The City Commission of the City of Sanford, Florida. met in adjourned regular
session at the City Mall in the City of Sanford, Florida, at 7:30 o'clock P.M. December
26, 1945.

Meeting called to order by the Chairman.
Commissioner Bishop next introduced Resolution No. ?02,and after being read in full
by the Clerk, moved its passage and adoption.

A RESOLUTION OF THE CITY CO~MISSION OF THE CITY OF SANFORD, FLORIDA OFFERING
ON BEHALF OF THE CITY OF SANFOBD TO LEASE FROM THE UNITED STATES OF AMERICA
CERTAIN WATER W~ORKS'~.PROPERTY WITH OPTION TO PURCHASE THE SAME.
WHEREAS, by written lease dated September 4, 1944, the City of Sanford, Florida
leased from the United States of America therein referred to as the Government, certain
water works property in Seminole County, Florida, consisting of an addition of one
well equipped with a 350 G.P.M. pump, including a well house, a pump house and a 1000
GPM Booster pump, together with the necessary pipe and electrical lines to hook. said
facilities into existing wells and feed lines in theCity of Sanford, Seminole County, State of
Florida, more particularly described in that certain warranty deed from City of Sanford,
Florida, a municipal corporation created and existing under and by virtue of the laws
of the State of Florida,. to the United States of America, dated January 25,1943 and
recorded on September 15,1943 at 3:58 o'clock P.M. in Deed Book 108, page 198, Seminole

stalled in or located at the leased property on the date of said lease or thereafter
provided by the Government, for a term of one year from the 16th day of june 1943, with
the right to extend the marne at the option of the City of 5anford, Florida without
notice for successive periods of one year each; and,
WHEREAS, the City of Sanford, Florida has 'paid to the Government the sum of
$2,500.00 as rental for Said property from the 16'th day of June , 1943, and,
WHEREAS, the City Commission of the City of Sanford, Florida, deem that the
continued use of said water works facilities by the City will be for the best interests
of the City:
.~ NOW, THEREFORE,BE IT RESOLVED by the City Commission of the City of Sanford, Florida,.
that/~Oity of Sanford does hereby make an offer to lease the aforesaid property from the
Government for a period of four years for the sum of $?300.O0,1ess the aforesaid rental
of $2500.00 hertofore paid by the City of Sanford, Florida, said rental to be paid as
follows: $1200.00 upon execution of lease by the Government and the balance in three
equal ~unual payments of $1200.00, with interest on said annual rentals at 3% per annum fro
date of lease, said lease to contain an option to the City of Sanford, Florida, to
purchase, at any time during the term of said lease or at the termination thereof, all
of said property including the real estate described in the aforesaid deed of conveyance
from the City of Sanford to the Government for said sum of $?300.00, less the aforesaid
rental of $2500.00 heretofore paid by the City, rentals paid under the new lease to be
credited on the purchase price.
BE IT FURTHER RESOLVED that the Mayor of the City of Sanford submit the foregoing
offer to the Government and upon its acceptance the Mayor and City Clerk of the City are
au~horized to execute said lease on behalf of the City.
BE IT FURTHER RESOLVED that this resolution shall become effective immediately upon
its passage and adoption.

On motion of Commissioner Bishop, seconded by Commissioner Gut and carried, the City
Attorney arid Clerk were next authorized access to safety deposit box at Sanford Atlantic
National Bank for the purpose of storing Government bonds purch&sed by the Policemen's
Pension Fund and Flremen's Relief & Pension Fund.
.Application next received from E.C.Wetherington for permit to remove seven oak
trees from parkway in front of 1020 French Avenue for purpose of constructing driveway
into his place of business, and same was granted.
Commissioner Gut next moved that E.B.Randall Jr,. Master Electrician, D.C.Stafford,
JOurneyman Electrician, ~ud G.L. Duncan, Building Inspector be re-appointed ms the Board
of Examiners for the year 1946, in accordance with ordinance No. 274 governing electrl-

Thereupon after careful consideration and in view of no other p~ices having
been submitted, Commissioner Gut moved that the Clerk be authorized to purchase the
necessary piling and timbers for reconstructing the two piers and repairing the docks
from Pensacola Creosoting Company and Tampa Creosoted Lumber Products Company at a cost

