Upon motion duly adopted, the salaries of Mrs A E Powers and Mrs Elsa Knight were ordered increased from $60.00 to $?5.00 per month each. The Chairman next announced that the time had arrived for the opening of bids for const=uctiom of a roof over the City Reservoir. Gentlemen:- As the County Attorney of Seminole County, I desire to bring to your attention and present for paDnent two certain claims against the City of Sanford and earnestly request your careful con- sideration and prompt payment of the s~me. The first claim is based upon certain indebtedness originally due by the City of Sanfor~ to the Hutton Construction Co. which claim was duly presented and approved for payment on 5~rch 23, 1926 by your city authorities, same being for certain paving contracted for by the City of Sanford with the Hutton Construction Co., and on which date, after the approval of said clai~, your city by its legally constituted authorities, issued voucher No. 7406~~, desigqated as time warrant on account of the City of Sanford Bond Trustees, principal amount of $15,000.00. This warrant was to draw interest at the rate of eight per cent per annum from its date, payable quarterly, which was properly and legally signed and issued under authority as contained in resolution properly and legally passed and adopted on the 8th day of February A.D. 1926 by the Honorable Board of City 0ommissioners at that time. Said warrant or certificate of indebtedness was for value, transferred, assigned and deliver- ed by the Hutton Construction Co. to the Seminole County Bank , a banking corporation of Sem- inole County, Florida, at that time doing a banking business in said State and County. That later said Seminole County Bank, for value received, transferred and assigned said time warrant to Seminole County , a political subdivision of the State of Florida, for v[[ue re- ceived, prior to its ceasing to do business in said State and County on August 6, 1927. The above time warrant or evidence of indebtedness issued by the City of Sanford, to the Semi~ le County Bank as aforesaid, was for a vlauable consideration prior to the closing of said Semino~.e County Bank ~nd before said warrant bec~me due, delivered, endorsed and assigned for value aforesaid to Seminole County , Florida, and is now held and presented for payment, same being now due and unpaid. Will you be kind enough to authorize and direct the payment of the above claims and in the event of your refusal to do so, please make such entry as would indicate your refusal and your reasons therefor ? Upon motion of Commissioner Niller, which unanimouSly prevailed, it was ordered that N P NcEvans, now serving a sentence in Jail, be parolled on good behavior, with instructions to the Chief of police that if Nr NcEvans gets into any kind of trouble, that he be re-arrested a~d~ compelled to serve out the balance of his present te~m in Jail. Resignation of Dr 0 P Vincent, as City Physician and Food Inspector, presented and accepted! as of August 7th 1928. Application of Dr J N Tolar for the position formerly held by Dr C P Vincent, presented, and upon motion duly adopted Dr. Tolar was appointed as City Physician and Food Inspector, effect- ive as of August ~th 1928. Upon motion duly adopted the 1927 Personal Tax of Ers N L Strong was reduced from $43.75 to $25.00, incorrect assessment. Upon motion duly adopted $~a.50 of the 1926 Personal Tax of J W Sneed was ordered cancelled o on account of double assessment. The Clerk reported the receipt of a check from the Town of Longwood, Florida for $150.OO as part payment on the purchase price of Ford Chemical Wagon sold to Longwood by the 0ity of Sanford, Florida, and also a time w~rrant for $150.00 covering the balance of the purchase price of $300.00 s~id time warrant to draw interest at 6% per annum, payable semi-annually and due August 2, 1929. The Clerk presented 155 un-executed Special Assessment Bonds , Series TT authorized under Resolution No. 357, dated August 26, 1927, same having been printed b~t never sold, and same were ordered destroyed. Dr M H King appeared before the Commission as a representative of the Litex Display Con~oany,. a company manufacturing and installing illuminated trash containers, and requested the privilege of installing in the City of Sanford these display Receptors for a term of Five CITY COMMISSION, SANFORD, FLORIDA, 429 MINUTES Re~u]~.r ~t~g A~ 13 ~ ? ~ 19 ?~ "To HONORABLE MAYOR AND CITY COM~,~ISSIO~ERS. We, the LITEX DISPLAY COMPANY, Dr M H King, Manager of this District, do hereby pe- tition your honorable body for the privilege of installing in the City of Sanford, our won- derful utility and display Receptors for a term of five years with the privilege of renewing same at the expiration of franchise. We agree~to install said Receptors absolutely free of charge to the City and maintain them during the life of our contract. We also further agree to install said containers under the general supervision of the City Con~issioners. We, as individual Commissioners, hereby endorse above petition without being obligator~ on our part. ~l .F Housholder ,, .F. rank L Miller After a discussion of the merits of this form of container, permission was