Request: Application for approval of a Conditional Use to allow the outdoor
display of used goods in a GC -2 zoning district
The Applicant and the property owner of the subject property, through the Applicant, have submitted
a request to allow the outdoor display of used goods located at 2613 Orlando Drive. The applicant is
proposing to display items behind the fence, in an area on the south side of the building. The property is
currently zoned GC -2, General Commercial and is bordered by residential properties to the east and
commercial businesses to the north, west and south. Per Schedule B, Permitted Uses of the Sanford
Land Development Regulations, Outdoor Display of Used Merchandise in the GC -2 zoning requires
Conditional Use approval by the Planning and Zoning Commission. In addition, per Schedule E of the LDR,
when a use is permitted under the land use category in Schedule B of these regulations as 'outdoor display' or

`outdoor storage', retail sales and services which are normally permitted outdoors may store or display their
goods outdoors provided that no such outdoor display and /or storage of goods, commodities or merchandise
shall be permitted within any required buffer yard or building setback.
NOW, THEREFORE, it is ORDERED and AGREED that:
(1). The aforementioned application for development approval and a Development Order
is GRANTED as set forth herein.
(2). Except as specifically set forth herein, all development shall fully comply with all of
the codes and ordinances in effect in the City of Sanford at the time of issuance of any and each
order or permit including, but not limited to, all impact fee ordinances.
(3). The following conditions of approval shall run with and perpetually burden the
subject property. All of the conditions listed shall remain in full force and effect unless removed or
modified by a document of equal dignity with this document:
1. All uses previously approved by the City for the subject property remain in effect
subject to their original conditions and the requirements of the Land Development
Regulations.
2. Outdoor Display may be established on the south side of the building in the general
area depicted on the Site Plan accompanying the Conditional Use request. The
boundaries of the proposed display area shall be striped on the existing paved area
and shall not exceed 600 square feet as depicted on the attached Site Plan.
3. All Outdoor Display shall be contained behind the existing fence at all times.
4. Outdoor display shall not be established in such a manner that will block or impede
required pedestrian access or accessible route from the parking area.
5. Outdoor Display is only allowed during regular business hours and shall be removed
and stored indoors otherwise.
6. Only items that are for sale at the Retail Sales establishment on the premises (2613
Orlando Drive) are to be displayed.
7. Outside storage or display of vending machines, pay phones, news racks, or similar
structures are prohibited. .
8. The right to have Outdoor Display as requested for this Conditional Use shall expire
if the existing business is closed or abandoned for six (6) months or greater unless
approved by the Planning and Zoning Commission or the City of Sanford in
accordance with the Sanford Land Development Regulations and Non - conforming
Land Use policies.
9. All required landscaping and buffer improvements per earlier approvals shall be re-
established and maintained in accordance with the Land Development Regulations.

(4). This Development Order touches and concerns the afore described properties, as set
forth herein, and the conditions, commitments and provisions of this Development Order shall
perpetually burden, run with and follow the said properties, as set forth herein, and be a servitude
upon and binding upon said properties, as set forth herein, unless released in whole or part by action
of the City of Sanford by virtue of a document of equal dignity herewith. The owner of the said
subject property has expressly covenanted and agreed to this provision and all other terms and
provisions of this Development Order. Accordingly, the provisions of this Development Order touch
and concern the subject.property.
(5). The terms and provisions of this Development Order are not severable and in the
event any portion of this Development Order shall be found to be invalid or illegal then the entire
order shall be null and void.
