M. 19.56 79 The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. July 9, 1956. Present: Commissioner F. Willlams Absent: Commissioner A. L. Wilson Meeting called to order by the Chairman. The first order of business being a public hearing to consider rezoning the property as proposed and described in the' following legal "Notice" which was published in the Sanford Herald on June 15 and 22, 1956: NOTICE OF PUBLIC HEARING ON PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DIS- TRICTS AND BOUNDARIES OF THE ZO~t ING ORDINANCE OF THE CITY OF SANFOE, FLA. Notice is hereby given that a Public Hearing will b e held at the office of t he City Commission in the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. July 9 1956, to consider the following changes and amendments to the Zoning Ordinance of the City of Sanford, Florida: (a) (b) The property zoned in District R-1-A (Single-Family), located between 25th Street and Satira Street and adjacent to property abutting on West side of French Avenue, is proposed to be changed to C-T (Transient~ Commercial) District. Said property being more particularly described as Lot 10, the East one-half of Lots 11 and 34, and all of Lot 35 of Block 9, Dreamwold. The property zoned in District R-1-X (Single-Family), bounded on North by 5th Street, East by Pecan Avenue, South by 6th Street, and' West by Mangoustine Avenue, is proposed to be changed to R-2 (Multiple-Family) District. Said property being more particularly de- scribed as BloCk 7, Tiers 14,15 and 16, of E. R. Trafford's Map of Sanford. (PUBLISHED AS A LEGAL ADVERTISEMENT IN THE SANFORD HERALD ON DATES OF JUNE 15TH AND 22ND, 1956) The Chairman then announced that the Commission would be glad to hear from anyone in favor of, or against rezoning the property as proposed and described in paragraph (a) of the foregoing notice. Jimmy Wright, whose residence is located at corner of Osceola Drive and Satits St., directly across the street from the property proposed to be rezoned, then voiced' his objections against rezoning the property from residential to commercial usage. He advised .of purchasing his property in 1949, at which time it was zoned under R-1-AA classification, the highest restricted residential zone of the city, 'and stated that he was required to erect a much larger dwelling thereon than needed in order to meet the zoning restrictions. Mr. Wright further stated that business had not progressed to the extent in that area to'warrant the proposed rezoning, but that it was only for speculative purpose for the owner ~hozequested it. B. 8wankhous, of 615 W 25th St., voiced her objections, stating that they purchased their home in 1947 because it was in a highly restricted residential zone. W. A. Johnson', of 616 Sarlta St., voiced his objections, advising ~Aat he purchased his ~ome in 1955, at which time he investig~te'd the zoning restrictions and. found that it was in a residential area. Mrs. George J. Rau, of 619 Satira St.,' voiced her objections, advisiong that she purchased her home in 1955 with the understandlng tha~ it was a residential area, and would remain so. Clay Willlass, of 613 W 25th Street, also voiced Its objections and pointed out that the residences in the area represented a much larger investment than any commercial building that '~uld be erected on the property proposed to be rezoned. Howard Hughes, owner of the property in question, next spoke in favor of the proposed rezoning. He pointed out that French Avenue had been designated as a "Truck Route" since 1947, and that all of the property on the West side of it from 25th to 181h Street had been re zoned one block in depth for commercial use. k*r. Hughes then advised that his lots facing French Avenue tiave adept of only 80 ft. , which he said was not sufficient to erect a building of any size after providing for off-street parking as required under the zoning ordinance. After ~eviewing the zoning map and plat of the property in question, Commissioner Krider recommended that a buffer zone be left between the adjacent residential property and the proposed commercial zone by leaving the East one=half of Lots ll and 34 of said property in the residential zone and relocate the 15 ft alley along the eas~ side of lots, and fezone only Lots lO and 35 for commercial usage. Mr. Hughes then stated that the foregoing recommendations were satisfactory ~o him, and a greed to convey to the City the W. 15 ft of the East one-half of Lots ll and 34 in exchange for the existing alley right-of-way for the purpose of relocating said alley. Thereupon Commissioner Krider moved that only Lots l0 and 35 of Block 9, Dreamwold of the property described in paragraph (a) of the foregoing notice be rezoned from District R-1-A (Single-Family) to C-T (Transient-Commercial), subject to Mr. Hughes' agreement to relocate the existing alley. Seconded by Commissioner Gatchel and carried. The Chairman next announced that the Commission would be glad to hear from anyone in favor of, or against rezonLng the property' as proposed and described in paragraph (b) of the foregoing notice. There being no objections registered, Commissioner Gatehel moved. tha~!~said property be rezoned a~ advertised, andShat the City Attorney prepare the necessary ordinance for adoption. Seconded by Commissioner Higginbotham and carried. Sam C. Lawson, developer of St. John's Village Subdivision, next appeared with reference to the City's agreement, which was authorized by the Commission at special meet- ing of June 13, 1956, whereby, the City would install 575 ft of water and sewer lines to service said development at estimated cost of $2,2?5.00, and accept his note in sum of $2,500.00 as guarantee of re-iSayment of such cost, payable on basis of $200.00 per house, as each is sold. Nr. Lawson advised that it was his understanding that the City would accep~ his personal note without requiring a lien against the property, as proposed by the City Attorney, and further advised that he could ncZ meet such requirement because he did not own the Drooert,v. M. 56 S1 accept Mr..Lawson's personal note in sum of $2,500.00, payable at rate of $200.00 per house constructed and sold on Lots 1 through 16 of said subdivision, and that in any event any unpaid balance shall be due and payable at end of two years. Seconded by Commissioner Krider and carried.' On motion of Commissioner Krider, seconded by CommlssioneP Gatchel and carried, the Commission next re-appointed Harry Lee as a member of the Civil Service Board for a term of two years, in accordsace wi~h the provisions of Section 7-28 of ~he Code of the City of Sanford 1954. On motion of Commissioner Higginbotham, seconded by Commissioner Gatchel and carried, the Commission approved the four proposed agreements and authorized the Mayor and City Clerk to execute same on behalf of the Oi~y by ~he followi~ vo~e - ~S: Commissioners Gatchel, Higginbo~ham, Krider and Scott. M. 19 56 After discussion the matter was take~ under advisement, pending satisfactory negotiations with one of the local banks to borrow the money to finance t he exchange. Letter next submitted from Karlyle Housholder, Chairman of Armed Forces Committee of Chamber of Commerce, requesting the City to provide for an appropriation in next fiscal year's budget for the purpose of paying at least $25.00 per month toward the salary of the U. S. O. Aide and Coordinator, and same was taken under advisement, for consideration in preparing the budget. On motion of Commissioner Higginbotham, seconded by Commissioner Gatchel and carried, the City Manager was next authorized to employ a Building Inspector on temporary basis at salary~ of $5,200.00 per year, to fill the vacancy c rested by resignation of John M. Gillon until such time the position' can be filled thru certified eligibles to be furnished by the Civil Service Board. The City Manager next reported that he had not received his salary increase of $600.00 per year, effective October l, 1955, due to no funds being appropriated for such purpose in current budget, which was authori~.ed by the Commission on September 25, 1955, after the budget had been adopted, and advised that there would be a balance in the contingencies ap- propriation from which funds could be transferred for this purpose. Thereupon Commissioner Gatchel moved that $600.00 be transferred from the Conti~geht Fund to the City Manager's appropriation for the purpose of paying him the salary increase authorized by the Commission. Seconded by Commissioner Higginbotham and carried. The City Attorney next submitted for approval, the proposed agreement with' Roy Wall, the City agreed to accept whereby[the plat of Wall ~ubdiv~sion and the new public utilities easement as platted thereon, and ~vacate**the existing easement, and in consideration therefor~;L Mr. Wall, agreed that at such time as it may become necessary for the City to construct new sewers .on the newly dedicated easemen~ of Wall Subdivision he Will pay the City the Cos t of purchasing and paying 189 feet of 8-inch viirifled clay sewer, together with three manholes in con- nection therewith. Thereupon C~mmissioner H~ ginbotham moved the approval o f said agreement, and that the Mayor and Clerk be authorized to execute same on behalf of the City. Seconded by Com- missioner Gatchel and carried. The ~ollowing letter next submitted from South-Eastern Underwriters Association, but no action was taken by the Commission: ~ Mr. Warren E. Knowlea, City Manager Sanford, Florida. Dear Mr. Knowle s: June 25, 1956 Install two additional standard fire department pumpera preferably of 750-gallons capacity and keep present pumpera in service· Increase the number of full-time paid firemen on duty at the fire station at all times to at least nine and preferably twelve. A minimum of at least 8,000 feet of 2,-inch and 1,O00 feet of 1½- inch standard fire department hose be maintained at all times. At the time of his visit to this office June 21, Chief Clevelard requested our suggestions for improvements in fire defenses to bring them up to stand- ard, and based on the information in our file ~and furnished by Chief Cleve- land, the following are~sOme~of the suggestions we made ~in the fire depart- ment: MINUTES City Commission, Sanford, Florida, July 1956 A thought was expressed to the Chief that a visit to Sanford and complete survey by one of our Municipal Engineers would best serve the purpose of the City, and that we would attempt to schedule this survey within the nex~ menth or six weeks. At1 ti'me of this visit our engineer will be glad to discuss with you in detail the fire defense needs of your city and p~epare such recommendations as may be in order.'
