102456 MINUTES City Commission, Sanford, Florida, 0ctobel, 21~ at 8 o 'clock P19M 1~56 The City Commission of the City of Sanford, Florida, met in adjourned regular session at the City Hall in the City of Sanford, Florlda, at 8:00 o'clock P. M. October 24, 1956. Present: Commissioner F. D. Scott, Maycr " David M. Gatchel " Earl Higginbotham " John S. Krider, Sr. " A.L. Wilson City Attorney W. C. Hutchison, Jr' City Clerk H. N. Sayer City Manager W. E. Knowles Meeting called to order by the Chairman. Further consideration next given to, he request from the doctors in the Medical Arts Bul]dlng, located at Southeast corner of Second Street and Man Marcos Avenue, that the City restrict parking of vehicles on San Maroos across from their off-street parking area in order that the patients can utilize said parking facilities in a safety manner, and without being blocked after parking therein. Commissioner HigginboSham stated that he had investigated ~he problem and it was his opinion that parking should be prohibited on both sides of San Marcos Avenue from Second Street south for a distance of at least 20 feet beyond both clinic buildings; and .that park- ing should also be prohibited on both.sides of Second Street from San Marcos Avenue east to Mellonville'Avenue in order to eliminate the existing traffic hazard caused by the heavy travel of large trucks on said street. Doctor Epps and Munson, representing both clinic buildings, both s~ated that the foregoing recommendations of Commissioner Higginbotham.would be satisfactory. Thereupon Commissioner Higginbotham moved tha~ the Police Department be instructed to res~ric~ parking of vehicles on San Marcos Avenue from Second Street south for a distance not to exceed 20feet beyond each clinic building, and also on Second Street from San Marcos Avenue east to Mellonville Avenue. Seconded,by Commissioner Gatchel and carried. Commissioner Higginbotham next reported of complaints received from the ~esidents on east si. de of Oak Avenue between 9th and 10th Streets against the parking restriction in front of their homes to provide for a loading zone for the Parb~,h!al School across the street After Consideration, and in view of the school having also a frontage on 10th Street and Myrtle Avenue, ~ommissloner Higginbotham moved that ~he Chief of Police be instructed to remove the 'no parking" signs from the east side of Oak Avenue in said Block, and relocate the loading zone on 10th Street or Myrtle Avenue, whichever is-satisfactory ~o the school. Seconded. by Commissioner Gatchel and carried. Commissioner Krider next pointed out an existing traffic hazard on 13th S~ree~ between Palmetto and Sanford Avenues, caused by parking of vehicles on the north side of said street, and after discussion, moved that parking be restricted on bo~h sides of ~he street in said block. Seconded by Commissioner Higginbotham and carried. Reconsideration next given to the application of Elnora James and Rosalia McCoy for permit to continue opera~ing ~he taxi-cab business of their father, Will Hankersa~, deceased, which was denied by the Commission a~ meeting of October 8, due to the application having requested transfer of the permit to them instead of remaining in the estate. Commissioner Gatchel, who was absent from the meeting of October 8, stated that he felt the policy for reducing the number of taxi-cabs should not re restricted to new permits or transfers but.applicable to all operators now hold. in~ permits, and based on manner of operation and traffic violations, in accordance with the ordinance regulating the MINUTES OctoSer 24 at 8 P. The City Manager then subm'Itted the police record of all o~erators showing the number of traffic violations and convictions for past several years, with the reco'rd of the taxi-cabs of Will Hankerson having a minimum of sm~h violations. Thereupon after reviewing ~he requirements of applicants for taxicab permits, and the provisions for revocation of such permits under the taxicab ordinance, Commissioner Gatchel moved Zha~ the application of Elnora James and Rosalle McCoy for permit to operate ~he ~axicab business of Will Hankerson, deceased, be approved subject to submittin'g proper ap- plication as required by said ordinance; and further moved that the Chief of Police be in- structed to adhere to said City ordinance regulating the operation of taxicabs. Seconded by Commissioner Higginbotham and carried. Conslderati~ next given to engaglngGoodbody & Company, Sullivan, Nel'son & Goss, Inc. and Anderson Cook Company, Inc., as Fiscal Agents for the City to haSdle the financing of ~he proposed sewage treatment plant, which will include preparing and submitting a feasibility rep as to the Cit~y,s ability ~o issue additional pari passu water & Sewer revenue certificates under the present revenue structure. The terms of their contract provide that no paymen~ will be required, of the City for such service unless the revenue certificates are issued and sold. After consideration of all other terms and conditions of the proposed con~ract, Com- missioner H~ginbotham moved that the Commission approve and accept same in order that the City have something concrete as to its ability ~o finance the trea~men$ plant, and that the Mayor and Clerk be authorized to execute the contract on behalf of ~he City, subject to approw of ~he City Attorney. Seconded by Commissioner Wilson wh~ stated "I believe that this Commissi should carry out the terms of the Resolution adopted on April 12, 1954, and if it is not able to do so, to make a survey and notify the State Board of Health as to when it can be accom- plished''. The motion was then carried by unanimous vote of the Commission. Said Contract being in words and figures as follows: THIS CONTRACT, made and entered into in duglicate this 24th day of October 1956 by and between GOODBODY & COMPANY, SULLIVAN, NELSON & GOSS, INC., ANDERSON COOK COMPANY, INC., hereinafter referred to as fim~cial advisors, and the CITY OF SANFORD, FLORIDA, hereinafter referred to as the "City"; W I T N E S S E T H WH.