N. October 22, 1951: Present: Commissioner F. A. Dyson, Mayor " W. V. Bitting " Andrew Carraway " John Ivey " W.H. Stemoer City Attorney A. Edwin Bhinholser City Manager Clifford McKibbin, Jr., Chief of Police R. G. Williams Absent: City Clerk H. N. Bayer Meeting called to order by the Chairman, who appointed City Manager Clifford McKibbin to act as Secretary for the meeting. A group from West First Street with Rev. Rushton as spokesman complained about the excessive speeding in the vicinity of Poplar Avenue. After considerable discussion, the Chief of Police was requested if possible to have a man spend more time on 1st Street and the procurement of a new police car to replace on having insufficient speed was authorized. On motion by Commissioner Carraway, seconded by Commissioner Stemper the application of Ernest Bkulley for a permit to operate one Taxi-cab was approved. Karlyle Housholder and Jack Hall, representing the Chamber of Commerce next recommended that a small building for use of the Banford Tourist Club to cost from three to f ire thousand dollars be built under auspices of the City ami interested citizens and Civic Groups. After considerable discussion Commls~oner Carraway moved, Commissioner Stemper seconded and motion carried, that the City Manager contact Mr. Moughton and request that plans and specifications be drawn for a concrete block building 26 x h0 feet and a preliminary sketch be presented to the Commission. No action taken. by After considerable discussion of the report/City Msnager and Chief of Police of the W. 13th Street Traffic problem, Commissioner Carraway moved, Commissioner Bitting seconded and motion carried, that a traffic light be installed at 13th Street and Olive Avenue. On motion by Commissioner Carraway, seconded by CommissiomrStemper the following option was authorized to be executed by the Mayor and City Clerk. (Option later rejected by Southern Bell Telephone and Telegraph Company.) Commissioner Bitting next introduced Resolution No. 797, and after being read in full moved its passage and adoption. Seconded by Commissioner Carraway and carried by the Commissioner Dyson Aye " Bitting Aye " Carraway Aye " Ivey Aye " Stemper Aye Said Resolution No. 797 entitled: following vote of the Commission: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, RESCINDING RESOLUTION NO. 680, ADOPTED OCTOBER 19~, INSOFAR AS SAME RELATES TO LOTS ONE TO NINE, INCLU~' SIVE, OF BLOCK ELEVEN, OF TIER EIGHT, OF E. R. TRAFFORD'B MAP OF SANFORD, FLORIDA, AND VACATING TP~ DEDICATION OF SUCH PROPERTY MADE BY SAID RESOLUTION: AND REQUESTING THE COUNTY COMMISSIONERS OF SEMINOLE COUNTY, FLORIDA, TO RE - VOKE THEIR DEDICATION OF SUCH PROPERTY FOR A PUBLIC PARK AND TO OFFER SAID PROPERTY FOR SALE, AS A WHOLE OR IN PARTS. WHEREAS, by Resolution No. 680, adopted October 9, 195h, the City Commissioners of the City of Sanford, Florida, reGuested the Board of Co~iMtv ~mmt~t~ov~ ~e ~-~. m .... ~.. 3O4 H407~0 MINUTES ~ October 22 at 8 P M 1~ 51 Cify Commission, Sanford, Flor.--, ................. pose, and WHEREAS, the in the minutes of, puroose, and to said Board. of County Commissioners, by resolution adopted st, and set forth their meeting of October J, 1944, did dedlcete the said property for said WHEREAS, it appears that no expenditures for public improvements have been made oursuant such dedication and that no acceptance of dedication has been made by public use, and that it for the best interests of the public that the purpose for which said dedication was made be abandoned and the dedication vacated, and that such property be offered for sale, and said Board of County Commis~oners have indicated a desire to offer said property for sale, and it is appro- priate that the aforesaid dedication be revoked prior to any' sale of said. property by said Board of County Commis~,ioners, AND, WHEREAS, the City of Sanford, Florida., is a prospective purchaser of said land or a portion thereof and desires that said dedication be revoked by said Board of County Commissioners, and desires further to vacate its own dedication of said property and to