M., February 13, 1956. Present: Commissioner F. D. Scott, Mayor " David M. Gatchel " Earl Higglnbotham " John S. Krider St., " Jack Ratigan City Clerk H. N. Sayer City Manager W. E. Knowlea Chief of Police R. G. Willisms Absent: City Attorney I~I. C. Hutchleon, Jr. Meeting called to order by the Chairman. On motion of Commissioner Ratigan, seconded by Commissioner Gatchel and carried, minutes of regular meeting of January 25, and special meeting of February 6, 1956, spproved. Randall Ch~:se next appeared on behalf of the General Sanford Memorial Library and Museum Association and reported on progress of constructing the L~Sbrary and Museum building, in which he advised that the plans and specifications were now available for advertising for bids, the estimated cost bein~ between $15,000.00 and $16,000.00. Mr. Chase then requested that the City turn over to the Association the funds in amount of $7,000.00 appropriated toward erecting the Library and Museum, in accordance with authorization of the City Commission unSIer date of July 25, 1955, advising that the County has $6,000.00 available in its appropriation, ~;hich the County Commissioners hs. ve agreed to turn over to them at this time providing the City will do likewise. After discussion, and upon advice of the City Clerk that only one-half of the funds are available at this time and t hat the balance will probably be available within 90 days Commissioner Hig~finbotham moved that the City turn over to the General Sanford Memorial Library and Museum As~ciation the sum of $3,500.00, to be used toward erecting' the afore- said building in Fort Mellon Park. Seconded by Commissioner Ratigan and carried. ~fr. Chase f,~.rt~ler advised that the County agreed. to appropriate the sum of ~9,000.00 over a three-year period toward erecting the L_tbrary and Museum, of which $6,000.00 were now available, and requesting the City to match these funds by appropriating the balance in next year's budget. He stated that the County's funds could not be used for the aforesaid purpose unless a like amount is appropriated by the City. After further discussion, and in view of the fact that the City only agreed to match the County's appropriation not to exceed. $7,500.00 toward erecting the Library and Museum, action was deferred for consideration in next fiscal year's budget. R. J.Bsuman, President of the Retail Merchant's Associa. tion, next appeared and re- quested financial assistance from the City toward paying balance due on the Christmas street lights installed by therh last fall. He a~,.vised that the total cost was $1,610.00, of which they had paid $700.00 but did not have funds to pay the balance. After discussion, and in view of City hot having any appropriation in current budget for this purpose, and no other funds available at this time, Mr. Bauman was requested to submit the foregoing request again in September,' for consideration for payment from funds which may be available at that time, or to be included in next fiscal yesr's budget. J. W. Hall., Realtor, next submitted an offer of $8,000.00 for a steel manufacturing firm of ~iami, to purchase two. lots (100 ft. frontage) of city owned property at north- west corner of French Avenue and Commercial Street. M. 1956 After discussion, action was deferred, pending conference with a representative of t he aforesaid firm. Mr. Hall next brought up the matter of City considering the feasibility ot taking over the distribution and selling of power within the City upon expiration of franchise of the power company, and voiced his objections against it. He stated that the Florida Power & Light Company is rendering excellent service and in financial position to expand its facili- ties along with the growth of the community, and pointed out that the City would have to borrow a large sum of money to take over the system and also to make any expansions. Mr. Hall concluded by stating that the matter should be given serious consideration before taking any action. Thereupon Mayor ~cott thanked Mr. Hall for his interest in the matter and assured him that since it will effect the City of Sanford for the next thirty years, the City Commission would think seriously before taking any steps. The following letter of recommendations next submitted from the Zoning and Planning Commi s s ion: Honorable City Commission City Hall Sanford, Florida Gentlemen: February lO, 1956 The following recommendations were made by the Zoning and Planning Commissimat a special meeting held on February 8, 1956: I - (a) Block l, Second Section of Dreamwold, along Myrtle Avenue south of 25th Street, to include Lots 4, 5, 6 and 7, and (b) Block 3, to include~. Lots Lots lO,11, and 12, and (c) Block 5, to include Lots 16, 17, and 18, and (d) All of that property west of the alley between Magnolia and Park Avenues, south of 2~th Street and north of 26th Street, anS. east of 0r!sn6o Drive, which is not presently zoned com- mercial, to be changed from an R-1 District to a C-1 District. 2 - Rezone all of that property between 6th Street and 13th. Street, west of the alZey between I.~aurel and Elm Avenues, and east of the alley between French and Laurel Avenues, presently zoned R-1 to C-1. N., Februs. ry 29, 1956, to consider rezoning. the property ~escribed in the foregoing letter in accordance with the recommendations of the Zoning and Planning Commiss! on. Seconded by Commissioner Krider and carried. Brailey Odham of Odham & Tudor, Inc., ne~t submitted a further request for t.he City to vacate the street right-of-way on the west side of Lake Gem in Bel-Air Subdivision, and offered to convey back to the City that portion of said right-of-way that will revert to them ss abutting property owners, in order that the City may dedicate the property for park purposes. "' ~ 56 19 Seconded by Commissioner Higginbotham and carried. vacate and abandon the street righ-of-way. Nesl Tare, operator of temporary skating rink located at southwest corner of Palmetto Avenue End Seminole Boulevard, next appesred and requested permission to keep his house trailer in back of the skating rin~k and occupy it for living quarters as long as he operates said business. After discussion, and in view of the fact that the City Code prohibits parking house trailers occupied for living quarters outside of regularly licensed trailer parks, except for not more tha~ three weeks under special permit from the City, the matter was referred to the City Attorney. Consideration next given