The City Commission of the City of Banford, Florida, met in regular session at the 0ity Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. January 8, 1951. Present: Commissioner F. A. The first order of business wac a Public Hearing to consider rezoning certain district of the Zoning Ordinance in accordance with the following legal notice published in the Sanford Her- ald on December 22 and 29, 1950: NOTICE OF PUBLIC HEARING ON PROPOSED CHANG~$AND AMENDMENTs IN OERTAIN DISTRIOT OF THE ZONING OR- DINANCE OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at the office of the City Com- mission in the Oity Hall in the City of Banford, Florida, at 8:00 o'clock P. M. January 8, 1951, to consider the following changes and amendments to the Zoning Ordinance of the City of Sanford, Florida~ The property Zoned in District R-1 (One Single Family) located on south side of 25th Street between Pig 'N Whistle Sandwich Shop and McReynolds_Drug Btore Build- ings~ is proposed to be chamged to C 1 (Commercial Re- tail) District. Said property being more legally des- cribed as the north 100 feet of East one-half of Block 3, Spurling Heights; the north 100 feet of unplatted part of Section 1, Township 20 S., Range 30E; and Lots 1 and 3 of Woodruff's Subdivision. All parties in interest a nd citizens shall have an oooortunity to be heard at said hearing. The O~l~man then announced that the Commission would be glad to hear from any interested parties objecting to re-zoning the property described in the foregoing notiu$. Thereupon a group of property owners residing within the vicinity of the property pro- posed to be re-zoned, with Mac~ Cleveland Jr., as spokesman, submitted the following petition signed by 50 of the property owners within the aforesaid vicinity protesting the proposed zoning of said property from Residential to Commercial-Retail: PETITION January 8, 1951. MINUTES City Commission, Sanford, Florida,.~.~!.ar~ 8 .a~_..8_.~.~...~.~ ................. 19 51 H40750 187 area of Banford, Florida, some of whom have lived here for many years and hope to continue living here for many more years, respectfully submit ~hia. petition of protest in opposition to the proposed re-zoning of the Bouth side of Geneva Avenue or 25th Street from the Pig 'N Whistle to McReynold's Drug store from residential to commercial retail, for the following reasons: 1. We feel that by re-zoning in such a piece meal method as proposed, would result in eliminating any desire for the ~rther development of the property in question for houses on those lots on which businesses might not be esta- blished, and those unoccupied lots would remain vacant for an unknown du- ration, and in effect, nothing of a real progressive nature would be achieved, and deprive: our neighborhood of future homes. 2. Once this property is re-zoned it would not be possible to restrict cer- tain businesses which might become nuisances and objectionable to the under- signed residents even though the business might be lawfully established under the zoning ordinance of Banford, Florida. An illustration of a current nuis- ance is the out door Juke box at the Pig 'N Whistle which is almost a nightly nuisance to the residents living nearby and those living several blocks away. We want to avoid any similar arrangement in the future. This is not to be construed as opposition to the Pig 'N Whistle itself, but only to the loud playing of their Juke box at night. 3. We are further opposed, to the rezoning of this property because of siz- able investments many of us have in our individual properties, and because the rezoning might bring about a decrease in the value of our property and possible result in a financial lose in She event we were forced to sell due to the nature and intolerableness of some businesses which might be established on the property in question. We the undersigned respectfully petition the City Commission of Banford~ Florida, to deny the application for the re-zoning of the south side of Geneva Avenue or 25th Btreet from the Pig 'N Whistle to McReynold'$ Drug Store. The Chairman next announced that the Commission would be glad to hear from any intereste~ parties in favor of the proposed re-zoning, but no one present spoke in favor of it. Thereupon after careful consideration and in view of the foregoing petition of protest, Commissioner Btemper moved, that the proposal to re-zone the property on south side of 25th Btreet between Park Avenue and Banford Avenue be declined. Beconded by Commissioner Martins and carried. The Commission then adjourned the Public Hearing and proceeded to handle the business of the regular meeting. Monthly reports of Btreets, Sanitation, Health, Water, Police, Fire Airport and Library Departments for month of December 1950, submitted and examined. Financial statement and statement of revenues and expenditures for month of December 1950, submitted and ex~mined. Bank statements in all accounts for month of December 1950, properly reconciled, sub- mitted and examined. On motion of Commissioner Btemper. seconded by Commissioner Martins and carried, cur- rent invoices and payrolls for month of December 1950, as evidenced by Voucher Nos. 5560 thru 5703, were next approved subject to approval of the Finance Committee. Mr. B. A. Allen, owner of the Yellow Cab Company, next appeared with reference to the rates for taxi-cab fares provided in City Ordinance No. $26, with maximum fare of 35~ per pas- senger transported to or from any point north of 25th Btreet, 505 south of 25th