Petition from the Board of Public Instruction amd from ~,Iessrs. C. D. Brumley and I. D. ~,L~rtin requestin~ the vacating of Garden Street in Eldorado Subdivision, cud on motion duly adol~ted the City Attorney was instructed to draft an Ordinance closing amd vacating s~ne. On motion duly adopted the ~ity Clerk was authorized to publish ~Iotice of Sale of Bonds for City Improvements for September ~rd, 1026 at 2:30 P. ~_. aggregating ~!,575,000.00. On motion duly adopted the City Clerk was authorized to appropriate ~$200.00,from the Contingent Fund to the .~erican Legion and to draw check for same in favor of L[.D. I-~tton, Commander. ~,Ir. E. A. That the City of Sanford will permit the said Railroad Company at any time to extend its track or tracks on, over amd across the said strip of land by means of an overhead bridge or underpass. Also tn~ the City ~ Sanford shall by resolution or in other prooer manner, re- scind that ~oart of the motion adopted by its City Com~nission at a re~iular meeting held October 26 1925, per-raining to the opening of Commercial Street west from Oa~ Avenue (ii' extended) across the tracks and :?red, arty of the Atlantic Coast Line ~lroa~ Company, and ~d~EREAo, the City of Sanford Florida is willing to accept said conditions, THEREFORE BE IT ORDAINED BY THE PEOPLE OF THE CITY OF SA]~FORD, FLORIDA. SECTION 1. That upon the Atlantic Coast Line Railroad Company delivering to the City of San£ord an easement deed to the above described strip of land containing the condition above set forth , the City of Sanford shall and does hereby agree to accept said easement deed with the conditions above set forth therein contained. SECTION 2. That the City of Sanford in consideration of said deed, hereby rescinds that part of the motion adopted by its City C~om?,ission at a regular meeting ne!d October 26, 1925 ~ertaining to the opening of Oommercial otreet west £rom Wak Avenue ~ if extended) across ~racks and property of 4he Atlantic Coast Line Railroad Con~pany. SECTION 3. That said easement deed when executed and delivered by the Atlantic Coast Line Railroad Company shall have inscribed upon said deed the following words, "This deed is accepted by the City of Sanford under all the terms and conditions of Ordinance No. 134, of the City of Sanford, Florida, passed on the 10th day of August 1926." SECTION ~'~. That this ordinance shall be and become effective immediately upon its passage and adoption. Adopted in regular session this 10th day of August A.D.1926.
