Willl~m* Meeting called to order by the Chairman. .requested Attorney Fred R.Wilson next appeared on behalf of S.A.Allen/the Commission to defer action on the request for transfer of bus franchise to Viola A Allen, which was authorized at meeting of March 26, advising of negotiations pending with Hartzell Brothers of Fort Myers to enter into the business with Mr. Allen as a partnership or corporation to operate the bus line. He then introduced Mr R.R.Hartsell and requested approval of application of transfer of franchise to Mr Allen and Hartsell brothers and also waiver of the requirements of 60 days written notice of intent of transfer. Thereupon Commissioner Carraway moved that the City Attorney be instructed to withhold drafting the ordinance to transfer the bus franchise to Viola A Allen. Seconded by Commissioner Stemper and carried. Commissioner Ivey then moved the approval of application for transfer of franchise to S.A.Allen and Hartsell brothers, or their designee. Seconded ~y Commissioner Carraway and carried. Commissioner Stemper next moved the walvure of 60 days written notice of intent of transfer of franchise. Seconded by Commissioner Martina and carried. Mr L C Tillis next appeared on behalf of Mrs Frances Mathews, widow of Wilmer Mathews, City employee who died on April l?, and expressed their appreciation for any financial consideration that may be given the family by the City. Thereupon Commissioner Carraway moved that Mr Mathew's survivors be paid $500.00 from the fund set up for self-insurer of employees to supplement the $500.00 that will be paid them under the City sponsored group life insurance policy with Prudential Insurance Company. Seconded by Commissioner Martina and carried. Mr. Lowell Ozier of Ozier-Weller Homes Inc. next appeared and reported satisfactory progress being made toward securing FHA approval of the apartment building proposed to be constructed on Lots 20 thru 34 of Lake View Park, of which they have an option for 120 days to purchase from the City. Mr Omier next requested the property in Bel-Air Subdivision be rezoned from R-1 to R-1-X so as to permit construction of small 2-bed room dwellings with 600 square feet of living space and 100 square feet of porch area, which can be sold for around $5,300.00, stating that they had secured FHA approval on constructing the small dwellings in said area. ' 23:6 MINUTES City Commission, Sanford, Florida, ~p~il ~3 ~ ~:3~ P M 19 51 Thereupon after careful review of the Zoning Nap and the type of dwellings already constructed in that area, Commissioner Ivey moved that a Public Hearing be held, the date of which to be announced later, to consider rezoning the East one-half of Block 5 and all of Block 6 of Bel-Air Subdivision from R-1 to R-1-X. Seconded by Commissioner Stemper and carried. Mr Fred Maynard next appeared with reference to order received from the City on April 20 to stop work on the construction of a silver diner at southwest corner of French Ave and Eighteenth Street immediately south of Seminole High School, for which he secured a building permit from the City on April 3. The City Manager then reported that the diner conformed to the requirements of the Building Code and that the property is zoned for commercial use but the stop-work order was served because the school officials and Parent Teachers' Association had registered a protest against it being located on said corner because of being detrimental to the school, claiming that the City Commission had verbally agreed to limit commercial enterprises on the site to those not obJectional to the school at the time it was rezoned for commercial use. Mr ~ynard next stated that it had placed him in a precarious position because he had secured a permit from the City and purchased the diner at a cost of $4,500.00 and that it would also deprive him the benefit of the use of the property. City Attorney Shinholser then advised that if the building conformed to the zoning regulations and the building code, the City had no legal Justification to stop construction. Mr and Mrs. W.W.Tyre, and Rupert Strlckland, members of the Parent Teachers Association, next voiced their objections to the diner being operated at said location for reasons that it would establish a hang-out place for students; that they would come in contact with the transient trade and especially truck drivers; that they would eat their lu_~ches there in- stead of the school lunch room; and the noise that will be created from heavy traffic stopping ther there, which would detract the students'attention from school work. After further discuession, Commissioner Stemper moved that the School Board be given an opportunity to purchase the aforesaid property so that Mr. Maynard would have an oppor- tunity to get out from under his obligations, and same died for lack of a second. Commissioner Martina then moved that the City appoint a committee who will attempt to bring about a meeting with the School Board and Mr. Maynard, at which meeting the object will be for the school officials, Mr Maynard and the representatives of the City to work out an amicable solution to the problem presented. Seconded by Commissioner Stemper and carried. The Mayor then appointed Commissioner Nartina and the City Manager to arrange for a meeting with the school officials and Mr Maynard, and to represent the City at such meeting. Mr John Krider, representative of New York Giants Baseball Club, next appeared before the Board relative to being without facilities for their farm clubs training program due to the airport being reactivated by the Navy. He advised that they were making tentative plans to remain in Sanford if satisfactory arrangements could be worked out for providing such facilities, but if not, they would have to move their training program elsewhere, including the ~fair Inn operations. Mr Krider then requested the City to construct four practice baseball diamonds on the City owned property north and east of the new municipal stadium for their training program, which he estimated would cost approximately $15,000.00 stating that two other cities had offered to provide them with both housing and field MINUTES City Commission, Sanford, Florida, ............ .-~R~?~l~3....~.......Z...'.3.0._..~....~._19 51 H-40750 237 baseball diamonds requested Dy Mr. Krlder. 'l'nereupon after a lengthy discussion and careful review of the City's financial position and the commitments for completing the Sanford Memorial Stadium, Commissioner Martina offered the following motion which was seconded by Commissioner Carraway and carried: I move that in view cf present fiscal conditions of the City budget and in our anxiety to maintain the benefits and continued operation of the Mayfair Inn and the training operations of the New York Giants Farm System in Sanford for an additional period of at least five years commencing with January 1952, that the following pro- posal for contract be forwarded in writing by the City Manager to the Directors of the New York Giants: 1. The City of Sanford agress to pay for 5~ of the construction e~ four additional training baseball fields, up to a maximum, cost of $7,500.00 to the City of Sanford on the property north and east of the Sanford Memorial Stadium. 2. The New York Giants Farm System shall be given a five year lease on these additional facilities and the Sanford Municipal Stadium, without rental fee and shall at the end of this period have the option to renew this lease on the same basis. 3. The New York Giants Farm System shall have the same rental period of five years with five year option on the Sanford Memorial Stadium at $2,000.00 as formerly agreed and shall maintain all structures, fixtures and fields in satisfactory condition, except the wooden grandstand structure of the Municipal Field. 4. The New York Giants Farm System, for the duration of leases shall operate the Sanford Baseball Club in the Florida State League. 5- The City of Sanford, shall effective January 1953, contribute $2,500.00 in cash annually toward the maintenance and upkeep of this property for the duration of the lease. 6. The proposed lease on the Municipal Athletic Field and Airport facilities be withdrawn. Pursuant to recommendations of the Board of Trustees of the Police Pension Fund, and on motion of Commissioner Stemper, seconded by Commissioner Carraway and carried, the Commission next authorized the publication of notice of intent to apply for passage of special legislation at the 1951 session of Legislature for an additional amendment to the Police Pension Fund so as to provide for contributions to said fund by the City; change the amount of monthly payments prescribed in Section 9; provide benefits for qualified widows of deceased fund members; prescribe the period of contribution from members entitling them to benefits; and prescribe rights of members called to active military service and of members permanently physically or mentally disabled to perform duties as members of the Police Department. On motion of Commissioner Carraway, seconded by Commissioner Stemper and carried, t~e Mayor was next authorized to address a letter to our State Representatives, opposing the passage of the proposed bill before the 1951 Session of Legislature, which would place a limitation on the mount of license tax that municipalities can impose on insurance companies and their representatives. As a result of request of Dr. H.K.Rlng, Chiropractor, for a private parking space at corner of Park Ave. and First St., Commissioner Stemper moved that a tabulation be made of all reserved parking spaced for the purpose of eliminating those not Justifiable. Seconded by Commissioner Carraway and carried. On motion of Commissioner Carraway, seconded by Commissioner Ivey and carried, the Commission next authorized a contribution in amount of $100.00 to the Naval Affairs Committee of Chamber of Commerce for the purpose of acquiring recreation equipment for their program for entertaining Naval Personnel. The City Manager next reported that the Civil Air Patrol had obtained use of the land between Country Club Road ,Railroad and Twentieth Street for a landing field for 238 MINUTES City Commission, Sanford, Florida,....AP~i~ Thereupon Commissioner Stemper moved that the City pay the aforesaid inspection fee so as to provide a landing field for private and commercial planes. Seconded by Commissioner Carraway and carried. Commissioner Stemper next introduced Ordinance No. 487, entitled: AN ORDINANCE OF THE CITY OF SANFORD,FLORIDA, VACATING, ABANDONING, AND CLOSING A CERTAIN STREET AND PAP~WAY EXTENDING OFF EDITHA CIRCLE PARTIALLY BOUNDED BY LOTS 22, 23 and 32 IN HIGHLAND PARK SUBDIVISION, SANFORD FLORIDA. and same was placed on its first reading and read in full. On recommendation of the City ~nager and on motion of Commissioner Stemper, seconded by Commissioner Martina and carried, the salary of Mrs Rosa Rotunda, book- keeper, was authorized increased from $193.00 to $205.00 per month. On motion of Commissioner Stemper, seconded by Commissioner Carraway and carried, C D Culberhouse was granted leave of absence as utility man at the airport during the present period of National Emergency. On motion of Commissioner Carraway, seconded by Commissioner Ivey and carried, the Commission next authorized payment of $2,500.00 to the Seminole County Chamber of Commerce to defray cost of special advertising during fiscal year, which was appro- priated in currentyear's budget for such purpose. On recommendation of the Tax Assessor, and on motion duly carried,the Commission next authorized the taxes against the W 1/2 of Lots 27 and 28 of Block G, Chappell's subdivision, adjusted from $45.00 to 31.5© per year for years 1937, 1939,1940 and 1941. On motion of Commissioner Martina , seconded by Commissioner Ivey and carried, a quit claim deed from City to John L Kadet and wife for Lots ll and 12 of Block 5, Mayfair, was next authorized. The City having at one time acquired title to this property thru foreclosure of tax liens. There being no further business the meeting then adjourned until 8:00 o'clock P.M. April 3©, 1951.