granted as requested, with the proviso, that said permission may be rescinded at any time that the City 0ommission may see fit to do so. Upon motion duly adopted, the Clerk was instructed to notify the Clerk of the Circuit Court to allow the redemption of the Tax Certificate against Lot 2 Blk 9, Chapman & Tucker's Addition , Sanford, Fla, issued for the non payment of City taxes for the year 1926 without the payment of the 192~ City Taxes against this property. Commissioner Frank L Miller introduced Resolution ~3~2 which was unanimously adopted and the roll beirg called, the vote stands as follows: E F Housholder, - Aye Frank L Miller Aye Said Resolution being in words and figures as follows: BE directed RESOLUTION No. 3?2 IT RESOLVED, that the Mayor of the 0ity of Sanford, Florida be and he is hereby and instructed to call a special alection to be held throughout the City of Sanford Florida on the lath day of September A D 1928, to determine by the vote of the electorate whether certmin amendments shall be adopted to the Charter of the City of Sanford, Florida, under the provision of Section 136 of Chapter 9897, Laws of 1923, said proposed amendments being as follows to-wit: "SECTION 8. That there is hereby to consist of five members, three created a City Commission of the City of Sanford, Florida of whom sh~ll be elected mt the annual election to be held in the City of Sanford, Florida in the year 1928, one of whom shall be elected for a period of one year, one of whom shall be elected for a period of two years, and one of ~hom shall be elected for a period of three years. At each annual election hereafter, a commissioner or commissioners shall be elected for a term of three years to isucceed the Commissioner, or com- missioners ~hose term or terms of office are about to expire. The 0ity Oommiseloners now hold ina office shall continue in office until their present terms of office expire, unless vacancies therein otherwise occur. It shall not be lawful for state or county officers to hold an elective office under t~e government of the City of Sanford, but such officers may be employed under the City government of the City of Sanford provided such officers have the necessar~r qualifications." "SECTION 13, A majority o£ all the members elected to the City Commission shall consti- tute a quortua, but a lesser number may adjourn from day to day and compel the attendance of absent members in such manner and under such penalties as may be prescribed by ordinance. The affirms.rive vote of three members shall be necessary to adopt any ordinance or resolu- tion, and the passage of all ordinances and resolutions shall be taken by Yeas and Nays, and entered upon the minutes." "SECTION 30 The City Oommission shall at the time of organizing at its first annual meeting each and every year, elect one of its members as Mayor of the City, provided, however, a member of the Oity 0ommission shall not be entitled to succeed himself as Mayor without the unanimous vote of the remaining memoers of the City Commission. In case the members of the City Commission are unable to agree on the selection of a Mayor within five days after organ- izing, the mayor shall be chosen oy lot conducted by the Oity Clerk, the result of such lot zo be spread upon the minutes of the City Commission. It shall be the duty of the mayor ~rom' time to time to designate some ~ember of the City 0ommission to act as mayor during his ab- sence from the City, or during his aosence from any meeting or meetings of the City 0om- mission." ,SEOTION5t The City Commission shall appoint a board of bond trustees to consist of three members, whose term of office shall be at the pleasure of the City Commission, said bond trustees shall constitute the trustees of the sinking fund of the City of Sanford, and shall succeed to all of the duties and powers and responsibilities imposed by ordinance of the City of Sanford or by any law on any board of bond trustees now existing. It is hereby made the duty of the present board of bond trustees of the City of Sanford, to turn over all moneys, se- curities, bonds and other papers pertaining to their office to the said board of bond trustees hereby created within ten days after the appointment of said board of bond trustees, and the acceptance of such office, and the said board of bond trustees shall receipt the said City Con~nission as such for all moneys, funds etc, and shall cause the ac~unts of the present board of bond trustees to be audited, and shall deposit such funds, bonds or securities in designated depositories for sinking funds. The said board of bond trustees as trustees of the sinking fund, shall be trustees of such bonds as may be issued from time to time for author- ized municipal purposes and shall manage and control the sinking funds created for the liquid- ation of such bonds, subject to the provisions of the general laws of the S2ate and the ordinances of the City with relation to the management of such funds." "Said board of bond trustees shall cause all funds coming into their hands to be deposited in the regular designated depositories of the City of Sanford, Florida, and shall require said funds to be ond hundred per cent secured by