat Book 3, Page 47, of the Public Records of Seminole
County, Florida.
On recommendation of the City Manager, Commissioner Farr moved to deny the request.
Seconded by Commissioner Smith and carried.
On recommendation of the City Manager, Commissioner Yancey moved to accept
in lieu of open space in amount of $15,163.43, from the developers of Sanford Gardens,
units in quadraplexes, between Myrtle Avenue and Oak Avenue, South of 25th Street and
of Park Drive. Seconded by Commissioner Keith and carried.

Commissioner Farr moved to authorize the City Attorney to prepare a resolution to
support The Chemical People, and local committees to fight school-age drug and alcohol
Begin at the Northwest corner of Lot 1, Block F, Sunland Estates, as
recorded in Plat Book 11, Page 20, Public Records of Seminole County,
Florida; thence run South 08° 36' 23" West through the Southeast corner of
said Lot 1, 265.54 feet; thence run West 94.76 feet; thence run North 60°
57'35" West 311.4 feet; thence run North 38°27'29" East 273.95 feet to a
point on the arc of a curve lying concave Northeasterly having a radius
of 499.3 feet, also being the Southerly right-of-way line of Collins
Drive; thence run Southeasterly along the arc of said curve a distance
of 260.82 feet to the Point of Beginning, being a part of Block G of
said Sunland Estates.
On recommendation of the City Manager, Commissioner Yancey moved to authorize the City
Attorney to prepare the proper ordinance to annex same. Seconded by Commissioner Smith and
lying South of and abutting Collins Drive and between U.S. 17-92 (SR 15 & 600) and Park View
Drive extended Southerly, further described as follows:

The Chairman announced that the meeting was to continue consideration of

amendments to the zoning regulations in accordance with action of the City Commission
September 26, 1983.
After discussion, Commissioner Farr moved to authorize the City Attorney to
prepare an ordinance to require a public hearing before the Planning and Zoning Commission
of all requests for conditional uses, except home occupations. Seconded by Commissioner
Yancey and carried.
Commissioner Fart moved to authorize the City Attorney to prepare a resolution

Existing multiple-family dwelling units within the district shall be
exempt from off-street parking requirements.
(2) Any new construction, enlargement of existing two-family or conversion
to two family units shall require that off-street parking spaces be
provided as set forth in Article VI of the Zoning Code.
STANDARD BUILDING AND NATIONAL FIRE CODES
(1) Existing multiple family dwelling units within the district shall
be required to install smoke detectors and fire extinguishers in
accordance with the Standard Building and National Fire Codes within
sixty (60) days following the effective date of this resolution.
(2) Existing multiple-family dwelling units within the district shall
be required to construct one (1) hour fire resistant tenant separation
in accordance with the Standard Building and National Fire Codes within
two (2) years following the effective date of this resolution.
(3) Any new construction, conversion to multiple-family, or any enlargement
of existing multiple-family dwelling units or increase in the number of
units within the district shall require immediate compliance with the
