A public hearing was Herald on November 10, held in accordance with notice published in the Evening 1983, as follows: NOTICE OF PROCEEDING FOR VACATING AND ABANDONING EASEMENTS AND A PORTION OF A STREET. TO WHOM IT MAY CONCERN: You will take notice that the City Commission of the City of Sanford, Florida, at 7:00 o'clock P. MINUTES City Commission, Sanford, Florida 131 November 28 at 7:00 P. M. 1983 Berry, The City Clerk reported that notice was sent to owners Robert G. Feather, C. H. Charles W. Hardwick, Walter J. Gardner and the Sanford Herald on November 4, 1983. Michael Gray, Attorney with the firm of Cleveland and Bridges, 209 North Oak Avenue, Sanford, Florida, appeared to support the request. The City Manager submitted a recommendation to vacate Parcel I and Parcel requested, but to vacate Parcel II only in exchange for a 14 petitioners West property line and replacement of privately owned lot on 17-92. III as foot utility easement on the the existing two inch water line to the On recommendation of the City Manager, Commissioner Keith moved to authorize the City Attorney to prepare the proper ordinance for same, subject to agreement of both parties on the 14 foot utility easement and two inch water line. A public hearing was held in accordance with notice published in the Evening Herald on November 8 and 18, 1983, as follows: NOTICE OF A PUBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on November 28, 1983, to consider changes and amendments to the Zoning Ordinance of the City of Sanford, Florida, as follows: A portion of that certain property lying North of and abutting Lake Mary Boulevard and West of Sir Lawrence Drive is proposed to be rezoned from AD (Agricultural) District to SR-1A (Single-Family Residential Dwelling) District. Said property being more particularly described as follows: The West one-half of the Southwest one- quarter of the Southwest one-quarter of Section 10, Township 20 South, Range 30 East, Public Records of Seminole County, Florida. The City Clerk reported notice was sent to the owner, Len Sloboda, on October 27, 1983 and the property was posted on November 1, 1983. Len Sloboda appeared to support the rezoning and reported he plans to construct single-family homes on the prcperty, and had dedicated 1.3 acres for a park area. On recommendation of the Planning and Zoning Commission, Commissioner Yancey moved to authorize the City Attorney to prepare the proper ordinance to rezone the property. Seconded by Commissioner Farr and carried. M. on November 28, 1983, to consider changes and amendments to the Zoning Ordinance of the City of Sanford, Florida, as follows: The Code of the City of Sanford, Florida Appendix A, Zoning Ordinance (Ordinance No. 1097, As Amended) ARTICLE VIII. SUPPLEMENTARY REGULATIONS Sec. 6. Site Development Plan paragraph (1) shall be amended to read as follows: (1) No building, structure or use shall be erected, altered, installed or maintained except in conformity with the provisions of this ordinance, and with a site development plan approved as provided herein. Due to the Christmas holidays, Commissioner Fart moved to hold the regular meeting of December 26, 1983 on December 27, 1983. Seconded by Commissioner Smith and carried. The City Manager reported that Jon Sundheim, U. S. Home Corporation, had requested clarification of the City's water and sewer connection fees for multi-family buildings, if they are revised effective in July, 1984. The Commission affirmed that the "sliding scale" would remain in effect. The City Manager reported that the City had a private firm, Flowers Laboratory, test the water from Sanford's water wells for EDB, and their results show only the #2 Well to be above the acceptable limit, where the State Laboratory's results show the ~2, #4 and #7 Well to be above the acceptable limit. He also submitted a report on present and future water needs and capacities. Commissioner Farr moved to authorize City Staff to proceed with obtaining information on a site or sites for three new wells. Seconded by Commissioner Keith and carried. Commissioner Farr moved to continue efforts with Seminole County to test the wells at least monthly, and to put them back into service as soon as possible when the water is safe. The City Manager reported that the City Attorney's office is researching action to be taken to vacate a park in Country Club Manor, which was never developed or used as a park. The City Manager submitted a proposed contract with Conklin, Porter & Holmes- Engineers, Inc., for Consulting Engineering Services for Wastewater Treatment and Effluent Disposal Facilities, with planning fees in amount of $32,700.00. MINUTES City Commission, Sanford, Florida November 139 28 at 7:00 P. M. 198~ carried. The City Manager reported that David Redwine had submitte~ to the Planning and Zoning Commission a site plan for an automobile salvage yard on the West side of Airport Boulevard, across from Academif Manor, and that the Planning and Zoning Commission had decided that it was a permitted industrial use in an MI-2 zone. Further, that the City Code, Section 14-2 prohibits salvage yards in all commercial areas of the City. Michael Gray, Attorney with the firm of Cleveland and Bridges, 209 North Oak Avenue, appeared to represent David Redwine and to support the proposed salvage yard. He reported Mr. Redwine had taken the request to the Building Division, who sent it to the Planning and Zoning Commission to see if it would comply with the zoning regulations. Further, many uses which are not set forth in the Zoning Ordinance as permitted uses in an MI-2 zone are permitted, and industry is a permitted use proposed salvage yard is an industry. Commissioner Smith moved to deny the request. carried. The City Manager submitted a letter from ROLM Florida, stating that the City will be asked to purchase the present telephone system in City Hall, and offering their services and equipment as alternatives. The Commission took no action. The City Manager reported that the state contract price for police vehicles rose 27% over last year's price, and the City only budgeted a 10% increase. Further, the Police Chief says he will use a standard vehicle. On recommendation of the City Manager, Commissioner Smith moved to authorize the purchase of two police vehicles under state contract at $9,336.00 each and one standard vehicle under state contract at $9,052.00, and make up the deficit in the police department budget during the year. Seconded by Commissioner Keith and carried. The City Manager reported the City had budgeted to replace seven pickup trucks, including a 3/4 ton unit and the Parks Superintendents unit. On recommendation of the City Manager, Commissioner Yancey moved to purchase the two replacement trucks under state contract in amount of $6,566.48 each, and to purchase five used, low mileage rental cars in amount of $6,200.00 to $6,300.00 each, in lieu of the five pickup trucks.