Mr H J Lehman, Manager of the State Farmers' Market, next appeared and protested
against'the excessive water bills of the Market for the past three months.
The Clerk then explained to the Commission that there are several water consumers
at the State Market having separate meters installed in the market's water lines and
registering thru the master meter, and after deducting the total comsumption of water
of these small meters from the master meter's consumption, the State Market assumed the bal-
ance; stating that the meter reader and service man had tested all meters, including
the master meter and reported each registering correctly, and had also assisted Mr.
Lehman in trying to locate a possible water leak.
Thereupon after considerable discussion, the Clerk was authorized to install a
separate water line into the market property and connect the meters of all the other
water consumers thereto, so as to eliminate these services from registering thru the
Market's meter.
In response to request for legal opinion as to whether or not the City had
authority to impose a tax on utility services of the State, the City Attorney next
advised he had not had sufficent time.to examine the laws relating to such tax but
had been advised that all other cities had exempted the State from payment of the
utility service tax.
Thereupon the City Attorney was instructed to authorize the local utility
companies to accDpt payment of the State's utility bills without payment of the
tax.
Engineer Hagan next submitted plat of "Georgia Acres", for approval.
Thereupon after careful examination, COmmissioner Bishop moved that the Plat of
"Georgia Acres" be approved by the City.
Seconded by Commissioner Gut and carried.
Chief of Police Williams next reported that N.E.Jennings had been dismissed from
the military services and had requested to be re-employed as police patrolman.
Thereupon the Commission authorized the re-employment of N.E. Jennings as police

On motion duly carried, the Commission next authorized the employment of

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF ~SANFORD, FLORIDA
~ offering on behalf of said city to lease from the ,'~nited ~tates of America
THAT CERTAIN BUILDING IN THE CITY OF SANFORD, NOW USED BY THE UNITED SERVICE
ORGANIZATION, WITH OPTION TO PURCHASE THE SAME.
WHEREAS, by lease dated the 4th day of March 1943,'the City of Sanford, Florida
leased to the United States of America that certain lot, piece or parcel of land sit-
uate in the City of Sanford, County of Seminole, State of Florida and described as
follows, to-Wit:
BEGINNING on the north side of First Street in the City of Sanford, Florida ,
at a poimt 60 feet east of the southeast corner of Block 2, Tier 1, E.R.
Trafford's Map of the Town of Sanford, Florida, of record in Plat Book 1,
pages 56 to 64 e~ the public records of Seminole County, Florida, th~ence run North
135 feet; thence East 140 feet, thence South 135 feet, thence west 1~0 feet to
BEGINNING.
f~ a ter~ begi~Hi~g March 1st, 1943 and ending March 1st, 19Y3, subject to renewal in
accordance with the terms of said lease at and for the sum of One Dollar for the original
term and any renewal thereof; and,
WHEREAS, the United States of America erected upon the above described lot, piece
or parcel of land which has been used and is still being used by the United Service
Organization for the benefit of men in the military service of the United States, and
the City of Sanford desires to lease said building for public recreational purposes,
upon the discontinuance of its use by the United Service Organization and the City
Commissioners of said city deem it advisable, expedient and for the best interest of said
city to make an of£~r to the United States of America for the lease of said building
for public recreational purposes, with option to purchase the same:
NOW, THEREFORE BE IT RESOLVED by the City COmmission of the City of Sanford,
Florida, that said City of Sanford offer to lease the aforesaid bu~ilding from the United
States o f America for a period of five years for a rental of $5,500.00 payable as follows
$1,100.00 upon execution of lease therefor and the remainder of said rental to be paid in
four annual payments of $1,100.00 each with interest thereon at three per cent per annum
from the date of lease, possession of said building to be delivered to the City upon
discontinuance of its use by the United Service Organization, with the right and option
to the City of Sanford, Florida to purchase said building at any time during the term of
said lease or at its termination for said sum of $5,500.00 and interest as aforesaid,
rentals paid on said lease to be applied on the purchase price, the aforesaid lease
of March ~th, 1943 and the land embraced therein, and said building to be surrendered
to the City of Sanford, upon the exercise and consummation of said option to purchase
and conveyance to the City of Sanford of said property.
BE IT FURTHER RESOLVED that the Mayor~ of the City of Sanford submit the fore-
going offer to the Government and upon its acceptance the Mayor and City Clerk of
the City are authorized to execute said lease on behalf of the City.
