121256-Special Called Session MINUTES City Commission, Sanford, Florida, December 12 at 10 A. M.19 56 165 The City Commission of the City of Banford, Florida, met in special called session at the City Hall in the City cf Banford, Florida, at 10:00 A. M. December 12, 1956. Present: Commissioner F. D. Scott, Mayor " David M. Gatchel " Earl Higgi nbc tham " John B. Krider, Sr., " A.L. Wilson City Attorney W. C. Hutchison, Jr., City Clerk H. N. Bayer City Manager W. E. Knowles Meeting called to order by the Chairman who announced that the meeting had been calle, for the purpose of considering the matter of' the Fire Department refusing his request to ans- wer a fire call to the Mayfair Inn Country Club on night of December 11. Ail members of the Commission being present, Commissioner Higginbotham moved the waiver of the requirement of "Written Notice" of this called meeting, which was seconded by Commissioner Gatchel and carried by the following vote of the Commission: Commissioner Scott Yea " Gatchel Yea " Higgl nbc tham Yea " Krider Yea " Wil ~ on Yea Mayor Scott then reported that while attending the Mayfair Inn Country Club on dight of December ll, a tree caught fire near the clUb house, which was endangering it, and he calle~ the Fire Department to send the necessary equipment out to combat the fire. He stated that both t~ Chief and assistant Chief were absent from the station at the time he made the request ard that Lt. John Crow, who was left in charge, refused to answer the call Because the prop- erty was located outside the corporate limits and Mayfair Inn, Inc., had not filed application and 1he necessary insurance policy with the City to cover such fire service. Mayor Scott further advised that since the country club property still belongs to the City he felt that it was the City's duty to protect it, even though it is under a long term lease to Mayfair Inn, Inc.~ Also, that under the authority vested in him as Mayor, he felt that Lt. Crow should have carried out his instructions. After discussion, Commissioner Gatchel move'd that Lt. Crow be requested to appear before the Commission to answer as to under what authority he refused to answer a fire call to protect City owned prtperty, also, that the Fire Chief and assistant Chief be requested to ap- pear concerning both being absent at the same time, and as to instructions issued to the ordinates to act in an emergency during their absence. Seconded by Commissioner Wilson and carried. Consideration next given to the limited powers conferredyupon the Mayor by the City Charter, and after discussion, Commissioner Krider moved that the Commission proceed immedlatel to take the necessary action to amendthe Charter so as to provide for the election of the Mayor by the people, such amendment to be presented to the next Legislature for approval and adoption.
