Bill Gilbert, Fire Department, 25 years Lt. Knowles, 30 years A public hearing was held in accordance with notice published in the Evening October 25 and November 4, 1983, as follows: the Florida, at 7:00 o'clock P. M. changes and amendments to the Sanford, Florida, as follows: NOTICE OF A PUBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at Commission Room in the City Hall in the City of Sanford, on November 14, 1983, to consider Zoning Ordinance of the City of A portion of that certain property lying between Ninth Street and 10th Street and between Laurel Avenue and Myrtle Avenue is proposed to be rezoned from MR-2 (Multiple-Family Residential Dwelling) District to GC-2 (General Commercial) District. Said property being more particularly described as follows: Lots 6, 7 and 8, Block 11, Tier 7, Town of Sanford, Plat Book 1, Page 62, Public Records of Seminole County, Florida. The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the proposed rezoning. No one appeared. The City Clerk reported that notice was sent to the owner, Robert Brisson, on October 3, 1983, and the property was posted on October 3, 1983. On recommendation of the Planning and Zoning Commission, Commissioner Farr moved to authorize the City Attorney to prepare the proper ordinance to rezone the property. Seconded by Commissioner Yancey and carried. The next item of business was a public hearing to consider a renewal of a franchise with Florida Public Utilities Company, for 30 years with a franchise fee of 6% of the gross revenue from residential customers. Art Maheu, Florida Public Utilities Company, MINUTES City Commission, Sanford, Florida 119 appeared to support the proposed franchise. Attorney to prepare the proper ordinance for carried. Commissioner Smith moved to authorize the City same. Seconded by Commissioner Yancey and Request submitted from Nanci S. Yuronis, Director, Star of Sanford, to waive the ordinance restricting sale of alcoholic beverages prior to 12:00 Noon on Sunday and to permit them to serve alcoholic beverages on Sundays, beginning at 10:30 A. M. for the cruise-dinner ship. Commissioner Smith moved to deny same. Seconded by Commissioner Farr and carried. Robert B. Thomas, Jr., 129 Bethune Circle, Sanford, Florida, spokesman for a group of residents from Academy Manor, appeared to discuss the results of the fire on October 29 1983 at the United Solvents of America, Inc. plant at 1107 Airport Boulevard. He reported damage to cars, vegetables, homes and people living in the area. He requested the City not allow United Solvents to rebuild that type of operation at that location, and submitted a petition to support his position. Louise Wellon, 139 Bethune Circle, Sanford, Florida, appeared and reported she had inhaled fumes from the fire which caused her to be hospitalized, and that the United Solvents operation is dangerous and could be fatal to residents living in the area. The Mayor reported that if United Solvents of America, Inc. wants to rebuild, they will have to obtain the City's permission to do so, and if they do, the nearby residents' concerns will be considered. John Mercer, 900 Palmetto Avenue, Sanford, Florida, appeared as spokesman for Southeast Bank, and announced that said bank has committed a quarter of a million dollars for owner-occupied dwellings in the area rezoned by Ordinance No. 1662, to be used to bring the dwellings into compliance with Codes, each owner can borrow up to $5,000.00 at interest 1% below the prime rate, and take up to seven years to repay the loan. Box 1778 Sanford, FI 32771-0212 Dear Mr. Knowles: After some updated prelimary conversation with Mr. Harriett, concerning a joint venture between I.W.S. and the city of Sanford for a solid waste transfer facility, we have come up with the following:r~ The city of Sanford will provide a portion of its Poplar Avenuec ~/~1~3~ Maintenance Facility to I.W.S. and issue I.W.S. the right to operate a transfer station on this site. In return I.W.S. will provide all necessary labor, materials and equipment to operate this facility. The major incentive for I.W.S. is to have a place to, discard our refuge at a central location. Due to the availability of our own dumping facility we can cut our costs and more im- portantly for you, pass on the same benefits to the city of Sanford. Example: 1. Your dumping costs will be cut by approximately 22% under your 1983 budget. This savings can be as high as $25,000.00 for the year. In addition we will lock in for a period of two years our dump per yard price to you. Thereafter, normal operational increases will be negotiated. 2.) In addition to the obvious financial savings, there are considerable hidden benefits which cannot be overlooked. a.) Accessibility to dump anytime day or night. During your holiday seasons and special occasions the overload can be routed and discarded at your convenience. This will stop the unsightly mess that is sometimes left overnight on the city streets. b.) c.) Less Wear and Tear on Equipment. The distance %o the dump will be reduced passing on a fuel savings as well as lessening flat tires and additional tire wear. Labor costs. Will be cut due to the driving distance and waiting time at the dump. Mr. Knowles, I believe this general outline of our proposal to the city of Sanford can be beneficial to both of us. M. 1983 The City Manager reported the City would save $18,765.00 to $25,020.00 annually, and the only obligation of the City is to provide the site as selected at the pound yard on West Sixth Street. On recommendation of the City Manager, Commissioner Smith moved to enter into an agreement for same, and disposal of city refuse for a guaranteed rate for two years at $2.20 per cubic yard. Seconded by Commissioner Keith and carried. The City Manager reported that Barnett Bank of Sanford has