Notice is hereby given that a Public Hearing will be held at
the Commission Roem in the City Hall in the City of Sanford,
Florida, at 7:00 o'clock P. M. on December 12, 1983, to consider
changes and amendments to the Zoning Ordinance, and amending the
Future Land Use Element of the Comprehensive Plan of the ,City of
Sanford, Florida, as follows:
A portion of that certain property lying between 22nd
Street and 24th Street and between Holly Avenue and
French Avenue is proposed to be rezoned from SR-1
(Single-Family Residential Dwelling) District to GC-2
(General Commercial) District. Said property being
more particularly described as follows:
Lots 1 through 5 and the North 35.79 feet of
Lot 6, and all of Lots 13 through 17 and the
North 35.86 feet of Lot 18, and the vacated
alley between, and the West one-half of
vacated Maple Avenue adjacent on the East,
Bonaventure, Plat Book 5, page 85, Public
Records of Seminole County, Florida.

The Chairman announced that the Commission would hear from those persons present
to speak in favor of, or in opposition to, the proposed rezoning.
Robert Morris, Attorney, appeared and reported he represents the owner, Bob Ball,
who plans to build townhouses on the property, that MR-1 or MR-2 zoning would permit same,
but the Building Division and Planning and Zoning Commission felt either of those zoning
classifications would be spot zoning, and the property would have to be rezoned to GC-2,
which would abut the present GC-2 zoning along Highway 17-92. Further, Mr. Ball or his
representative has contacted property owners in the area, and all but two are in favor of,
or have no opposition to, the GC-2 zoning.
Bob Ball appeared and reported that multi-family zoning is alright with him.
Les Balogh, 2006 Holly Avenue, Sanford, Florida, appeared and reported he opposes
the proposed commercial rezoning, but does not oppose the apartments.
The City Clerk reported that on November 14, 1983, a recommendation had been
submitted from the Planning and Zoning Commission to deny the rezoning to GC-2, General
Commercial District.

The City Manager reported that the Planning and Zoning Commission was in favor of
the apartments, but did not approve the GC-2 zoning.
The City Attorney reported the City Commission has the power to amend, supplement
or modify recommendations of the Planning and Zoning Commission, after each has held a public
hearing to consider the issue.
Commissioner Yancey moved

a buffer zone between the abutting

single-family and commercially zoned property. Seconded
by Commissioner Farr and carried over dissenting vote of Commissioner Smith.

The City Manager reported that Robert G. Feather, owner of the property, has
agreed to provide a ten foot wide utility easement on the West property line and to relocate
the existing two inch water main to the lot now served by it.

The City Manager reported the City has made arrangements with a private, state
certified lab to have the City's wells tested for EDB, the Tallahassee office of Health and
Rehabilitabive Services indicates they will have the three wells retested prior to December
16, 1983, and the Department of Environmental Regulation would cooperate with retesting
through their Tallahassee lab. Further, he submitted a letter from the Florida Departnent
of Environmental Regulation, suggesting the City retain a consultant to investigate well
drawdowns as well as the feasibility of installing
the well heads as an interim measure.
Commissioner Farr moved to authorize the
granular activated carbon filtration at
City Manager to organize a City task
force to investigate developing a filtering system that could be adaptable to other water
systems, in accordance with the Department of Environmental Regulation recommendations.

The City Manager reported that the Marina operator has received a permit to dredge
the West basin.
The City Manager submitted a report from Mack LaZenby on beach erosion at the
marina, and recommended the following:
a) City to rebuild the beach area once the dredge work is complete; utilizing
the spoil materials. Establish a 3:1 slope for the erosion control area.
b Install a Tri-Lock Erosion Control system on the 3:1 slopes from a minus 2
elevation to a plus 5 elevation with filter fabric. This is interlocked
