092258-Regular Session MINUTES City Commission, Sanford, Florida,, September 2'2 at 8 P.M. 19_ 58 The City Commission of the City of Sanford, Florida met in regular session at the City Hall in the City, of Sanford, Florida at 8:00 o'clock P. The first order of business being a Public Hearimg to consider rezoning the property as proposed and described in the following legal "Notice" published ~in the Sanford Herald on September 1, 1958: NOTICE OF PUBLIC HEARING ON PROPOSEI~ CHANGE AND AMENDMENT IN CERTAIN DISTRICT AND BOUNDARY OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at the office of the City Commission in the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. September 22, 1958, to consider the following change and amendment to the Zoning Ordinance of the City of Sanford, Florida: The Property zoned in Districts R-1 and R-1-A (Single Family) located on WeSt side of Mellonville Avenue between 8th Street and llth Street, is proposed to be changed to R-2 (Multiple- Family) District. Said property being more particularly dee- cribed as the South 89 feet of Lot 4, and all of Lots 5 and 6, of Ella A Pace's Subdivision. All parties in interest and citizens shall have an opportunity to be heard at said hearing. By order of the City Commission of the City of-Sanford, Florida, this 29th day of August 1958. s/ H. N. The Chairman then announced t hat the Commission would be glad to!~hear from anyone in favor of, or against rezoning the property as proposed and described in the foregoing notice. There being no objections registered, Commissioner Higginbotham moved that the property described be rezoned as advertised. Seconded by Commissioner Brown and carried. Philip Zeuli and Wm Stemper, Realtor, next appeared, in interest of vacating and abandoning alleys located between 18th and 20th Street and Marshall and Chase Avenues. Mr. Zeull stated that many of the newer subdivisions did not have alleys but Just utility easements, and that he is going to construct houses valued from $11,500.00 to $14,000.00 and that it would lower their salability if alley is not closedl The City Manager pointed out that it cost more to service residences for garbage and trash pickup ~here there is no alley, and also that it makes the fogging for mosquito and insect control less effective. After considerable discussion, moved by Commissioner Brown to hold a Public Hear- ing on October 13, 1958 to consider vacating and abandoning the North-South and East-West alleys between 18th and 20th Streets and Chase Avenue and i',iMa.~hall Avenue, extended, and the East-West alley Between 18th & 20th Streets and Chase Avenue and Lake Avenue. Mack Cleveland, Jr., President-elect for the ensuing year, next appeared to outline the objectives of ~he Chamber for this period and further stated that if the $2,500.00 decrease is ,allowed to remain that it would pro. bably be a handicap in the forthcoming membership drive. N. L. Raborn, next appeared supporting the Chamber and th.e need for it in order to maintain the h~g h standard of business now existing. Ha!'Old~Kastner;:~ produce dealer, next appeared and stated that through the efforts of the efforts of the Chamber that a vacuum cooler for lettuce had been obtained at the State Farmers Market in Sanford. William Stemper next apoeared and spoke of the cooperation within the Chamber and regrett, to see any curtailment of their activities. George Stlne next appeared and stated that if the money is curtailed from the City, the Chamber would not be able to continue to do t~e good Job that has been received in the past. John Krider next appeared and spoke of the work of the Chamber and the advertisement of the City in various publications as a result of the Chambers efforts. After considerable discussion, moved by Commissioner Higglnbotham to transfer from the Contingency Fund Account No. 8150 to the Appropriati~ for the Chamber of Commerce Account No. 8134-1 the sum of $2,500.00. Seconded by Commissioner Brown and carried. Mr. john Krider next appeared and reported that a substantial business concern with the necessary capital to construct a completely aireonditioned building of 8,000 square feet would like to purchase.the north half of Block 6, Tier 13' E. R. Traffords Map, for said building. After consideration, moved by Commissioner Higginbotham, seconded by Commissioner Brown and carried, the Commission authorized sale of said property for the sum of $500.00, title to be held in escrow until completion'of construction. After consideration, moved by Commissioner Higginbotham, seconded by Commissicner Brown and carried, to hold a Public Hearing on October lB, 1958 to consider~rezon~ng~Bl°ck 6, Tier lB, E. R. Traffords Map, from District'R-1-X (Single-Family) to C-2 (Commercial-Industrial). The City Manager next submitted t~e following tabulation of bids which were opened pub- licly at 2:00 P. M. September 22, 1958, for furnishing paving in accordance with the specifi- cations in the invitation for bids published in the Sanfor~ Herald on September 12, 1958. Miller Paving Co., $7.88 per ton 9.50 per ton 9.85 per ton ~0.~5 per ton 10.45 per ton After discussion, Commissioner Higginbotham moved the acceptance of the low bid, that of ~he Orlando Paving Company for $7.88 per ton, ~o furnish ~he aforementioned paving in amount of 7,488 tons for $59,005.44. Seconded by Commissioner Brown and carried. Recommendation next submitted from the Zoning and Planning Commission to rezone the following: a. b. From R-1 a~d R-lA to R-2, Block 28, Mellon~ille Subd. Commissioner Wilson next introduced Resolution No. 915, and after being read in full, moved its passage and adoption. WHEREAS, The City Commissim of the City of Sanford, Florida, deems it.necessary, ex- pedient, and for the best interest o~ said City that any unexpended cash surplus as of September 30, 1958, of the operating revenues of said City for the fiscal year 1957-1958 be appropriated for the ordinary purposes and operating~::expense of said City in the budget for the fiscal year 1958-1959. NOW THEREFORE, BE IT RESOLVED By the City Commission of the City of Sanford, Florida, that any unexpended cash surplus as of September 30, 1958, of operating revenues of said City for the fiscal year 1957-1958, be and the same is hereby appropriated to the Depart- ment of General Government of said City for the ordinary purposes and operating expenses of said City for l;he fiscal year 1958-1959, and said cash surplus shall be incorporated in the budget of revenues and expenditures of said City for said fiscal year 1958-1959 f~ the ordinary purposes and operating expenses of said City. BE IT FNRTHER RESOLVED That upon collection of any revenues cf said City, the City Clerk shall alloca~te.: from each dollar collected and received, the several amounts to the respective funds for purposes for which the same are hereby authorized and appropriated. The City Manager reported that Mr. Brailey 0dham had agreed to pay for the extension of the fire service 'to October 15, 1958.
