042528CITY COMMISSION, SANFORD, FLORIDA,. miNUTES ADJOURNED SESSION - April 271 The City Commission of the City of at the City Hall at 1:30 P M April 25, 1928 Present: Co~nissioner E F Housholder Sanford, Florida met in an adjourned Session Mayor " S 0 Chase " Frank L Miller City Attorney , George A DeCottes. City Clerk F $ Lamson Mr W H Doty, representing the Globe Dredging Co. of Ssvannah Ga, presented claim against the City for $4675.00 and submitted as documentary evidence as proof of said claim, a statement in writing over his signature as Secretary of the Globe Dredging Co. setting forth~ his claim, bank statement of the Seminole County Bank, cancelled note of the Globe Dredging for $10,000.00 cancelled check of the Globe Dredging 0o. payable to the Globe Dredging Co. in the sum of $5,000.00, and original telegram from the Seminole County Bsnk to W H Doty, dated December 30, 1926. The City Attorney having been previously instructed to investigate the claim and report his legal conclusions thereon, and the City Attorney having reported that from investigation made it is his opinion that the claim presented is an obligation of the City , and as S G Gray, City Auditor having been called into conference regarding the matter, explained to the City Commission that it was an item not included in his audit because, the item in question was apparently represented in Bond Trustees Voucher No. 3?74 which appar-i ently had been paid in full. Thereupon, ~oon motion of Commissioner Miller and unanimously adopted, the legal recommendation of the City Attorney was approved, and it was ordered that the claim of the Globe Dredging Co. for the sum of $4675.00 as set up in the papers aforesaid constitute an obligation of the City payable to the Globe Dredging Co. out of the funds available therefor, and the City Cl~rk was directed to voucher the same and present to the Board of Bond Trustees. On motion which unanimously prevailed, it was ordered that the Auditor re-adjust the Globe Dredging Co. account by allowing them a credit of $1988.33 , representing charge made against them for bond premium on their contract for construction bond that was never issued. City Clerk submitted for the consideration of the Commission, letter from the City Attorney under date of April 23, 1928 transmitting executed contract with the Sanford Gas Company and check of the Gas Company on account of interest, in the sum of $9714.38 and was ordered to have same set up on the books of the City in accordance with the suggestions contained in the letter from the City Attorney. The City Clerk was instructed to open a new bank account entitled "Gas Plant Sinking F~md Account." and to deposit therein the check for $6~50.O0 first payment on account of the purchase of the Gas Plant by the Sanford Gas Company. The City Clerk was ordered to issue a check in favor of the Sanford Gas Co, to the amount of moneys representing gas meter deposits due them. City Attorney, DeOottes, reported as to progress made in securing right-of-way for Seminole Boulevard from Myrtle Ave. west, and same was aoproved. City Clerk was instructed to deliver certificate of deposit $2105, dated April 8, 1927, issued by the Seminole C~unty Bank to the Globe Dredging Co, and endorsed by the Globe Dredging Company, to Mr S G Gray of the firm of Hall & Pentland, City Auditors, for the pur- CITY COMMISSION, SANFORD, FLORIDA, MINUTES Adjourned Session April 25, 1928 373 City Clerk was dated February 29, 1928, for $128.40. instructed to voucher bill of Lucien H Boggs on account of expenses, for $90.53 and also bill of April 2, 1928, on account of expenses, Upon motion duly adopted the City Clerk was instructed to transfer the Sum of $5,000.00 f=om the contingent fund to the contingent litigation Audit and Eefinancing ?.~ud.
