M 19 50 The City Commission of the City of Sanford, Florida , met in adjourned regular session in the City Hall in the City of Sanford, Florida, at 8:00 o'clock P.N. February 2, 1950, for the purpose of a Public Hearing to consider changes and amend- ments in certain districts of the Zoning Ordinance, and to consider adoptlng a Building Code Ordinance and any other business that may come before the meeting. Absent: Commissioner Randall Chase. Meeting called to order by the Chairman who directed the City }4anager to read the following legal notice of this hearing published in the Sanford Herald on January 18th and 25th, 1950. NOTICE OF PUBLIC HEARING OF PROPOSED A~END~ENTS AND CHANGES IN BOT.~DARIES OF CERTAIN DISTRICTS OF THE ZONING ORDINANCE 0F THE CITY OF SANFORD, FLORIDA. Notice is here~y given that a Public Hearing will be held at the office of the City Commission in the City Hall in the City of Sanford, Florida, at 8:00 o'clock P.M. February 2, 1950, %o consider the following changes and amendments in the Zoning Ordinance of the City of ~anford, Florida: (a) The area zoned in District R-1-A ( One Single Family) bounded on the North by 24th. Street, East by Alley between Oak Avenue and Park Avenue, south by 25th. Street, and West by French Avenue, is proposed to be changed to R-1 ( One Single Family) District. (b) The area Zoned in District R-1-A ( One Single Family) bounded on the North by 20th Street, East by the east property line of the property abutting on the east side of Oak Avenue, South by 24th. Street, West by French Avenue, is proposed to be changed to R-1 ( One Single Family) District. in interest and citizens shall have an opportunity to be heard the City Commission of the City of 5anford, Florida, this l?th day All parties at said hearing. The City Manager next read an excerpt from the minutes of meeting of Zoning Board of Adjustment recommending that Franklin Terrace be re-zoned to R-1 and that Highland Park be zoned R-1-A with a modification permitting 1000 equate feet for first floor area to be computed to include oar port. The Chairman then announced that the Commismion would be glad to hear from anY interested parties objecting to, or , in favor of re-zoning the area described in paragraph (b) of the foregoing notice ( Highland Park Subdlvlsloni to R-1-A ~odlfled, as recommended by the Zoning Board of Adjustment. Mr and Mrs. Paul J Chesterson, residents of Highland ~ark Subdivision, next voiced their objections to the proposed change, stating tha~ they purchased their home in Hlghland Park because of it belng located in a restricted area under the MINUTES Fl~rida Februar~ 2 at ~ P M 50 City Commission, Sanford, _ , ................................................................... 19 to the construction of dwellings in that area similar to the type Phillips Industries are constructing in Banford, but did object to other types of small dwellings that could be erected under the proposed change. Mr. Forrest Gatchell, resident of Highland-Park, next concurred in the objections submitted by Mr. and Mrs Chesterson and advised of property owners who already have plane to construct two dwellings in that area at a cost that will exceed $20,000.00 each. Mr. Harold Davis and Mr. Anderson, residents of Highland Park also voiced their objections to the proposed change. Mr. Welborn Phillips Jr, representative of Phillips Industries, next outlined their proposal to erect several dwellings in Highland Park at a cost of from $4000.00 to $12,000.00 each. Mr Edward Higgins, Manager of Semir~le County Chamber of Commerce next pointed out the advantages of the proposed change in order to construct dwellings within the price range the average citizen can afford to build. He stated that the need for additional homes in Sanford has been a great problem of the Chamber of Commerce for several months, and recommended that the City Commission authorize the Zoning Board of Adjustment to grant variances to Phillips Industries for the conetructin~ of the proposed dwellings in Highland Park. Thereupon those who had objected to the proceed change, endorsed the recommendations of Hr. Hlgglns and stated that they would not object to granting the variances. Upon advice of the City Attorney, the Chairman then advised that the Commieslon did not have authotiry to vest such power in the Board of Adjustment. Hr. A.W. Lee, property owner in Highland Park, next spoke in favor of the change. There being no further protest registered as to the proposed re-z0$~ng of Highland Par~ the Chairman then announced that the Commission would next consider re-zoning the area described in paragraph (a) of the foregoing notice from R-1-A to R-l, which includes Franklin Terrace, Beck's Addition and a part of Pine Heights. Nr R F Noule, resident of Franklin Terrace, next submitted a petition signed by the following property owners in the aforesaid area objecting to the proposed change: R F Moule Raymond M Ball J C Higgins Gertle A Wilson Nrs L J Gourley J D Cordell Alfred W H Stanley G C Uti Sr. P T Meeks B R Beck Jae. D MacNelll J N Stinecipher Harry Lee. Mr. J M Stineclpher and Mrs Jas. D.McNeill also voiced their objections to the proposed change but stated that they would withdraw their objections if the City would adopted the Bouthern Standard Building Code aa the official code for Sanford so as not to permit any sub-standard dwellings to be constructed within that area. Thereupon the Chairman advised them that the ordinance adopting the Bouthern Btandard Building Code would be placed on its first reading at this meeting. Mr. A.W. Lee resident of Franklin Terrace, next spoke in favor of the change. There being no further protest registered, the Commission adjourned the Public Hearing and reconvened to consider the adoption of a new Bullding Code and other matters that may come before the Board at this time. Commissioner Stemmer next introduced Ordinance No. 465, entitled: sO MINUTES City Commission, Sanford, Florida,... F,~BR~R¥ 2 at 8.. P 19 50 ~-40750 and same was placed on its first reading. In accordance with Ordinance No. 28?, and on motion of Commissioner Krider, seconded by Commissioner Stemper and carried, the Commission next appointed M.G.Hodges, Master Plumber John E.Baker, Journeyman Plumber and John M. Gillon, Plumbing Board for the year 1950. In accordance with ordinance No. 2?4, and on motion of Inspector, as the Plumbing Commissioner Dy son , seconded by Commissioner Krlder and carried, the Commission next appointed D.C.Stafford, Master Electrician, D.Jobe, Journeyman Electrician, and John M Glllon, Building Inspector, as the Board of Electrical Examiners for the year 1950. Consideration next given to the following proposal of Ozier-Weller Inc. of Champaign, Ill. to purchase certain property from the City for the purpose of construction of at least 50 dwellings thereon, each with a floor area of approximately 6?2 square feet, exclusive of porches and car ports, to sell at a price range of $6,OOO.00 to $6,500.00: Option for 60 days to purchase 146 lots in Bel Air Subdivision and 36 lots in San Lanta Second Section at a price of one-third less than the list sale price established by the City ; to purchase at least fifty lots within %he sixty day period and renew option for six months on balance of lots; and upon commencement of building program and purchase of 50 additional lots during said six months period, renew option for additional six months to purchase the remaining lots. Thereupon after careful consideration, Commissioner Krider moved that the City grant Ozier-Weller, Inc. an option to purchase the aforesaid property at a price and terms stipulated in the foregoing proposal and that the City Attorney prepare the option agreement for consideration at the next regular meeting. Seconded by Commissioner Dyson and carried. The Commission then reconvened the Public Hearing to give further consideration to the proposed changes in the Zoning Ordinance, Thereupon after considerable discussion, Commissioner Krider moved that the Zoning Ordinance be amended so as to transfer the property described in paragraph (a) of the fore- goTng notice from District R-1-A ( One single family) to District R-1 ( One Single Family.) Seconded by Co~missioner Dyson and carried. Commissioner Stemper next moved that the proposal to re-zone the property described in paragraph (b) of the foregoing notice from District R-1-A to Distrlc~ R-1 be declined.
