The City Commission of the City of Sanford, Florida, met in regular session at the Ctty Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. July 22, 1957. Present: Commissioner David M. Commissioner Higginbotham introduced Resolution No. 898, and after being read in full moved its passage and adoption, Seconded by 0ommlssioner Wilson and carried by the followirg vote of the Commission: Commissioner Gatohel Aye " Hlgginbotham Aye " Scott Aye " Wilson Aye Said Resolut~n No. 898 .being in words and figures aa follows; A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BANFORD, FLORIDA, PERTAINING TO CONSTRUCTION OF SEWAGE TREATMENT PLANT IN SAID CITY AND PERTAINING TO EXTENSIONS AND CONNECTIONS TO THE EXISTING SEWER SYSTEM OF THE CITY OF SANFORD, FLORIDA ACCORDING TO REQUIREMENTS OF THE STATE BOARD OF HEALTH OF THE STATE OF FLORIDA. WHEREAS, The State Board of Health of the State of Florida has directed a notice to the City Commission of the City of Banford, Florida, stating that all major extensions to the existing sewage system of the City of Sanford, Florida will not be approved by t he State Board of Health until such time as a primary sewage treatment plant is constructed, and WHEREAS, Without such approval by the State Board of Health the continue growth and ex- pansion of the City of Sanford will be greatly curtailed to the detriment of said city and its people, and WHEREAS, An agreement has been reached with the State Board of Health pertaining to construction of a primary sewage treatment plant, and additional extensions and connections to the existing sewer system of the City of Sanfo~d, Florida, which said agreement is found by the City Commission of the City of Sanford, Florida to be in the best interests of said city and its people. NOW THEREFORE, BE IT RESOLVED By the City Commission of the City of Sanford, Florida that the following agreement be and the same is hereby adopted by the City of Banford with the State Board of Health, to-wit: That for and during the next two years from the date of this Resolution the City Commission will deposit in a sewage treatment plant sinking fund the sum of Forty Thousand Dollars ($~,000.00) annually, reaching a total in two years of Eighty Thousand Dollars ($80,000.00) for the express purpose of futUre con- etruction of a primary sewage treatment plant in the City of Sanford, Florida. That in the event a revenae certificate issue cannot be issued for the express purpose of building a primary sewage treatment plant in the City of Sanford, Florida by Novemeher~l, 1958, the City Commission agrees that a general obli- gation bond program for the purpose of sam com truction will ~be submit ted to the people of the City of Sanford, on referendum for approval. The City agrees ~hat until such time as a primary sewage treatment plant is constructed in the City of Sanford, Florida, that no major extensions of said present sewer system of z he City will be effected a nd no subdivision ad- ditions to said sewer system will be allowed wither interim sewage treatment to be approved by the State Board ~ Health. The aforesaid is conditioned upon the allowance by the State Board of Health of the con- neotion to the present sewer ay.stem of the City of Sanford, Florida, w~thout said primary MINUTES City Commission, Sanford, Florida, July 22 at 8 P.g. 19 ~? constructed by Mr. ~aorge Garrison, provided that the said Mr. George Garrison construct a five thousand gallon tank for the purposes of the removal o f solids from the sewage from said homes prior to the time said sewage enters the existing sewer system of the City cf Sanford, Florida. BE IT FURTHER RESOLVED, That a copy of this Resolution be spread upon the minutes of t he City Commission of the City of Sar~ ord, Florida and copies thereof forwarded to Mr. Ge~ge Garrison and the State Board of Health. Reborn, Jr., next presented a resolution from this organization citing the inherent perils associated with the many areas, of restricted visibility of motorist due to high hedges, bushes and other growth on parkways, and requested that all ordinances pertaining to control of these hazards be enforced, and to enlist the public to maintain these areas in a manner consistent with safety and beauty. Mr. T. McDonald also spoke in favor of enforcement of these controlling ordinances. Mr. Mason Wharton also spoke in favor of seeking cooperation of the public in voluntarily correcting these hazards. Moved by Commissioner Higginbotham, to accept the Jaycee's resolution, and to enlist the