M. r 195 The City Commission of the City of Banford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. February 25, 1957. On motion of Commissioner Higginbotham, seconded by Commissioner Warner and carried, minutes of regular m~eting of February ll, and special meeting or'February 16, 1957, approved. The next order of business 9as a Public Hearing to consider certain changes and amend- ments to t he Zoning Ordinance in accordance with the following notice published in the Sanford Heraid on February I and 8, 1957: NOTICE OF PLB~IC HEARING ON PROPOSED ~: CHANGES AND AMENDMENTS IN CERTAIN DIS- TRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD,FLORTDA. Notice is hereby given that a Public Hearing will be held at the office of lhe City Commission in the City Hall in the City of San- ford, Florida, at 8:00 o'clock P. M., February 25, 1957, to u n- sider the following changes and amendments to't he Zoning Ordinance of said Cl~y of Sanford, Florida: The property zoned in District R-1 (single- FamilY), located on North side of Second Street and bounded on east by north-south alley between Myrtle and Elm Avenues, and west by north-south alley between Laurel and French Avenues, is pro- posed t° be changed to R-2 (Multiple-Family) Dis- trict. Said property being more particularly described as Lots 9, l0 and ll, Block 3 Tier 6; Lots 6, 7, 8, 9, l0 and ll, Block 3 Tier 7; and Lots 6, 7 and 8, Block 3 Tier 8, of E. R. Traf- ford's Map of Sanford, Florida. All parties in ir~erest and citizens shall have an opportunity to be heard at said hearing. The Chairman then announced that the Commissi on would be glad' to hear from any in- terested parties in favor of, or against rezoning the property as proposed and described in the foregoir~ notice. There being no objections registered, Commissioner Higginbotham moved that the propert be rezoned as advertised, and that the City Attorney prepare the necessary ordinance for adoption. Seconded by Commissioner Scott and .carried. The next order of business was a Public Hearing to consider closing, vacating and abandoning a certain public street in accordance with following notice published in the Ban- ford Herald on February l, 1957: NOTICE OF PROCEEDING FOR VACATING, CLOSING AND ABANDONING A STREET TO WHOM IT MAY CONCERN: You will take notice that the City Commiss~n of the City of Sanford, Florida,~ at 8:00 P. Sayer, City Clerk The Chairman then announced that .the Commission would be glad to hear from anyone in favor of, or against closing, vacating and abandoning that portion of Fourth Street as describe in the foregoing notice. There. being no objections registered, Commissioner Higginbotham moved that the street be closed, vacated and abandoned as advertised, and that the City Attorney prepare the neces- sary ordinance for adoption. Seconded by Commissioner Scott and carried. The City Attorney next reported that the $400,000.00 Public Improvement Revenue Cer- tificates had been validated by Circuit Court, and arrangements were being made to have them ~y~ecuted by the City and delivered to the purchaser at the Florida State Bank on March 5. Thereupon Commissioner Higginbotham moved that the Architect be authorized to~roceed with preparing the plans and specifications on the civic center, fire station and~imming pool to be constructed under the Capital Improvement Program, and that the City Manager be authorized to advertise for bids on the equipment to be purchased under said program. Seconded by Commissioner Warner and carried. The City Manager next reported on City's application for federal aid under Public Law 660 toward cost of constructing a sewage treatment plant, advising that 38 Florida communities applied for such assistance, and that under the formula provided for priority, which is based (1) public health necessity; (2) wealth of community; and (3) cost of proposed project; san- ford is appros-imately 34~t~ in the list and will notbe eligible for aid until 1959-60 unless there is an increase in the' annual funds appropriated for this purpose. Consideration next given to proposal of Roland A. Sharp and Associates, Inc., Veto Beach, to make a survey and preliminary engimering report on City's sewage treatment re- quirements, for fee of $100.00, After discussion, and in view of City having already engaged Smith & Gillespie to make such survey and. report, the matter was 'taken under advisement, pending feasibility of report from said engineering firm. Messrs, J. C. Hutc~ison, H. B. Pope and Dr. J. B. Root of the General Sanford Memorial Library and Musseum Association ne~t appeared ~ with reference to the employment of a librarian for the Memorial Library. Dr. Root, as spokesman, advised that they h~d only three applicant~ whom they felt were qualified and capable of handling the position, and of the three, recommen~ that the City employ Mis~ Francina Flanigan of DeLand, who had agreed to commence at salary of $35.00 per week with hours from 2:00 to 5:00 P. M. He also advised that it was possible that Miss Flanigan might work in conjunction with the County School System, beginning next term, by working for the school in the mornings. After discussion the recommendatim was taken under advisement, pending an inter- view of the applicant by the City Manager. Mr. Pope, chairman c~ the building Committee, then advised ~hat they had completed the installatioK~ of the burglar alarm syst'em and flood lights on the building, but did not install iron bars on the windows because they did not feelit was necessary. M. 19. 