Commission, Sanford, .-.~,..,~o, ....... : ...................................................................... 19 427 The City Commission of the City of Banford, Florida, met in adjourned session at the City Hall in the City of Banford, Florida, at 8:00 o'clock P. Bayer City Manager Thcs. L. Lemon Police Captain Roy Tillis Absent: Chief of Police R. 6. Williams Meeting called to order by the Chairman. The Commission then proceeded to sit as a Tax Equalization Board to receive any complaints or objections as to assessed valuation on the 1952 Tax Roll as prenared by the City Tax Assessor and p~esented at this time. Thereupon the following complaints were presented and taken under consideration: Miss Isabella Simon - requested a reduction in the assessed valuation of $2,180.00 against Lots 1 and 2, Block 10, Tier 6, E. R. Trafford's Map because of not having any income to pay taxes. A. C. Lamb - requested that the assessed valuation of $6,510.00 against Lot 18, Roblnson~s Burvey, be reduced to $5,000.00. Mack Cleveland; Attorney for Harry E. Robson - protested assessed valuation of $22,0~0.00 against the E. 72'~# of Lots 9, 10 and 11 Block 2 ?ier 1, E. R. Trafford's Map, claiming that Mr. Robson purchased the property within past sixty days for sum of $15,000.00 and based on sensed valuations of other property the assessment should be less than the sale price. He also pointed out the assessed valuation on similar property similarly located for comparative purpose. Mr. & Mrs Theo. Judt - protested assessed valuation of $?,500.00 against Lots 1 and 2, tons Welling/ Add.; $?,500.00 against Lots 3 and 4, Welllngton's Add.; and $9,900.00 against Lots 5 and 6 Welllngton's Add., claiming the valuations are too high in comparison with similar proper- ties and also in proportion to the income received from the property. Montes Harris - protested assessed valuation of $3,160.00 against W. 1/3 of Lot 4 Block 9, Chapman & Tucker's Add., representing an increase of $550.00 by Tax Assessor for improve- ments made to the property during 1951. George Coachman - protested assessed valuation of $1,370.00 against S. 39 ft of Lot and N. 8 ft of Lot $? Block J, Chappell'e Bubd., covering new dwelling constructed during 1951 to replace old dwelling destroyed by fire; claiming the property should carry a low valuation because of not having any ~ater mains and hydrants in that area for fire protection. J. N. Crooms - protested assessed valuation of $5~190.00 against Lots 3 and 4 Block 10 Tier 1, E. R. Trafford's Map, representing increase of $210.00 by Tax Assessor for improvements made to the property during 1951 R. W. Herron - requested the Board to table the increase by Tax Assessor of $1,260.00 in the assessed valuation against Lots 13 and 15, Teague's Add., for improvements made during 1951, until the City has given him some relief of his request for in~l~lllng a traffic signal light at street intersection in front of hie place of business. There being no further complaints or objections registered, the Commission then adjourned as an Equalization Board until 8:00 o'clock P. M., Be~tember 16~ and thereupon proceeded to handle other business of the adjourned meeting. 428 H4~750 for the foundation, MINUTES City Commission, Sanford, Florida, /~pt~]~er ..l~ ~.t ~..P.N. 19 52 found that the City had a 48" storm sewer and 12" sanitary sewer running east and west across Lot 57, which would not leave him sufficient space to construct t he dwelling on Lot 58. He then requested some consideration for an adjustment from the City since no reserva- tion for sewers were provided in the plat and Sad, and also for exoensee incurred by him in clearing the lots with bulldozer and securing building permit. The City Attorney then advised that since the sewers have been constructed on ~he property for over twenty years the City had acquired an easement by prescription and could not be held liable for encroachment. The matter of reimbursing Mr. Miller for expenses incurred in connection with clearing the lots and securing building permit was referred to the City Manager. W. L. Kirk of Bill Kirk Motors next apoeared and submitted an offer of $4,000.00, the last appraised value, to purchase Lots 39 ~nd 40, Lake View Park, for the purpose of erecting an automobile sales and service building thereon. He advised that t he proposed building would be a one story, concrete block structure size 50' x 100' with modernistic glass front, and that he would start breaking ground within 10 days if his offer was accepted. Mr. Kirk further advised that his lease on present automobile agency building expires next March and he would have to have the new building completed before then. Thereupon after careful consideration, Commissioner Chase moved that the offer of Mr. Kirk be accepted to purchase the aforesaid property at price of $~000.00 for the purpose of constructing an automobile sale and service building thereon in accordance with the foregoing structural design and dimensions, conditioned that construction be started within 90 days. Seconded by Commissioner Carraway and carried. In response to request of R. W. Heeron that City install a traffic signal light at inter- section of Park Avenue and the short street east of the triangle park at 25th Street, the City Manager next reported that it would require a three way signal light which would cost over $500.00. but that the City had an old adjustable ~raffic signal on hand that could be repaired for $350.00 and used as a three-way signal. After further discussion of the advisability of ins~lling a traffic signal at the afore- said intersection from a safety viewpoint, the City Manager was authorized to secure advice of a traffic engineer for further recommendations to the Commission. Volle Williams, Jr., Attorney, next appeared on behalf of application of ~erry Bentley, colored, for transfer to him of taxicab permit and license of William Fields, Jr., and on motion of Commissioner Kadet, seconded by Commissioner Chase, Same was authorized. Attorney Williams next gave a report on progress being made in securing rights of way for widening French Avenue, in which he advised that several parcels of property would have to be con- demned because the owners would not ~ccept values established by the Appraisal Board. He also recommended that the Commission consider rezoning certain districts on French Avenue for com- mercial use, which he felt would be some inducement for the orooerty owners to make satisfactory settlement for the rights of way. The Commission then directed that a request be made to the Planning Board for recommenda- tions on rezoning property along French Avenue. Request next received from Ozler-Weller Homes, Inc., for the City to remove two stumps from their property with the City's wrecker, offering to pay the cost of such service, and same was referred to the City Manager to assist them'in finding someone else with a wrecker to remove the stumps.
