Gillon City Clerk H. N. Sayer Chief of Police R. G. Williams Meeting called to order by the Chairman~ Minutes of adjourned regular meeting of January 8, 1952, approved. Financial statement and statement of revenues and expenditures for month of October, November and December, 1951, submitted and examined. W. W. Dawson, Jr., Contractor, and Elton J. Moughton, Architect, next apoeared and sub- mitted proposed plot location for the new tourist building iu Fort Mellon Park, and on motion of Commissioner Ivey, seconded by Commissioner Chase and carried, same was aporoved. A group of citizens residing on South Sanford Avenue and adjoining streets, with Archie Bmith as spokesman, next appeared and submitted petition signed by approximtely 80 water con- sumers in that area that are being served from a 2" water main south of 25th Street, request- ing the City to install a 6" main to the City limits.at 26th Street and a ~" main beyond to end of the 2" line in order to furnish them adequate water service. Seconded by Commissioner Chase and carried. Mr. Joel S. Field, President of the newly organized Sanford Baseball Association, next appeared with reference to the baseball franchise which was assigned to the City by the New York Giants, and requested that it be assigned to ~e new association after the name has been changed, advising that they could not operate under the name of Sanford Baseball Association because it conflicted with same association incorporated by the New York Giants. Thereupon Commissioner Chase moved the assignment of the baseball franchise over to the unnamed association. Seconded by Commissioner Kadet and carried. Mr. W. G. Kilbee, County Commissioner~ next apoeared with further reference to the City acquiring rights-of-way for widening French Avenue and advising of meeting of County Commissioners at 3:30 P. M. January 30, to consider assisting in the project, which the City Commissioners have been invited to,tend. He then advised that he would recommend that the County aporopriate certain funds toward such purpose and the City secure the rights-of-way under the provolone of its contract with the State Road Department. Matter taken under advisement. R. W. Herron next appeared with further reference to the proposal to remove the palm trees and triangle oark from intersection of Park Avenue and-25th Street and was advised of letter from State Road Department stating that a survey had been made of traffic at said intersection ,,' 340 MINUTES City Commission, Sanford, Florida, January 2.~. at 8 P.M. 19 52 H-40750 as to provide for traffic turn at main intersection at 25th and Park. After considerable discussion, Commissioner Ivey was~appointed as a Committee of one to contact the State Road Department for further str vey an5 consideration of the matter, and the City Manager was directed to trim the palm trees in the triangle park. Albert Fitts, Chairman of the Sanford P~,t .~r~:nal an6 Warehouse Association, next ap- peared and gave a brief resume of the new association which was organized for the purpose of developing the proposed dock and terminal facilities on City owned property on the lake front, a project that was recently abandoned by the City~ He then submitted the following request: "To request the City for an outright grant to all of the lakefront property owned by the City west'of French Avenue, less the east 150 feet. "That the City Commission be requested to commit itself to make such a grant when it ts determined that the financing of the Port Terminal and Warehouse project is assured. "That ~he City Commissioners be requested to commit themselves that when the gr~nt is made, the property will be free of taxes until the bonSed indebtedness of the Terminal is paid, and the net earnings equal the orlglna~ investment. "That after the earning a equal the investment, that the property be taxed on the same basis as any other City property.~ The City Attorney then advised that in his opinion the City would not have legal authority to grant the foregoing request as presented because it could not make an outright grant of the property and waive the assessment of taxes, He inidcated, however, that probably legal pro- cedure could be reached to make the transfer of the property. Thereupon after cortaid erable discussion and on motion of Commissioner Ivey, seconded by Commissioner Chase and carried, the Mayor was authorized to appoint a Committee consisting of one Commissioner and two citizens to meet with the directors of said Port Terminal and Ware- house Association to work out ways and means for the City to grant their request. On motion of Commissioner Chase, seconded by Commissioner Ivey and carried, the City Attorney was next authorized to prepare a resolution repealing and rescinding Resolution No. 790 authorizing the construction of municipal port terminal and tt~ issuance of bonds; authori- zing and directing the dismissal of preoceedlng fi/sd in Circuit Court to validate the bonds; and appropriating to the department of General Government all unexpended net Parking meter revenues received during 1951-1952 fiscal