The City Commission met in regular session at the City Hall

Mayor Dyson convened Public Hearing to consider changing
following particulars.

Ivey moved, Commissioner Bitting seconded and motion carried to instruct City Attorney to draw
appropriate ordinance to change the zoning of S 400 ft., 'of Lot 5 A. V. French's Addition from
R-1 to C-2.
Mayor Dyson declared the Public Hearing adjourned and convened the meeting as the
regular City Commission meeting.
B. C. Steele apoeared to protest a fine assessed by the Municipal Court in connection
with a recent automobile accident in which he was involved. After discussion action was de-
ferred pending further study and recommendation by Judge Sharon.
Messrs Mervyn and Lowell Ozier presented the following letter concerning lots in San
Lanta and Bel Air:

described as the South 400 feet of Lot 5 of A. V. French's
Subdivision, lacated and abutting on the West side of
French Avenue between Sanford State Farmers Market and the
Seminole County High School property, is proposed to be
changed to C-2 (Commercial-Industrial) District.

Although our option agreement specifies that sewer mains will be installed
by the City in the blocks where we build houses, it is definitely not our
intention to cause an undue financial expense to the City by requesting
sewer installations where they are not yet prepared to build them. On the
other hand, we do not wish to build houses or ourchase lots which will not
be served by City sewers.
For these reasons, and in view of the probability that the City will make
some decisions regarding sewer main extensions during the next few months,
we propose that you grant a 120 day extension of our option to purchase the
next 50 lots, except that we propose to proceed immediately with the pur-
chase of the ten lots in Block 20 of San Lents referred to above, namely
#1 thru #5 and #13 thru #17, all inclusive, Second Sect!on. It would be
mutually agreed that such option extension would in no way affect the other
terms of the present option agreement.

and on motion by Commissioner Ivey, seconded by Commissioner Btemper, Ozier-Weller Homes, Inc.,
was authorized to purchase only ten (10) Lots at present aa outlined in above letter and die-
position on the remaining forty (40) was deferred for 120 days pending further study by the
City and Ozier-Weller Homes, Inc. Mr. Ozier also advised the Commission that the Apartment
house project for Lakeview Park was not progressing satisfactorily but they did not wish to
release the City from its option at this time.
Mr. Raymond Weinman apoeared and requested that something be done by the City to im-
prove 24th Street west of French Avenue as he has his home on that street and is planning to
build additional dwellings; he was advised the City can grade the street.
Mr. Vollie Williams Br., next apoeared and advised the Commission he had procured
some brick from the Florida State Road Department for paving alley between Magnolia Avenue
and Park Avenue and 2nd and 3rd Streets, and was advised that the City forces could lay the
brick in the alley as soon as it was available.
Commissioner Stamper introduced Ordinance No. $91 entitled:
AN ORDINANCE AMENDING SECTION 15 (A) OF ORDINANCE NO 300 OF
THE CITY OF BANFORD, FLORIDA, PASSED AND ADOPTED SEPTEMBER
23, 1940, WHICH PRESCRIBES PROHIBITIONS AND REGULATIONS CON-
CERNING THE SALE OF MILK AND MILK PRODUCTS IN THE CITY OF
BANFORD, FLORIDA, BY PERMITTING HOTEL, SODA FOUNTAINS, AND
SIMILAR ESTABLISHMENTB TO SERVE MILK FROM MECHANICAL REFRIG-
ERATOR DISPENSORS MEETING THE REQUIREMENTS HEREIN SPECIFIED~
REPEALING ORDINANCE NO. ~90 AND OTHER ORDINANCES OR SECTIONS
OF ORDINANCES IN CONFLICT HEREIN.
and same was placed on its first reading and read in full.
B. A. Allen next introduced A. D. Hartsell who is associated with him in ownership
with the City Bus Company and requested an extension of the ordinance permitting him to operate
on and over the streets of Sanford. Present Ordinance has 2~ years to run. Action was deferred
pending investigation by the City Manager.
City Attorney next discussed phases of the Sanford Utility Service Tax, and advised
that tl~ Federal Statute exempt U. B. Government and its Agencies from paying the tax; the
Utility Tax being construed as a tax on the purchaser.
On motion by Commissioner Stemper, seconded by Commissioner Bitting, and motion carried,
Mr. E. H. Johnson was authorized to attend the Na~onal Association of Sanitarians Conference in
Miami; City to bear expenses up to 875.00
City Manager was irs tructed to send out bid forms for purchase of annual basis of ~
fleet tires.
On motion by Commissioner Btemper, seconded by Commissioner Bitting, motion carried
vouchers from 6512 to 6639 were approved subject to final approval by Finance Commissioner.
On motion by Commissioner Ivey, seconded by Commissioner Bitting, and motion carried,

perimeter streets of Castle Brewer Court, part of which to be their proportionate share and bal-
ance to be a loan to the City, payable out of City's proportion of shelter ~ents, interest to ac-
crue against City at same rate as required of BHA. City to put up balance of money to complete
paving Job, total estimate to date being $36,662.00. Motion duly carried".
Minutes of meeting of June 25 were approved after motion by Commissioner Stemper and
Seconded by Commissioner Ivey, subject to insertion of the report by the Committee appointed to
aselet~the Commission in the appointment of a Commissioner to succeed Commissioner Mart ina.