concur with said Board of County Commissioners in ~heir vacation of the same, NOW, THEREFORE, BE IT RESOLVED, by the City Commission of the City of Sanford, Florida, that Resolution No. 680, adopted October 9, 1944, by the City CommisSion of the City of Sanford, Florida, be and the same is hereby rescinded insofar as the same apoliee to the property situate in Seminole County, Florida, described as follows: Lots l, 2, 3, h, 5, 6, 7, 8 and 9 of Block Il, of Tier 8, Of E. R. Trafford's Map of Sanfor~., Florida, as recorded in Plat Bookl~ Pages F56-6h, of the Public Records of Seminole ounty, lorida, and that the dedication of said property for use as a public park to be known as "Hynes Memorial Park", as provided in said resolution, be and the same is hereby revoked, vacated, and rescinded. BE IT FURTHER RESOLVED, That the Board of County Commissioners of Seminole County, Florida, be and they ere hereby recuested to vacate and revoke their dedication of the above described property for the purpose aforesaid as appears by resolution adopted by said Board of County Commissioners October .3, 1945, and that the City Commission of the City of Sanford, Florida, does hereby concur in and agree to the vacation and revocation of such dedication by said Board of County Commis~oners, and BE IT FURTHER RESOLVED, That said Board of County Commissioners are .hereby requested, after vacation by them of their dedicatio~n as aforesaid, to offer said property for sale as a whole or in such parts as to them shall appear desirable. BE IT FURTHER RESOLVED, That a certified copy of this Resolution be filed with the Clerk of the Board of County Commissioners of Seminole County, Florida, and That this Resolution shal~ become effective immediately upon its BE IT FURTHER BESOLVED, passage and adootion. Motion carried. On motion of Commissioner Carraway, seconded by Commissioner Btemper the Commis~on ap- proved application of R. T. Hunt, 801 E. 2nd Btreet to remove two trees from the park-way which he desires to ~prove with driveway. On recommendation of the Zoning Board of Adjustment and on motion by Com~Iseloner Carrsway, seconded by Commissioner Stemper, the Commission set 12 November 1951 8 P.M. aa time and date for a Public Hearing in the matter of rezonlng Blocks 7A, 8A and 5, Becond Bection of Dreamwold from H-1-A to R-I; Blk 11, Tr 8, Town of Banford from R-1 to C-2, and to change text of the Zoning Ordinance to include original provisions of District R-1-X and clarify the provisions for accessory buildings in R-I-AA and R-1-A to permit accessory buildings with living quarters, providing some portion of the accessory building is to the rear of the main building. On motion of Commissioner Stamper seconded by Commissioner Ivey, and carried the matter of charge for police and fire protection for tent meetings~s tabled. A letter was received from the Garden Club advising of their tentative plans to sell the small building at the corner of let Btreet and Mellonvllle Avenue, constructed on property donated by the City, and applying proceeds to the contructlon of an appropriate Civic Center. On motion by Commissioner Stamper, seconded by Commissioner Bitting, the Comnission approved the tentative plans and commended the Garden Club on its public spiritedness. On motion by Commissioner Stamper, seconded by Commissioner Carrsway, minutes of July 1~51 were aporoved. Commissioner Carraway discussed the proposed toll highway from Jacksonville to Miami, and requested the Commission to recommend to the Chamber of Commerce that the BtateRoad Department be reminded of the right-of-way procured by the Board of Beminole County Commissioners and con- veyed to the Department as an appropriate location for the section of the toll road to pass in this vicinity. The suggestion was approved by the Commission. On sug~estion by Commissioner Carraway, the City Manager was authorized to offer assistance to the extent available, to Albert Fitts and Petite Paris Lingerie Company, in cleaning up after the fire that destroyed their factory, in recognition of their quiet, self-sufficient operation.