~REA$ it is deemed essential by the City that improvements and extensions be made to the sewer system ~of the City; and WHEREAS, the City contemDlates the issuance of additional bonds ~o improve ~he sewer system; and WHEPJEAS, GOODBODY & COMPANY, SULLIVAN, NELSON AND GOSS, INC., ANDERSON COOK COMPANY, INC., hereby offer to design a financing plan and the said financing; NOW THEREFORE, for and in consideration of the sum of One Dollar ($1.'00) paid. by each of the parties hereto to the o~her, the receipt of which is hereby acknowledged by each of ssi( parties hereto, GOODBODY & COMPANY, SULLVIVAN, NELSON & GOSS,' INC., ANDERSON COOK COMPANY, INC. agree ~o perform the following services: 1. Iq. 19. 56 2. Will confer and advise with the City Attorney and the approving bond Attorneys in preparing the financial program. 3. Will prepare and pay for a comprehensive brochure detailing the most advantageods financing setup for the proposed certificate issue, and all salient economic features of the City, and distribute the .same among investment bankers and 'investors for the purpose of securing a wide market and the lowest possible interes~ cost to the City for said certificates. /,.Will pay the following expenses incident to and. culminating in the issuance and sale of the proposed certificates: A. Legal fees and services of a nationally recognized firm of bond Attorneys who will prepare all resolutions and other validation papers necessary for validating of the certificates and issue the approving legal opinion. B-. Printing and delivery of the certificates to the City for proper signatures. C.All necessary advertising costs in a local newspaper and in the Bond Buyer. D. Fees of the Clerk of the Circuit Court for validation certificates. If the City shall follow all 'of the mterial recommendations made by the financial advisors, said financial advisors guarantee to submit a legal bid at public sale, in 1. ine with the market at the time of such sale, for all of the ~certificates being offered for sale. Until a bid acceptable to the City has been received and. accepted and thc certificates have been delivered and paid for, no compensation for services or reimbursement for expenses shall be due or paid to the financial advisors. IN CONSIDERATION of the premises and faithful performance by G00DBODY & CO., SULLI- VAN, NEI,SON AND GOSS, INC., and ANDERSON COOK COIqPANY, INC., of their obligations herein assumed, the City agrees that it will pay to said financial advisors a fee of Fifteen ($15.00) Dollars for the performance of such obllgatlons for each One Thbusand ~$1,000.00) Dollars revenue certificate sold and delivered. THIS CONTRACT ~hal! remain in full force and effect for a period of twenty four (24) months from date hereof, provided tb~t the ~erm. s of this Contract shall be extended beyond the expiration of such period until the completion of issue and sale of any certificates authorized by City hereunder prior to the expiration of such period. Sayer City Clerk Mr. Sidney Berkowitz, ~istrict representative of the State Board of Health, next advised of a recent appropriation by Congress, designated as Public Law 660, to be use~ fc~ granting up to ~0~ of cost of oonst~ucting treatment plants for cities ~ith population under 25,000, of which $900,000.00 of such appropriation h~d been set aside for Florida. He £~rther advised that none of Florida's appropriation had been used as yet, and it ~as possible that Sanford could get up to ~0~ of the cost of a treatment plant from this grant. MINUTES City Commission, Sanford, Florida, October 24, ~t 8 P. 1~I. 19 56 14i Thereupon Commissioner Wilson moved that the City Manager be authorized and instructe~ to obtain information and. the necessary forms for making application for a grant under Public Law 660 for constructt, ng a sewage treatmen.t plant, and also to request the State Board of Heal1 not to curtail the City's growth by not allowing any sewer extensions while the City is en- deavoring to find ways and means of financing the cost of constructing such treatment plant. Seconded by Commissioner Higginbotham and carried. Application next aubmitted from J'. W. Adams to purchase a block of the City owned property at Northwest corner of Commercial Street and Holly Avenue with f~ontage of 338 feet on Commercial Street and depth of 250 feet to be used for purpose of erecting a bonded ware- house thereon. After discussion, and on motion of Commissioner Wilson, seconded by Commissioner Higginbotham and carried, the Commlss~.on authorized the emplo~vment of A. B. Peterson, Sr., and Robert A. Williams, local realtors, to appraise the aforesaid property in order to ascertain its current market value for further consideration of the Commission.