offered to contribute for playground equipment $5.00 for each new account opened at their bank during the promotional grand opening period, and estimated the amount would be approximately $2,000.00. On recommendation of the City Manager, Commissioner Yancey moved to accept same and to send Barnett Bank a letter of appreciation. Seconded by Commissioner Smith and carried. The City Manager reported that the City Commission had approved the City paying for the dredging of the East and the West basins of the Marina, at an estimated cost of $117,063.00, with the understanding the marina operator would be installing additional docks and thereby generate additional revenue to the City. However, the State has denied their request to install the additional docks and breakwater. Further, he believes the marina operator will get the additions, but it may take time. Also, the East basin has been completed and if the dredging of the West basin is completed now, while the contractor and equipment are here and the settlement ponds set up, it will cost less than if the City waits until the additional docks and breakwater are actually approved. Commissioner Yancey moved to continue dredging. Seconded by Commissioner Smith and carried. The City Manager reported that the State of Florida Department of Environmental Regulation is requiring lab monitoring of three observation wells around the Art Lane area, used to dump yard trimmings only, at an unbudgeted cost of $2,940.00 per year. On recommendation of the City Manager, Commissioner Yancey moved to authorize transfer in the Refuse Division budget from funds saved if the Industrial Waste refuse disposal plan is accepted. Seconded by Commissioner Smith and carried. Commissioner Yancey moved to authorize salary reclassifications as follows: Aaron Keith, Police Department, from Police Officer E to F, $20,226.06 annual. Joe Dillard, Police Department, from Police Sergeant E to F, $23,070.32 annual. Clifford Anderson, Jr., Public Works Department, Street Division, from Heavy Equipment Operator E to F, $17,483.60 annual. Seconded by Commissioner Farr and carried. The City Manager reported that Jonathan S. Sundheim, Senior vice President, US Home, a land development company, has asked the City to delay implementation of the increased utility connection fees, possibly until after July 1, 1984, so they could construct their proposed 600 dwelling units South of Lake Minnie and West of 17-92 at the present fee. The Commission affirmed action taken at meeting of November 7, 1983, and denied the request. 128 MINUTES City Commission, Sanford, Florida November 14 at 7:00 P. M.1983 Commissioner Farr moved to authorize the City Manager to request the Seminole County Legislative Delegation to introduce local legislation to freeze the present 4¢ local gasoline tax revenue distribution formula for the duration of the tax, to avoid annual changes in the distribution formula as proposed by Seminole County. John LeRoy, 1401 East Second Street, Sanford, Florida, appeared and reported he was a member of the Advisory Charter Committee, and favored a recommendation that the Charter be revised to require election of Commissioners by districts, but that the voters of MINUTES City Commission, Sanford, Florida November 14 at 7:00 P. 129 M. 19 83 the City of Sanford had turned down the proposed Charter, and he did not think that lawsuit filed by five members of the community should force the Commission to go to districts, when the voters did not want districts. A public hearing was held in accordance with notice published in the Evening Herald on November 10, 1983, as follows: NOTICE OF PROCEEDING FOR VACATING AND ABANDONING EASEMENTS AND A PORTION OF A STREET. TO WHOM IT MAY CONCERN: You will take notice that the City Commission of the City of Sanford, Florida, at 7:00 o'clock P. M. on November 28, 1983, in the City Commission Room at the City Hall in the City of Sanford, Florida, will consider and determine whether or not the City will close, vacate and abandon any right of the City and the public in and to easements and a portion of Maple Concourse, all lying between 17 & 92 (Seminole Boulevard) and Fulton Street and between Poplar Avenue extended Northerly and French Avenue, further described as follows: PARCEL Ail of the remaining portion of Maple Concourse that was not vacated and abandoned pursuant to City of Sanford, Florida Ordinance No. 1124, adopted April 23, 1973, and said abandonment as recorded in Official Records Book 977, Page 418, Official Records of Seminole County, Florida, extending in a Northerly direction from the intersection of Maple Concourse and Fulton Street, as shown in the plats of LAKE MONROE INDUSTRIAL PARK, Plat Book 14, Page 29, Public Records of Seminole County, Florida, and LAKE MONROE INDUSTRIAL PARK AMENDED REPLAT, as recorded in Plat Book 14, Page 78, Public Records of Seminole County, Florida. PARCEL II That 14 foot utility easement lying between Lot 8, LAKE MONROE INDUSTRIAL PARK AMENDED REPLAT, Plat Book 14, Page 78, and Lots 7, 10 and 11, of LAKE MONROE INDUSTRIAL PARK, Plat Book 14, Page 29, Public Records of Seminole County, Florida. Said utility easement extending from the intersection of said easement and Fulton Street and running continuously Northerly to its termination point at the Northwesterly corner of Lot 6, LAKE MONROE INDUSTRIAL PARK, per Official Records Book 14, Page 29, Public Records of Seminole County, Florida. PARCEL III That 14 foot utility easement lying between Lot 7, LAKE MONROE INDUSTRIAL PARK, Plat Book 14, Page 29, and Lot 8, LAKE MONROE INDUSTRIAL PARK AMENDED REPLAT, Plat Book 14, Page 78, extending from the Northwesterly corner of said Lot 8 and running East to termination point at the Northeasterly corner of said Lot 8 and the Southeasterly corner of said Lot 7.