Federal , State, Count, School, District of Municipal bonds." Such notice shall be by personal service upon the owner or agent or by leaving a copy of said notice at his usual place of business, or last place of residence., or by mailing said notice to the last known place of residence of said owner or agen, or by publishing said no- tice in a newspaper published in the City of Sanford, three times prior to the date of said meeting, such notice shall be made or given at least ten days prior to the date of the meeting of said Equalization Board." "SECTION 75 The Equalization Board shall have the power to change the valuation or assessment of any real or personal property upon the roll by increasing or decreasing the asees~- ed value thereof as shall be reasonable and just to render taxation uniform; provided that the valuation of any real and personal property as returned by the Assessor; shall not be increasedi without first ~iving the owner or his agent notice of the intention of the Board to increase itl. Such notice shall be by personal service upon the owner or agent, or by leaving a copy of the written notice at has usual place of business or last place of residence, or by mailing said notice to the last known place of residence of said owner or agent, or by publication three times in a newspaper published in the City of Sanford, ~Florida, and shall state in said notice the time when the Board will be in session to act upon the proposed increase in assessed value which notice shall be made or given not less than ten days prior to the time of such hearing." "SECTION 124. Primary Elections shall be held on the first Tuesday after the first Nonday in November of each year for the nomination of a City Commissioner or City Commissioners, as the case may be, provided, however, should only the mumber of candidate~ qualify that are required to fill the position or positions of City Commissioner, such election shall not be held, and the said candidate or candidate~ shall be certified as the regular nominees to be voted upon in the regular election." "Regular municipal elections shall be held eac~ year on the first Tuesday after the first Nonday in December in each year for the election of a City Commission or City Commissioners as the case may be. Any matter ~aich, by the terms of this charter may be submitted to the electors ~f the City at any special election may be submitted and voted upon at a Regular Nunicipal . election." "Any l~erson who is a qualified elector in the City of Sanford, Florida and otherwise qualified may become a candidate for the office of City Commissioner upon filing with the City Clerk, twenty days before any primary election, a written notice of his or her intention to become such can-~ dadate, requesting that his or her name be printed upon the b~llot." "SECTION 48 Any b~nk in the City,authorized to do business in the State that will pay such rate of interest as the City Commission shall determine on daily b~lances of City f~uuds when such funds exceed Two Thousand ($B,OO0.00) Dollars and such rate of interest as the City Commission' shall determine on balances of time deposits of the City funds deposited for a period of three mohths or more, and give a surety bond in an amount not less than seventy-five per cent , nor more than one hundred per cent ,of the mno~nts on deposit in said bank o~ banks, such bond to be given with a recognized company as surety, or deposit to the credit of the City with the City ~nmmission or the Citv Auditor and Clerk. "SECTION 125 Every person over the age of twenty-one years, residing in the City of Sanford at the time of holding of any Nunicipal Election who shall have resided continuously in the State of Florida for one Year, ~ud in the City of Sanford for six months, shall be deemed a qualified elector and authorized to vote at any municipal election, provided such person has paid his poll tax in the County for the preceding year, ten days prior to the date of any such election, and is properly registered in the City registration books." and, BE IT FURTHER RESOLVEDZ, that any and all said proposed amendments adopted by the vote of the electorate shall become effective from and after the date of the canvass of the electiom returns and declaring of the result therof by the City Commission, and BE IT FURTHER RESOLVED, the City Commission having been advised through its legal de- partment that the charter of the City of Sargord, Florida cannot be lawfully amended by the vote of the electorate under the authority of Section 136 of Chapter 989?, Laws of Florida 1923, that should by the vote of the electorate any or all of the proposed amendments to the charter be adopted, the City Commission of the City of Sanford Florida, shall have enacted by the 1929 Session of the Legislature of the State of Florida a Special Act amending the present Charter of the City of Sanford Florida in accordance with the will of the electorate as expressed in the elction to be held on September 18th 1928, and ratifying, validating, con- firming and approving any and all municipal acts done and performed, under any amendments that may be adopted on September BE IT FURTHER RESOLVED, its passage and adoption.