year heretofore allocated to t~e Public Projects Fund for port terminal purposes. Mr. J. C. Derrenbacker who operates a grocery store at ?13 Celery Avenue, next appearcd and requested that his beer and wines license be reinstated, which was suspended for six months by the City Commission on October 22, 1951, b~cauae of his conviction in Municipal Court for selling beer on Sunday. He stated that not belng~le to sell beer and wines was causing a hardship in his business and he would not violate any of the City's regulations again. Thereupon Commissioner Carraway moved that Mr. Derrenbacker's beer and wines license be reinstated on probation for ba].a~ce of suspended time. Seconded by Commissioner Chase and carried. R. T. Cowan, Chairman of Sanford Housing Authority, next submitted a proposal subject to approval of Federal Housing Adm~niatration, of Atlanta, to furnish approximately 500 feet of 15" storm sewer if the City would install it in an open drainage ditch on W. llth Street ad- Jacent to William Clark's Terrace, ap as to eliminate the open ditch. Thereupon Commissioner Kadet moved the acceptance of aforesaid proposal, if approved by Atlanta office of Housing Administration. Seconded by Commissioner Chase and carried. They then submitted request for City to waive the sixty days notice of sale as required by Ordinance No. 447, and to grant transfer of franchise effective Februsry l, 1952, from the partnership to C. W. Elrod. After discussion Commissioner Kadet moved the waiver of 60 days notice and the approval of transfer of franchise from City Bus Company to C. W. Elrod, effective February l, and approval of transfer of permit to C. W. Elrod to operate the fleet of Yellow Cabs, and that the City Attorney prepare the necessary Ordinance for passage and adoption. Seconded by Commissioner Chase and carried. Finley Mason, representative of Florida-Georgia Tractor Company, Orlando, next apoe~red with further reference to the City's proposel to purchase a new street sweeper and to find out what equipment the City may be interested in trading in on same. After consideration and on motion of Commissioner Carraway, secbnded by Commissioner Chase and carried., the City Manager wss directed to advertise for bids to be opened at $:00 P. N. February 7, for purchase of one new street sweeper, the proposals to be submitted as follows: (a) Straight sale, 50% cash and balance November l, 1952. (b) Trade~in allowance on i Case Wheel Tractor, 1 Austin Sweeper and I International Bulldozer, optional to City as to either or all. On motion of Commissioner Carraway, seconded by Commissioner Chase and carried, the Commission next suthorlzed the employment of Engineer M. C. Hagan to revise the map of the City at a cost of approximately $200.00. Vollie Williams, Jr., next appeared on behalf of Herbert Prevatt and requested refund of 1951 taxes levied and pa~d for operating purposes on Lot 28, Woodruff's Subdivision, because he failed to apply for homestead exemption, advising that thru an oversight Mr. Prevatt failed to apply for such exemption at the proper time because of illness in his family. Thereupon Commissioner Kadet moved that same be authorized. Seconded by Commissioner Chase and carried. On motion of Commissioner Chase, seconded by Commissioner Kadet and carried, the Com- mission next authorized installation of a storm sewer on W. llth Btreet between Mangoustine Avenue and across Mulberry Avenue to open ditch, to tie into sewer to be furnished by Ssnford Housing Project. On motion of Commissioner Carrsway, seconded by Commissioner Chase and carried, the re- newal of 200 feet of 6" sanitary sewer with 8" pipe on Sanford Avenue and 18th Street at approximate cost of $200.00 was next authorized. The City Manager next submitted estimate of oaring concourse at new Municipal Memorial Stadium with clay base and asphalt finish at cost of $637.50, and with concrete at cost of ~ $1,076.92, and on motion of Commissioner Carraway, seconded by Commissioner Ivey and carried, concrete payment was authorized. Also, that they are requesting that it be rezoned for commercial use in accordance with original agreemen~ with the City. , Thereupon Commissioner Carre.way moved that ~he Mayor and Clerk be authorized to execute quit-claim on behalf of the City to Southern Bell Telephone Company on the aforesaid property. Seconded by Commissioner Chase and carried. On motion of Commissioner Carraway, seconded by Commissioner Ivey and carried, the Com- mission next authorized a request to be submitted to the Zoning Board of Adjustment to consider rezonlng Lots 1 thru 5 of Block ll,, Tier 8, E. R. Trafford's Map, for Retail-Commercial uae. Petition nex~ submitted from merchants on Sanford Avenue requesting the elimination of rummage sales on Saturdays on s~id street, claiming they are affecting their business. Matter taken under advisement. Petition next received from white employees paid on hourly or weekly b~sls with over-time and not receiving a pal~ vacation, requestla~ that they be g~ven et ]east one week's vacation with pay, and same was referred to the City M~nager.
