The City Commission of the City of Sanford, Florida, met in Regular Session in the
City Hall in the City of Sanf~rd, Florida, at 7:00 o'clock P. M. On December 27, 1983.

OF THE DENIAL OF A CONDITIONAL USE.
Notice is hereby given that a Public Hearing will be held at
the Commission Room in the City Hall in the City of Sanford,
Florida, at 7:00 o'clock P. M. On December 27, 1983, to consider
an Appeal of the Denial, by the Planning and Zoning Commission,
of a Conditional Use to construct one duplex, on a portion of the
property lying between Maple Avenue and French Avenue and between
20th Street and 22nd Street, more particularly described as
follows:
Lot 19, Boyd's Subdivision, Plat book 1, page 85,
Public Records of Seminole County, Florida.
The City Commission may, after Public Hearing, affirm, deny,
or modify the decision, finding and recommendation of the
Planning and Zoning Commission, and the action of the City
Commission shall be final.
All parties in interest and citizens shall have an
opportunity to be heard at said hearing.

I. TYPE OF CONSTRUCTION OF BUILDING
1. Shall be Type 1 construction, Sec. 602, 1982 Standard Building Code.
--- A. Structural members shall be on non-combustible material,
including roof interior and exterior bearing walls.
2. Building shall have automatic sprinklers throughout. Sec. 407.4 (e)
1982 Standard Building Code. Sprinkler system shall be designed
in accordance with 1982 Standard Fire Prevention Code, Sec. 20.405-
Design & Construction of Inside Storage Rooms.
3. The area used for inside storage of flammable liquids shall be in
accordance with 1982 Fire Prevention Code, Sec. 20.405, Design &
Construction of Inside Storage Rooms, and Sec. 20.406, Storage in
in Inside Storage Rooms.
4. Areas in the building used for the processing of flammable liquids
shall meet all requirements of NFPA 30, Chapter B, Processing Plants.
5. Building Location on Property.
A. Zoning Ordinance (MI-2) requires .minimum 25' front yard setback,
minimum 20' rear yard setback, 15' minimum side yard setback.

B. 1982 Standard Fire Prevention Code, 20.402-7, Requires 50' from
any building or line of adjoining property unless 2-hr. fire walls
are provided. All of Chapter 20 is relevant.
C. NFPA-30, Chapter 8, Sec. 8-5-1, Tank Vehicle & Tank Car Loading
and Unloading. Loading & unloading facilities shall be separated from
above-ground tanks and warehouses and other plant building or nearest
line of adjoining property which can be built on by a distance of 25'
for Class I liquids and 15' for Class II and Class III.
6. Building shall meet all requirements 1981 National Electric Code,
Ref. Chapter 5, Special Occupancies, Art. 500-Hazardous Locations,
Art. 515, Bulk Storage Plants and Art. 501, Class I Locations.
7. Means of egress from building shall meet all requirements of 1981
Life Safety Code, Chapter 28, Means of Egress.
8. Building shall meet all requirements of Sec. 6.5, 1981 Life
Safety Code, Sec. 6.5, Interior Finishes.

II. ABOVE GROUND STORAGE TANKS
1. Shall meet all of 1981 Fire Prevention Code, Chap. 20, including
Division II, Sec. 20.202, Fire Protection for Above Ground Tanks.
Foam fire protection shall be required by fire authority having
jurisdiction for any above ground tanks for the storage or handling
of Class I flammable liquids when such tank or group of tanks are
less than 50' apart. 1982 Edition, NFPA 30, all of Chapter 2-2,
Installation of Above Ground Outside Tanks, which addresses distance
from property lines and diking around tanks, depending on size of
tank. (Also see attached .copy and description)
III. UNDERGROUND TANKS

The City Attorney reported he had reviewed the City Code and found the uses for
which United Solvents of America, Inc. has been utilizing the property, are conditional uses
under MI-2 (Medium Industrial) District zoning, and if the owners elect to rebuild, they
will have to meet all conditional use requirements.
Jack T. Bridges, Attorney with the firm of Cleveland and Bridges, appeared to
represent the owners and reported that United Solvents of America, Inc., wants to comply with
all applicable City, State and Federal rules and regulations.
Further, that the conditional
use exists and the owners should not have to obtain approval of a new conditional use.
The City Manager reported that tractor #54 in the Street Division has a blown
motor and is not worth repairing and recommended purchase of a replacement from Robinson
Equipment Company, Inc., low bidder on August 19, 1983 in the amount of $9,079.50, the same
amount they bid.
Commissioner Smith moved to authorize same, and transfer from Contingency.
Seconded by Commissioner Yancey and carried.

Dear Sandra:
At the meeting of December 7, 1983, the Council of Local Govern-
ments authorized me, as Chairman, to propose a compromise which
would change the current fuel tax distribution and end the con-
troversy which has existed about this issue. The compromise would
be as follows: the portion of the allocation of the fuel tax to
the county (64.89%) and to the seven cities (35.11%) remain the
same. The one change to the current distribution would be that
the 35.11% cities' portion would remain fluid throughout the term
of the tax. The distribution of that 35.11% would be based on
each city's contribution to the transportation improvement effort
, based on the previous five' years.
If this compromise can be agreed to by the Seminole County Board
of Commissioners, I will then take it back to the Council of Local
Governments for their approval. Such action by the county and
the cities would- make-llnnecessary the proposed "clar ification
legislation" and end the bickering that has existed between some
county and city officials concerning this issue.
Sandra, I would appreciate you placing this item on a County
Commission agenda prior to the January 11, 1984, CALNO meeting.

using water supplied by the City of Sanford, and the Sanford City Commission approved a
total of 1,057 connections.

follows:
