091056-Regular Session MINUTES City Commission, Sanford, Florida, September 10, at 8 P, M,19 56 103 The City Commission of the City of Sanford, Florida, met in regular session at the , City Hall in the City of" Sanford, Florida, at 8:00 o'clock P. M. ~eptember 10, 1956. Present: Commissioner F. D. Scott, Mayc~ " David M. Gatchel " Earl Higginbotham " John 8. Krider, St. " A.L. Wilson City Attorney W. C. Hutchleon, Jr. City Clerk H. N. Sayer City Manager W. E. Knowlea Chief of Police R. G. Willlame Meeting called to order by the Chairman. A committee representing the High School Athletic Association and Seminole Chiefs Club, with John Schirard as spokesman, next appeared. and requested the Commission to waive the admission tax on all Seminole High School fOot ball games played in the municipal stadium. He stated that the High School athletic program had been operating at a loss of approximately $750.00 each year, and that the admission tax, which amounted to $720.60 during last season, would almost off-set this deficit. Mr. Schlrard also pointed out that the School Board is paying the City $1,250.00 annually for converting the baseball diamond to football use and back again, and that the Athletic Association is paying the City $70.00 per game for use ~ the stadium, in addition to the admission tax. The City Manager then informed the committee that the' City is losing money under the aforesaid schedule because it was costing approximately $1,500'.00 to convert the field, and that the $70.00 did not include any cost for maintenance and repays. After considerable discussion it was felt that the School Board s~kould pay the entire cost of converting the baseball diamond to football use, and probably appropriate funds toward the maintenance, and Mayor Scott appointed Commissioners Gatchel and Krider as a committee to meet with the School Board together with representatives from the Athletic Association and Seminole Chiefs Club, to work out satisfactory financial arrangements for using the stadium foz such purpose. 8evePal of the local merchants next appeared,wi~Ah further reference to the City's proposal to eliminate the displaying of merchandise on the sidewalks by enforcing an existing ordinance prohibiting same. Mr. Roberrs, who operates the Lobby News Stand in Sarf ord Atlantic Bank Building, voiced his obJections to the ~roposal and stated that such action wo~ld pu~, him out of business. He pointed out the value of displaying magazines and newspapers in order to sell them, and of not having adequate space in his small place of business to do so. Harry Robson, of Robson's Sporting Goods Store, spoke in favor of allowing the mer- chan~a,,~o continue using a portion of the sidewalks for displaying merchandise, and sighted the sales advantages to the merchants in being able to display merchandise in front cf~,their places of business. He also pointed out that only a few of the merchants were ~busing such privileges, which he felt could be regulated, and stated that it would work a hardship on moe t of the merchants if this privilege was discontinued. The City Manager then informed of someone tripping over a lawn mower displayed on the sidewalk within the past week and cutting his shoe, and had requested the City to pay the damag;$. M, 19 56 I::.. !, :... ,. ~-:. :~'~ft.e,r d:isOuss:ion Commissioner Gatchel ~oved, that in view of the foregoing opinion of the Ci.ty Attorney. the City Commission instruct the law enforcement officers to enforce the City's ordinarce prohibiting obstructions from being placed on sidewalks. Seconded by Com- missioner Higginbotham. Commissioner Krider then sighted the number of times that this matter had been brought to the attention of the Commission over past several years, and pointed out that the ordinance had never been enforced, except temporarily, and stated that he did not believe that it would be enforced in the future. He then made a Substitute motion to table the discussion of the matter before the Boar~, which was seconded by Commissioner Gatchel and carried unanimously. On motion of Commissioner Wilson, seconded by Commissioner Gatchel and carried, the Commission next accepted the bid of A. E. Finley & Associates, Inc., Lakeland, on purchase of i used 1944 Model Reo 7½-ton Truck at price of $3,000.00. including trade-in allowance on old derrick truck, which was the only bid received. Said t~uck being purchased under capital improvement program. A committee of residents from the Goldsboro area next appeared with'reference to their petition for extending sanitary sewers to said area, which was filed with the City in 1954, and inquired as to if and when the City intended to make such improvements. The City Manager then advised that f, unds were being appropriated in the 1956-1957 budget for extending sanitary sewers to the area in question, which would be installed not later than January l, 1957o Architect John Burton next submitted sketches and floor plan of the proposed civic center building for consideration of t he Commission, which is included in the capital im- proveme nt pro gram. Mr. Burton also submitted proposed agreements with the City covering Architect 's fees of six (6%) per cent for services in preparing plans and specifications, and supervision of construction of the proposed. civic center, fire station, and swimming pool. t6 be constructed under the capital improvements program. After consideration. and on advice of the City Attornsy thet'k-t, he aforesaid agreements were of standard form, Commissioner Higginbotham moved the approval of same and that the Mayor and Clerk be authorized to execute them on behalf of the City. The following bids next submitted for purchase of a 6-inch water meter to replace the one servicing the Naval.Air Station, which is beyond ~epair: Badger Meter Company Davis Meter Company Neptune M~ter Company $696.40 900.O0 916.25 After comparison of prices submitted and the quality of meters bi'd upon, and on recommendation of the City Manager, Commissioner Higginbotham moved the acceptance of the l~qest bid. Seconded by Commissioner Krider and carried. Seconded by Commissioner Wilson and carried. Seconded by Commissioner Higginbotham and carried. Company at price of $401.00. Seconded by Commissioner Krider and carried. Commissioner Higglnbotham next introduced Ordinance No. 588, entitled: AN ORDINANCE OF THE CITY OF SANFOE, FLORIDA, VACATING, CLOSING AND ABANDONING THAT CERTAIN NORTH-SOUTH ALLEY DIVIDING THE NORTH HALF OF BLOCK 2, TIER lO, ACCORDING TO E. R. TRAFFORD'S NAP OF THE CITY OF SANFORD, FLORIDA. and same was placed on its first reading and read in full. Commissioner Higginbotham then moved t he waiver of the requirements of the second reading of said ~rdinance No. 588, and that same be placed on its firal passage and adoption. Commissioner Gatchel next introduced Resolution No. 877, and after being read in full, moved its passage and adoption, seconded by Commissioner Krider and carried by the following vote of the 0oremission: Commissioner Scott Yea " Gatchel Yea " Higginbo~ham Yea " Krider Yea " Wilson Yea Said ResDolutlon No. 877 being as follows: A RESOLUTION OF THE CITY COMNISSION OF THE CITY OF SANFORD, FLORIDA, COMMENDING THE SANFORD NAVAL AIR STATION IN ITS SERVICES TOGETHER WITH THE SERVICES OF THE CITY OF SANFORD, FLORIDA, FOR THEIR PROMPT, OUTSTANDI~ AND COURAGEOUS CONDUCT IN THE RECENT CRASH OF AN AIR- CRAFT OF THE SANFORD NAVAL AIR STATION, WHEREIN THEE OCCURRED A MOST ,REGRETTABLE LOSS OF LIFE AND PROPERTY DAMAGE. WHEREAS, On August 27, 1956 there occurred wit~hin the City limits of the City of Sanford, Florida, ~a most regrettable and unavoidable accident wherein a naval aircraft crashed with attendant los s of life and property damage, and .WHEREAS, Fire and security services of the Sanford Naval Air Station together with fire and security services of the City of Sanford resporfi ed in a most efficient, prompt and courageous manner, to the extent that property damage and loss of life in the area were held to a minimum, and WHEREAS, Had it not been for the prompt, efficient and courageous efforts on the part of the services mentioned, loss of life and property damage would have been materially increased, NOW' THEREFCRE, BE IT RESOLVED By the City*Commission of the City of Satford, FlorJda, that the services of the Sanford Naval Air Station and the City of Sanford be and they are hereby commended for their prompt, efficient and courageous activities connected with the aforesaid crash on August 27, 1956, BE IT FURTHER RESOLVED That there is hereby extended a sincere regret of the City Commission of the City of Sanford, Florida to the persons involved, both from the standpoint of life and property damage as a result of the aforesaid unavoidable accident. BE IT FURTHER RESOLVED That a copy of this Resolution be spread on the minutes of the City Commission of the City of Sanford, Flarida and copies thereof be delivered to the Sanford Naval Air Station and ths local press.
