022458-Regular Session MINUTES City CommiSsion, Sanford, Florida, February 24 at 8 PN19 58 The City Commission of the City of Sanford, Florida met in regular session at the City Hall in the City of Sanford, Florida at 8:00 P. M'. on February 24, 1958. Present: Commissioner Merle Warner, Mayor " R.S. Brown " D.M. Gatchel " Earl Higginbo tham " A.L. Wilson City'Attorney W. C. Hutchison, Jr., City Clerk H. N. Sayer City Manager W. E. Knowles Deputy Clerk H. N. Tamm, Jr., Police Chief R. G. Williams The meeting was called to order by the Chairman. The First order of business beihg a oubllc hearing to consider rezon~g the property as proposed and described in the following legal "Notice" published in'the Sanford Herald on'FeBruary 3, 1958: NOTICE OF PUBLIC HEARING ON PRDPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ~ORDINANCE OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at the office of the City Commission in the. City Hall in the City of Sanford,'Florida, at 8:00 o'clock P. M. February 24, 1958, to consider the following changes and amendments to the Zoning Ordinance of said City of Sanford, FlOrida: (a) The pr6Perty zoned in'District C-1 (Commercial-Retail), located on South side o~ Celery Avenue between Locust Avenue and Mellonville Avenue, is proposed to be changed to R-1 (Single-family) District. Said property being more particularly described as Lots i and 2 Block 9, San Lanta, Second Section; Lots 2, 4 and 6 of Block E; Lots l, 2, 3, 4, 5 and 6 of Block F; and Lots l, 2, 3, 4, 5 and 6 of Block G, Celery Avenue Addn., and the NorZh 120 feet of the unplatted part of the Northwest ~uarter of Section 31, Township 19 South, Range 31 East. (b) The~property zoned in District R-1 (Single-family) located .on West side of fan'View Ave., between 25th Street and 25th PlaCe, is proposed, to be changed to C-1 (Commercial-Retail) District. Said property being more particularly described as Lots ~0 to 38 inclusive, of BlOck 1 Palm Terrace. All parties in interest and citizens shall have an opoortunity to be heard at said hearing. The Chairman then announced t hat the Commission would be glad to hear from anyone in favor of, or against rezoning the ~roperty as proposed and aescrlbed in paragraph (a) of the foregoing notice. ¢ There being no objections registered, Commissioner Brown moved that the property des- cribed in paragraph (a) be rezoned as advertised. Seconded by Commissioner Ga~chel and carried. The Chairman then announced that the Commission would be glad to hear from anyone in favor of, or against rezoning the property as proposed and described in paragraph (b) of the foregoing notice. Mr. Scott Burns, District Manager for Florida Power & L~t Company, appeared in favor of the oropos'ed rezoning and pointed out the need in the near future for a sub-station in this area. M. 19.58 Request next submitted from Lee Brothers Plumbing and Construc~on Company to continue con- sideration of the property on North French Avenue until March 10, 1958, and moved by Com- missioner Gatchel, seconded by Commissioner Wilson and carried on approval of the request. The City Nanager reported that Mrs. Keel of DeBary had complain ed of tripping over a weight machine in fro~ of Kel's store at 201 E'First Street, and that she had suffered torn hosiery and a bruised leg, however, it was not necessary to contact a physician. Mrs. Keel requested $50.00 damage. After consideration of the circumstances, moved by Commissioner Gatchel, seconded by Commissioner Higginbotham and carried to deny the claim. After discussion, moved by Commissioner Higginbotham, seconded by Commls sioner Gatchel and carried on the appointments to the Board of Examiners of Electricians for 1958 of E. C. Harper, Sr., E. L. Burns and Modesto Velez. After considerable discussion, moved by Commissioner Wilson, seconded by Commis~oner Gatchel and carried over the dissenting vote of Commissioner Higginbotha~, the City Manager and Police Chief were authorized to enforce the compliance of Kindergartens and Nurseries with Section 15-13 paragraph 285, of the City Code, controlling the issuance of an occupationa license for this business. Commissioner Higginbotham next introduced Ordinance No. 631, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, CLOSING, VACATING AND ABANDONING THAT PORTION OF THAT CERTAIN NORTH-SOUTH ALLEY BETWEEN PARK AVENUE AND OAK AVENUE EXTENDING FROM 25TH STREET NORTH TO THE NORTH PROPERTY LINE OF LOTS 7 AND 23, OF PINE HEIGHTS SUBDIVISION, ACCORDING TO PLAT THEREOF RECORDED IN PLAT BOOK 3, PAGE 51, PUBLIC RECORDS OF SEMINOLE COUNTY, FLORIDA, IN THE CITY OF SANFORDi; FLORIDA. and sa~e was placed on its first reading and read in full. Commissioner Higglnbotham then moved the waiver of the requirement of the second read- ing of said Ordinance No. 651, and that same he placed on final passage and adoption. Seconded by Commlssio.ner Gatchel. Thereupon the question recurred upon the waiver of the second reading, the roll 'was called and the vote stands as follows: Commissioner Warner Yea " Brown Yea " Gatchel Yea " Higginbotham Yea · " Wilson Yea Said Ordinance ~o. 631 was then placed on its final passage and adoption, the roll was called and the vote stands as follows: Commiss loner Warner Yea " Brown Yea " Gatchel Yea " Higginbotham Yea " Wilson Yea Thereupon the Chairman announced that the City Commission of the City of Sanford, Florida by unanimous vote had passed and adooted said Ordinance No. 6~1, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, CLOSING, VACATING AND ABANDONING THAT PORTION OF THAT CERTAIN NORTH-SOUTH ALLEY BETWEEN PARK AVENUE AND OAK AVENUE EX- TENDING FROM 25TH STREET NORTH TO THE NORTH PROPERTY LINE OF LOTS ? AND 25, OF PINE HEIGHTS SUBDIVISION, ACCORDING TO PIAT THEREOF HECORDED IN PLAT BOOK 3, PAGE 51, PUBLIC RECORDS OF SEMINOLE COUNTY, FLORIDA, IN THE CITY OF BANFORD, FLORIDA.
