City Hall in the City of Sanford, Florida at 8:00 o'clock P. M. on February 17, 1958. Present: Commissioner' Merle Warner, Mayor " R. $. Brown " D.M. Gatchel " Earl Higginbotham " A.L. Williams The Meeting was called to order by the Chairman. The first order of business was a Joint discussion with the Commission of the Banford Housing Authority, Gordon Bradley, Manager, and George Bpeer, Attorney, pertaining to the maintenance of sewer lines within the Housing Project. The City Attorney pointed out that the sewer lines under consideration are located on the private property of the Housing Authority and that the City was obligated to furnish sewer facilities only to the boundaries of this private property. George Speer, attorney for the Sanf ord Housing Authority, next appeared, stating that his interpretation of t he agreement with the City, was that the City should maintain the feeder lines running through the project to the trunk lines outside the project. Gordon Bradley, Manager, stated that in the past the Housing Authority had maintained the lines from the dwelling to the feeder line and that the City had serviced the feeder lines through the project. After further consideration, the Commission informed the Housing Authority that services made to the sewer lines within the projects would be made on a cost basis to the Authority and that proper author{zation to perform such services should be on file in the City's records. Howard Montelth spoke in appreciation of the cooperation of the City and the desirability of future mutual cooperation. Mr. Monteith also requested the Commission direct their atten- tion to the condition of the boundary streets of the projects. The City Manager pointed out t~at some repairs to these boundary streets was set up in the schedule of street work for this year. Brailey Odham of Odham & Tudor, next appeared and stated that although his option to purchase the 55 acre tract located south of the corporate city limits at a price of $500.00 per acre had expired, however he would now like to purchase this property at the above price. After discussion, moved by Commissioner Higginbotham to sell this 55 acre tract for $27,500.00 payable in the sum of $13,750.00 on March l, 1958 and $13,750.00 on May 15, 1958. Seconded by Commissioner Brown and carried. Mr. Odham then stated that his firm had received permission from the State Board of Health to connect the sewer system of Sunland Estates project with the City sewer system. The construction of the forced main to make this connection was now in progress at an estimated cost of $45,000.00. Mr. Odham further stated that he would agree to deed to the City the en- tire sewage system of Bunland Estates for one half the cost of the construction of the forced main or approximately $22,500.00, to be paid entirely by rental of City equipment to Odham & Tudor, Inc., and further that his company would collect the sewer charges assessed to each residence and remit same to the City. Moved by Commissioner Higginbotham, seconded by Commissioner Gatchel and carried, authori- zinc the City Manager and City Attorney to prepare an agreement embodying the aforementioned --I MINUTES City Commission, Sanford, Florida, February 17 at 8 P. M. 19 58 349 proposal of Mr. Odham. Next order of business being the consideration of a franchise to the Sanford Gas Company. The City Manager submitted a copy of franchise used by the City of DeLand. After consideration said franchise was referred back to the City Manager and City Attorney to include the following chages: 1. Right of inspection - by City pers'o.nn'el or representative. 2. 20 year term. Secure permit prior to enterirg any Stree.t or Alley, except for emergency repairs. Action under paragraph 13 to be covered by performance bond. 5. 'Collection from Utility Tax to be delivered to City wlthin'i~ 30 days after it is received, failu~ results in cancellation of franchis e. 6. City ~o have the privilege to audit records of Company. Letter next submitted from Lee Brothers Plumbing and Heating Contractors in offer of $10,333.00 for property under consideration for purchase. After discussion, moved by commissioner Gatchel to sell one half of the 250 foot parcel on French Avenue and the entire block 1N, Tier lC, for the sum offered, $10,330.00. Seconded by Commissi cn er Wilson and carried. Report next submitted of an inspection of ~he Yacht Club by City Manage~, Building In- spectior and the Director of Public Works, outlining the defects in the present structure. After discussion, the City Nanager was directed to forward same to the Sanford Boa~-and Ski Club for t heir consideration. There being no further business t he meeting then adjourned until 8 P.M.