aid of the Jayceee, ralo and press, for a thirty-~ay publication period, seeking cooperation of home owners and business houses, and after this period the Jaycees to repc~t back to the Commission the rate of progress acheived. After thirty-days, notice will be made by the City Manager, and enforcement to be made by City crews. Seconded by Commissioner Wilson and carried The next order of business was a Public Hearing to consider closing, vacating and abandon lng a certain public alley in accordance with the following notice pu~lished in the Sanford Herald on June 27, 1957: NOTICE OF PROCEEDING .FOR ..V,.ACATING AND CL0SiNG',AN TO WHO IT MAY CONCERN: You will take notice that the City Commission of the City of Banford, Florida at 8:00 P, M. on July 22, 1957, at the City Commissicners' Room at the City Hall in the City of tanford, Florida, will consider and determine whether or not the City will close, vacate and abandon any right of the City and the public in and to the land delineated on a plat as an alley and recorded in the Public Records of Seminole County., Florida, maintaining in lieu thereof an easement for public utilities, which said alley is more particularly ~scrlbed as follows: That certain alley running east and west from Mangoustine~ Avenue easterly to the west line of Lot 25, Graceline Court, thence extending north to First Btreet, and bounded on the south by Second Btreet in the~City-of. Banford, Florida. Persons interested may appear and be...~eard at the time and place above specified. CITY COMMISSION OF THE CITY OF BANFORD, 1P? .t~ I~T rlA 264 MINUTES City Commission, Sanford, Florida, ffuly 19 57 The Chairman then announced that the commission would be glad to hear from anyone of in favor~ or against closing, vacating and abandoning the alley described in the foregoing notice. : Ur. Fred George, owner of lots 1 thru 17, and lots 33 th~u 35, Graceline Cc~rt, abutting said alley next appeared and registered his objection to the above action. Commissioner Higginbotham moved, that in view of the objection presented by Mr. Fred George, the above described alley remain open to the public. Seconded by Commissiener Wilson and carried. Mrs. Jimmie Horton, owner of property on Cedar Avenue and 24th Place next appeared and objected to receiving a notice dlrect&ng~ her to have her property cleared of undergrowth, unless all properties in the City. were brought up to this condition. City Manager Knowles explained that this notice was Just. an office procedure based upon a complaint received in his office. Mrs. Horton also made referenc~ to the shrubbery and grounds at the cemetery not being kept satisfactorily. City Manager knowles pointed out that the City has only one part- time employee working at the cemetery, and that the Park~ crew of 4 men have 57.8 acres of park~ in the City to maintain. Application next submitted from Thomas Prevatt for permit to sell beer and wines, for consumptlnn off the premises, at 1317 W 13th Street, and on motion of Commissioner Higgin- botham, seconded by Commiss&oner Scott and carried, same was approved upon ~recommendation of Chief. of Police. Application next submitted from Claude E. Sessions for permit to sell beer and wines, for consumption off t.he premises, at 1201 W First Street, ar~ on motion of Commissioner Higginbotham, seconded by Commissioner Scott and Carried, same was approved upon recommendatiol of Chief of Police. Application next submitted from Maria Leonls for transfer of liquor package aZore permit for consumption off the premises, from her deceased father, Nick Constantine, d/b/a Nick's Package Store, $10 Sanford Avenue, and on motion of Commissioner Higginbotham, seconded by Commissioner Sco~t and carried, same was approved upon recommendation of Chief of Police. City Manager Knowles reported his office had received several calls from home owners in the neighborhood of Lot A, Sanfo Park, requesting the City to utilize this area, approxi- mately 260' x 400', which was given to City for a hospital site. After consideration, Commissioner Hlgginbotham moved that this area be converted into a Public Park and playground, seconded by Commissioner Scott and carried. Consideration next given to the traffic signal and pedestrian walk signals at Park ~ Avenue and First Street, and after discussion, moved by COmmissioner Higginboths~, seconded by Commissioner Scott and carried, to change the Pedestrian control light to "Walk" when the traffic control light is Red, so that the pedestrians may walk with the traffic.