57 On motion of Commissioner Higginbotham, seconded by Commissioner Wilson and carried, the City Attorney was next directed to prepare an appropriate resolution of thanks and appre- ciation to Mrs. Carola Dow for her gift of General Sanford's Library, paintings, etc.,, to the Ci ry. Request ne×t submitted from Arcade Package Store for use of the public alley next to place of business at 310 E First Street to provide a drive-in for a proposed window s~rvice for customers. The City Manager then pointed out that public alleys are provided to service the store~ and not for the stores to provide service for their customers. Also that the alley in questio~ is only 14 ft in width, which is not sufficient 'for passing of vehicles. Commissioner Scott voiced his objections to ~Pranting the aforesaid request, stating that it would be establishing a precedent for other businesses that may wish to provide simila~ service, and that the downtown alleys are too conJestlve for such usage. Commissioner Gatchel concurred with C~mmissiomr Scottand said that he did not feel the City had legal right to ~ant the use of alleys for ~ch purpose. Commissioner Higginbotham spoke in favor of allowing the alley to be used for providin a drive-in to the proposed window service, and after considerable discus~i on, moved that the request be granted, which was seconded by Commissioner Warner and carried 6vet the dissenting vote of Commissioners Scott and Gatchel. Commissioner ~igginbotham ne×t introduced Ordinance No. 60~ entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING SECTION lC-l, THE CODE OF THE CITY OF SANFORD, FLORIDA, 1954, SAID SECTION PROVIDING FOR THE ADOPTION OF FIRE PREVENTION CODE, SAID AMENDMENT PROVIDING FOR ADOPTION OF FIRE PRECENTION CODE DATED 1956. and same was placed on its first reading and read in full. Commissioner Higginbotham then moved the waiver of the requirement of the second reading of said Ordinance No. 604, and ~hat same be placed on final passage and adoption. Commissioner HigginbotPmm next introduced Ordinance No. 605, entitled: MINUTES City Coram~ssion, San£ord, Florida, February at 8 P.M. 19 57 AN ORDINANCE OF THE CZTY OF SANFORD, FLORIDA, ANENDING SECTION ~-l OF THE CODE OF THE CITY OF SANFOBD, FLORIDA 1955, SAID SECTION PROVIDING FOR ZONING OF THE CITY OF SANFORD DESIGNATING ZONES IN ' WHICH INTOXICATIMG LIQUORS MAY BE SOLD, SAID AMENDMENT ADDING AD- DITIONAL AREAS THERETO FOR THE SALE OF INTOXICATING LIQUORS. and same was placed on its first reading and read in full. Request ne×t submitted from Mrs.' Esther Ridge, 837 Rosalia Drive, for City to close and vacate the north-south alley immediately west of her property, and offering in exchange a right of way for e×tendlng the east-west alley across the back-, After discussion, and on recommendation of the City Manager, Commissioner Hig~inbotham moved that a public hearing be held at 8:00 P.~,, March 25, 1957, .to consider closing and vacating the aforesaid alley. ~Seconded by Comm~.ssio~r Wilson and carried. Letter next submitted from Nunicipal Judge Leonardy advising that he had reviewed the case of Nfs. Eugenla Fritz who was charged with "improper parking" for parking on w~ong side of street, and assessed a fine of $10.00 and $1.00 cost in Nunicipal Court on February 18, Case No. 56175; and recommended that the sentence be suspended. After discussion, in which it was felt t~at the fine was e×cessive, Commissioner Wilson moved that $9.00 of the fine be refunded to Mrs. Fritz. Seconded by Commissioner Warner and carried. Commissioner Scott then moved that the balarce of sentence be suspended and the $2.00 fire refunded. Seconded by Commissioner Hlgginbotham and carried. The City Manager next submitted the following report and recommendation for adding lime to the municipal water system to neutralize the acidity which is causiug rust and rapid failure of water heaters: Extensive tests and inquires have been made as to the trouble and means of controling the city water ~upply and its effect on hot water heaters~, The trouble appears to be dissolved iron in the water that is only slightly above the average. Upon entering a heating unit, and not .until then, it appears that the change of temperature 'multiplies the corrosive action and it attacks the metal of the heater tank. Two solutlons were proposed: a. By the addition of 6 ppm of caustic soda and 2 ppm of sodium hexa- meta phosphate. Operating.~costs woUld be approximately $9.12 per day. Equipment costs are $1,275.00. b. By ~he addition of lime a~.~.an operating cost of approximately $2.00 per day. Equipment costs are $1,275.00. Both systems are relatively ~he sa~e as far as effectiveness is concerned. System a. is no doubt easier to handle physically so far as the Plant personnel are concerned.. However, it, is recommended tha~t system b. woUld be used. Approximately $200.OOinStallatlon cost plus equipment cost of $1,120.00 would make a total of $1,~20.00 olus the operation fo~ the first year of $800.00. Total - $2,120.00. If such a system is desired, it is recommended that it be approved and held for the re xt budget as this year's Utility Budget will be very close. After consideration Commissioner Higginbotham moged the approval of the foregoing recommendation, and that the equipment be purchased and installed as soon as practicable. Seconded by Commissioner Scott and carried. Letter ne×t submitted from Dr. Wade H. Garner, whose office is in the Touchton Bldg., requesting the Commission to reconsider and rescind the action taken at meeting of January 21, eliminating the "reserved spaces for doctors" and setting an annual fee of $90.00 for parking privileges in any availab~ parking stall Without depositing money in the meter. He stated that the doctors felt such action was premature and unfair because all of the physi- cians make emergency calls in addition~ to taking turns on emergency calls to ~he hospital; that such arrangements would be impracticable because most of the time an empty parking space .MIN.UTES City CommiSsi°n, Sanford, FlOrida, February 25 at 8 P. M. 19 57 would not be available exoep~ probably blocks away from the office; and ~hat he would not pay ~his fee unless a space was reserved for him. Thereupon Commissioner Higginbotham moved, in view of' the Commission having had ~his mat~er of "reserved spaces for doctors"' under discussion and consideration for a number of years before taking such action, that the' letter be tabled and 1he City Manager notify Dr. Garner ~hat it was read before the Commission· and his viewpoints well taken,' but the City has to consider all citizens and each given fair and equal privileges. Seconded by Com- missioner Scott and carried. On motion of Commission~ Scott, seconded by Commissioner Warner and carried, a re- quest for addi~tonal street lights in Franklin Terrace was referred to ~he City Manager and Chief of Police for recommendation.