to the motion of Commissioner Gatchel at regular meeting of January 23, 1956, "that the City discontinue sending. its fire equipment beyond ~he cor- porate limits so as to conform with the Charter", which was seconded by Commissioner Ratigan bu~ not voted on by the Commission. Commissioner Krider then stated that he was in favor of continuing rendering fire service beyond the corporate limits to a limited e~tent, providing the City can be reim- bursed for such service by way of insurance coverage underwriting the cost, or other satis- factory methods. Commissioner Hig~:inbothsm stated that he was also in favor of continuing such service but would like to see a program worked out so the City could be reimbursed thru insurance coverage, and felt that a f~ir and equitable fee could be worked out with the insurance companies. He furt.her stated that from a humanitarian viewpoint he could never vote to instruct the Fire Department to go to a certain line and stop, regardless of any reimbursement plan. Brsiley Odham of Odhsm & Tudor, Inc., developers of several homes outside the city limits, next offered to pay for fire protection service for all the homes in their develop- ments until such time the City can ~.rork out an equitable plan for reimbursement by the property owners. He cited the recent growth of Sanford and surrounding areas, and stated that the proposed action of the Commission would do more to impede this growth than anyt!~ing else. Mr. Odham further stated that if the citizens outside the city limits are given the machinery, they would serve themselves. Commissioner Ratigsn then advised that it was never the intent of the Commission to withdraw fire protection from said areas, and that the proposed action was to roring the matter to a climax in order that some program lcould~ be worked out so the cost of such service would not have to ]be borne by the citizens of Sanford. He pointed out that 20% of all calls made by the Fire Department during 1955 were to combat' fires outside the corporate limits, and stated that the City would not be able to continue this service ~rithout additional equipment and manpower. Commissioner Ratigan then sug[;~ested that Commissioner GatChel with- draw his motion with instructions to the City Manager te work out a schedule of fees to be charged for fire protection service beyond the corporate limits, based on mileage a fire truck has to travel. Commissioner Gatchel concurred in Commissioner Rstigan's statement and pointed out that Sanford was the only city in central Florida rendering<(:such free service. 'He stated that his motion had served its purpose because this matter had been pending for several years without any official action by the Commission. Fire Chief Clevelan~ then informed the Commission that he was in favor of continuing to render fire protection service outside the city limits, if he had adequate equipment and manpower. He also pointed out the recent growth of the City and stated tt~. t he department was inadequately equipped to provide sufficient protection for it alone, according to national standards, and that the ~ity would have to have additional equipment, manpower, a~ probably another station in order to serve both. Petition next submitted from the property owners in the block between 25th Street and 25th Place, and Yale and Princeton Avenues, for the City to open an alley in said block, offering to convey the necessary righ-of-way for the proposed alley. After discussion, and on recommendation of the City Manager, Commissioner Ratigan moved the approval and acceptance of the property for the aforesaid alley. Secon6ed by Commissioner Higginbotham and carried. On recommendation of the Chief of Police, and on motion of Commissioner Ratigan, seconded by Commissioner Higginbot,hsm and carried, the Commission next approved the transfer of beer an6~ wines license from Clarence Henderson, now deceased, to Johnnle Henderson, his brother, at 620 Locust Avenue. Letter ne~t submitted from the State Welfare Board requesting that they be granted permission to move back into the old hospital building, and on motion of Commissioner Rstlgan, seconded by Commissioner Gatchel and carried, action was deferred. Volie A. ~/~il!iams, City Bond Trustee, mex~ reported on tt~ activities of the Board since October 1, 19~5. The City Manager next reported that under the provisions of Section 120 of 195~ Internal Revenue Code, police officers are allowed a subsistence of ~.00 per day out of their wages, which can be excluded from gross income s.n~. exempted from income tax, provided the employers' records designate the portion of the wages attributable to the subsistence al lowanc e. Thereupon after consideration, and in order for t he City' s police officers to benefit by the aforesaid tax exemption provision, Commissioner Higginbotham moved that 'the City Attorney prepare the necessary resolution designating the allowable portion of their wages as subsistence. Seconded by Commissioner Kri8er and carried. Further consideration next given to the following bi6s submitted.at meeting of January 23, 1956, for resurfacing certain streets with asphalted blacktop, based on 5,770 tons: Orlando Paving Company $7.22 per ton MacAsphalt Corporation 7.60 per ton The City Manager then advised that Orlando Paving Company, the low bidde~, ~ad agreed to lay a minimum of 2,860 tons of asphalt at this time at the above prid'e, provided they have first refusal on balance of proposed resurfacing at same price per ton if the work l.s done within one year. After discussion Commissioner Ratigsn moved the acceptance of the lowest bid, that of Orlando Paving Company at price of $7.22 per ton, and further moved that they be given re- fusal on balance of the resurfacing at same price per ton, provided the work l~ done within one year. M. 19,56 current invoices and payrolls next ap:oroved, as evidenced by General Fund Sanford Atlantic Nstlonal Bank Vouchers Nos. 8502 t~ru 8A~25; General Fund Florida State Bank Vouchers Nos. 1503 thru 1536; and Water & Sewer Revenue Fund S~nford Atlantic National Bank Vouchers Nos. 61 thru 66. On motion of Commissioner Higginbotham, seconded by Commissioner Krider and cartie d, the Commission next spproved an expenditure of $135.00 from the Contingent Fund for repairing the pool table at Fir~ Station. Petition next submitted from the residents of Dresmwold Subdivision for the installa- tion of 7 street lights at certain locations in said subdivision.
