M. 1983 City Hall The City Commission of the City of Sanford, Florida, met in Regular Session in in the City of Sanford, Florida, at 7:00 o'clock P. M. on October 24, 1983. Present: Mayor-Commissioner Lee P. Moore Commissioner Edward A. Yancey Commissioner David T. Farr Commissioner Edwin O. Knowles The meeting was called to order by the Chairman. A public hearing was held in accordance with notice published in the Evening Herald on October 7, 1983, as follows: NOTICE OF PROCEEDING FOR VACATING AND ABANDONING A PORTION OF A STREET. TO WHOM IT MAY CONCERN: You will take notice that the City Commission of the City of Sanford, Florida, at 7:00 o'clock P. M. on October 24, 1983, in the City Commission Room at the City Hall in the City of Sanford, Florida, will consider and determine whether or not the City will close, vacate and abandon any right of the City and the public in and to a portion of East 25th Place (Victoria Street) lying between Bay Avenue and Hellonville Avenue, further described as follows: That portion of East 25th Place (Victoria Street) lying between the Westerly right-of-way of Mellonville Avenue and the Easterly right-of-way of Bay Avenue; however, retaining the Southerly 15 feet thereof for a Utility Easement. Tamm, Jr. City Clerk The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the proposed street closing. The City Clerk reported notice of the public hearing was sent to surrounding property owners on October 13, 1983. Those appearing in opposition were as follows: C. C. Henderson, 2524 Mellonville Avenue, Sanford, Florida, appeared and reported he owns Lots 96 through 101 and Lot 103, and he wants the City to open the street right-of- way being considered for vacating and abandoning. William Leffler, Attorney representing Laura Brown, owner of Lots 102 and 104, appeared to oppose the proposed vacating and abandonment and reported same would decrease surrounding property values, the vacating must be in the public interest, and the applicants want to use the property for a garage. Leo Salvail, 2522 Willow Avenue, Sanford, Florida, appeared and reported he owns lots between Willow Avenue and Bay Avenue immediately North of 25th Place, which he wants to develop commercially, and traffic would have to exit of-way is vacated and abandoned. Mr. and Mrs. Mark Grzeskowick, petitioners, West on 25th Place if the street right- appeared to support their request and MINUTES City Commission, Sanford, Florida 105 reported they have been mowing the right-of-way and want to level it out and increase thez~ lot width. Commissioner Keith moved to deny the request. Seconded by Commissioner Yancey and carried over dissenting vote of Mayor Moore. Ted Williams, Twin Lakes, appeared and reported he owns property along the West boundary of this property, and asked what plans have been made to drain and fill some of the lots, which are under water. Mr. Shoemaker, owner of the property, appeared and reported the engineers have made plans in accordance with the City's specifications for same. Zon____ing - Time limit on site_~_q_approval In response to your recent request for an opinion'regarding a time limit for site plan approval, I offer the following thoughts: A. The City has no time limit at present. If we had to go to court and argue the point, we would have to say approval was for a "reasonable time" and it would ultimately be up to a judge or Jury to determine how long that would be. ' B. Many cities and counties have impqsed a time limit in which construction must commence and/or be completed or the site plan must be resubmitted for approval. The time frame for starting work is usually six to twelve months. C. I can see where a time limit could help the City staff in planning for the future and it would certainly help our legal posture if we had to go to court over site plan approval- D. The best way to impose a t'ime limit would be by ordinance that would apply to all site plans. An alternative would be to approve each plan on the condition that construction commence within a certain time. If I may be of further assistance, please feel free to contact me. The Acting City Manager reported that the State of Florida Department of Environmental Regulation has notified Chuck Volk that tbey will deny his request for a permit to extend the breakwater and increase the number of slips in the East basin of Monroe Harbor Marina, but they are not ~enying the maintenance dredging. Commissioner Keith moved to authorize the City Staff to Ko everything they can to help Mr. Volk obtain the permit. Seconded by Commissioner Farr and carried. The Acting Ciay Manager reported that the State of Florida Department of Environmental Regulation has denied the City's request for a Site Specific Alternative for lake discharge of treated sanitary sewerage effluent. After discussion, Commissioner Fart moved to authorize City Staff to take proper action to request a formel hearing for same. Seconded by Commissioner Keith and carried. Commissioner Farr mlved to authorize the City Manager to apply for a p~ocedure to modify the 201 Plan, and start trying to find a solution for the discharge of the sewer treatment plant effluent. The Acting City Manager reported that Liquid Foods has completed construction of site improvements, but the City's sewer treatment plant is still receiving high BOD's from their plant. Further, the City has set a deadline of November 24, 1983 for them to be in compliance with sewer discharge regulations, or the City will levy the surcharge as set forth in the City Code. M. 1983 The City Commission of the City of Sanford, Florida, met in Special Session in the City Manager's Conference Room in the City Hall in the City of Sanford, Florida, at 3:30 o clock P. Tamm, Jr. The meeting was called to order by the Chairman, who announced the purpose of the meeting was to consider ordinance No. 1664, placed on first reading at meeting of October 10 1983. Said ordinance containing provisions to increase the utility connection fee. M. N. Cleveland, Jr., Attorney for the builders and developers, requested Mr. Shoemaker to present their requestS. A. K. Shoemaker, developer, requested the Commission to delay the implementation of the ordinance in consideration of the development that is already in the planning and f nancial stage and also to consider establishment of a sliding scale for multi-family construction- Robert McKee supported Mr. Shoemaker's remarks. Bill Goodman requested consideration be given to the benefits of the development to the merchants and residentS of the City, and requested to delay the increased fees for six or seven months for development in the process at present. Commissioner Smith moved to amend the proposed ordinance to increase the dwelling unit connection fee to $1,100.00 on January 1, 1984, and to increase said fee to $1,925.00 on July 1, 1984. Seconded by Commissioner Farr and carried. Commissioner Farr moved to authorize a sliding scale for the dwelling unit connection fees for a multi-family building or structure as follows: first unit 100% of base dwelling unit fee second unit 50% of base dwelling unit fee each additional unit 25% of base dwelling unit fee Seconded by Commissioner Keith and carried. The Commission authorized a minimum utility deposit fee of $50.00, effective January 1, 1984. The City Attorney reported that he had met a second time with the Plaintiffs' Attorney and Judge Kovachevich, and further, the judge had requested that he request the Commission to consider the pragmatic approach to the case that will come to trial prior to the next City election. Attorney Ned Julian, assisting the City Attorney, explained other cases dealing with similar circumstances, and the costs incurred.