Btreet, and 50~ to or from any point between 1:00 o'clock A. M. and 6:00 o'clock A. M. He advised that he was unable to operate his taxi-cabs at a profit under the existing rates and requested the Oommisslon(to revise the zones for taxi-cab fares and to establish east and west zones, in order that the taxi-cab operators may increase their rates for transporting passengers to and from certain points in the 0ity. Seconded by Commissioner Martina and carried by the following vote of the Commission: Commissioner Dyson Aye " Ivey Aye " Martins Aye " Stemper Aye Said Resolution No. 788, being in words and figures as follows: A RESOLUTION IN RECOGNITION OF THE BERVICE OF ANDBEW CARRAWAY AB MAYOR OF THE CITY OF BANFORD, FLORIDA, DURING THE YEARS 194-1950. WHEREAS, COMMISSIONER ANDREW CARRAWAY was elected by the City Commission in the year 1949 and again in 1950 to serve as Mayor of the City of Sanford, Florida, and during said years served faithfully and continusously in the capacity of Mayor, work- ing at all times to achieve what he believed to be for the beet interest and welfare of the community, and giving unstintlngly of his time in the performance of hie duties as Mayor, frequently devoting his time to civic affairs at the sacrifice of time from his personal business affairs, and WHEREAS, during his service as Mayo~ Commissioner Carraway sought always to con- duct himself in accordance with the responsibility and dignity of his office, endeavor- ing both in his conduct of Commission meetings and in his associations with the public elsewhere to exercise courtesy, impartiality and patience, and WHEREAS, it is aporoprlate that such service and such conduct be given recog- nition b~ the remainder of this Commission, both for themselves and the citizens of the community. NOW, THEREFORE, BE IT RESOLVED by the remaining members of the City Commission of the City of 8anford, Florida, that the City and such remaining CommiselGuers as the City Commission do hereby extend their sincere appreciation to COMMISSIONER ANDERW CAiqRAWAY for his service as Mayor of the City during the years 1949 and 1950, and do hereby heartily commend him upon the excellence of his conduct in the duties of that office. January 8 at 8 P.M. ~ 51 City Commission, Sanford, riorma, .......................................................................... ~ Thereupon after comparison of the prices submitted, the quality and performance of pumps bid upon, and the additional cost of installation, Commissioner Carraway moved the acceptance ~ of the bid of Fairbanks, Morse & Company to furnish two pumps at price of $1,268.21, as being the best bid for the 0ity. Seconded by Commissioner Btemper and carried. Apollcation next received from George Thruston for permit to operate a taxi-cab in con- nection with tours for guest of M~yfair Inn to points outside of the City, and on motion of Commissioner OarrGway, seconded by Commissioner Stemper and carried, same was approve. On motion of Commissi~er Btempm~, seconded by 0ommissioner Oarraway and carried, the City Manager was next authorized to re-open the swimming pool on February 15, if the weather is --' favorable. The City Manager next reported that the 48" segment block sewer crossing under Seminole Boulevard between Park and Hood Avenues had caved in and that it would be necessary to replace that portion of it with $8# re-enforced concrete pipe which would cost $?10.00, the total estl- ~ mated cost installed being $1,500.00, and on motion of Commissioner Stemper, seconded by Com- missioner Martins and carried, same was authorized. Consideration next given to request of firemen for increase in salaries and on motion of Commissioner Carraway, seconded by Commissioner Btemper and carried, same was tabled because of recent 5% increase granted in all salaries. Further consideration next given to condition of the citrus grove at airport under lease to Fellowship Foundation, and on moti~ of Commissioner Btemper, seconded by Commissioner Martins and carried, the City Manager was directed to notify the lessee to fertilize and culti- _, rate the grove immediately in accordance wi~ terms and conditions of the lease agreement. Commissioner Martina next moved that a letter of commendation be sent to the Commissioners of Banford Housing Authority, and especially to Ralph Cowan upon the excellent performance of the duties o~ Chairman, in acquisition of the site and expediting every phase of the project so as to commence construction of the first 125 units ahead of schedule, and the securing approval of 125 additional units for Banford. Seconded by Commissioner Carraway and carried. The Clerk next advised that the Board of Bond Trustees had not complied with the provisions of Resolution No. 780. passed and adopted by the City Commission on August 28, 1950, directing the transfer from the Binking Fund to the Public Project Fund of all funds on hand received from the sale of real estate, which were re-allocated for capital improvements by said Resolution. He stated that on August 29, a check was drawn on the Board of Bond Trustees Fund to transfer sa~ funds back to the Public Projects Fund, which was signed by the Nayor, but that the Board of Bond Trustees had declined to sign i~. Thereupon after considerable discussion, the Nayor and City Attorney were authorized to confer with Nr. W. A Lef?ler, Chairman of the Board of Bond Trustees with reference t o im- mediate transfer of the aforesaid funds because of City having made obligations for capital improvements.
