The City Commission of the City of Sanford, Florida met in regular session at the City Hall in the City of ~anford, Florida, at 8:00 o'clock P. M. on January 26, 1959. Present: Commissioner A. L. Wilson, Mayor II Joe B. Baker " Robert S. Brown " Earl Higginbotham II Merle Warner City Attorney Wm. C. Hutchison, Jr., City Manager W. E. Knowles City Clerk H. N~ Tamm, Jr., Police Chief R. G. Williams r- The meeting was called to order by the Chairman. Request next submitted rrom P. R. Rieboldt for a three-year lease of the Bandshell and Pier to set up a business to provide boating dockage, storage, fuel and supplies. Mr. Rieboldt proposes to close-in the Bandshell and repair the piers. After considerable discussion, Mr. Rieboldt was requested to present a comprehensive plan of types of construction that would be used for boat storage and dockage, an outline of a repair program, and an ~stimate of his proposed investment; thereafter, the Commission would give the plan further consideration. Tom McDonald, President of the Sanfora-Seminole County Chamber of Commerce, next appeared to request that the $210.00 reduction in their budget 'appropriation be reinstated ana outlined projects in which his association has participated and their costs. Art Harris next appeared to report that the Jaycee Information Booth would be finished in February, and have paid for all materials used. ,..,... After discussion, moved by Commissioner Higginbotham, seconded by Commissioner Brown and carried, authorizing the transfer of $210.00 from the Contingency Account No. 8150 to Publicity Account No. 8134 (2), Jaycees. R. H. LeFils, owner of a salvage yard at 1715 W 3rd Street, next appeared, stating he had received a 30 day notice to vacate as he was'not conforming to the Zoning Code. He further stated that his neighbors have not objected to his business and that it would be an extreme hardship to comply with the order. After consideration, and on motion by Commissioner Baker, seconded by Commissioner Brown and carried, the Commission authorized an extension' of the order to vacate for a six months period. After discussion, and on motion of Commissioner Higginbotham, seconded by Commissioner Warner and carried, the Commission appointed H. N. Brown and carried, the Commismon approved the reclassification and advances as follows: Street Supt. $4,772.00 4,328.00 Sewer Supt. Edgar L. Griffith, from 23-C to 23-D at Robert Kelly, from 20-C to 23-B at ,..,... Pursuant to a Public Hearing held on October 14, 1957, the Commission approved Vacat- ing and abandoning a portion of Rose Street in consideration of the City being deeded the South 50 feet of Lots 5 and 6 of Block J, Neaves Addition. Said deed dated January 17, 1959 recorded in Book 208, Page 285, has been received by the City. Commissioner Brown next introduced Ordinance No. 667, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA CLOSING, VACATING AND ABANDONING THAT PORTION OF ROSE STREET IN THE CITY OF SANFORD, ]'LORIDA FROM ITS INTERSECTION WITH CHAPMAN AVENUE EAST TO ITS INTERSECTION WITH LOCUST AVENUE. 47:1 ~'\ 'i I I I ;- ( '472 I i 1 MINUTES City Commissio,n, Sanford, Florida, January. 26 at 8 P.. M. 1959 Commissioner Brown then moved the waiver of the requirement of the second reading of Ordinance No. ,667, and that same be placed on final passage and adoption. II II Wilson Baker Brown 1rIi ggi n bo t ham Warner Yea Yea Yea Yea Yea Thereupon the Chairman announced tha t the Ci ty Commission of the Ci ty of Sanford, Florida, by unanimous vote had passed and adopted said Ordinance No. 667, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FL8RIDA CLOSING, VACATING AND ABANDONING THAT PORTION OF ROSE STREET IN THE CITY OF SANFORD, FLORIDA FROM ITS INTERSECTION WITH CHAPMAN AVENUE EAST TO ITS IN'l'ERSECTION WITH LOCUST AVENUE. After consideration and on motion of Commissioner Higginbotham, seconded by Commissioner Baker and carried, the City Attorney was authorized to prepare for ~he Legis- lative Delegation, a Local Bill amending the City Charter setting up a qualifying fee for each Candidate for City Commissioner of 5% of the yearly salary. After consid. eration and on mot ion of Commis sioner Higginbotham, seconded by Com- missioner Warner and carried, the Cdlty Attorne y was authorized to prepare for the Legis- lative Delegation a Local Bill amending the City Charter Section 173,Claims Based on Tort, to cover any and all negligent acts. Af1:;e:r;oi.,9.isqussj;on, the City Manager was authori zed to contact the County Commies iouers pertaining to resurfacing 20th Street from the City Limits to French Avenue. After consideration, moved by Commissioner Warner, seconded by Commissioner Higgin- botham and carried to transfer $273.63 from Contingency Account No. 8150 to Recreation Account No. 4226, Equipment, to cover difference in expenditure and appropriation for a new Station Wagon. After discussion and on motion of Commissioner Higginbotham seconded by Commissioner Warner and carried, the Commission authorized purchase of a full page Ad in amount of $157.92 for the Sanford Herald Mail-away Edition, and a transfer of $131.08 from Contingency Account No. 8150 to Publicity Account No. 8134 to cover over-expenditure for same. On motion of Commissioner Warner, seconded by Commissioner Higginbotham and carried, the City Manager was authorized to attend a meeting of the Florida League of Municipalities in Jacksonville, Florida, on February 21 and 22, 1959, and the City Clerk was appointed to act as City Manager during his absence. After discussion, and on motion of Commissioner Warner, seconded by Commissioner Baker and carried, tennants in the two City owned houses on North Maple Avenue were given notice to vacate, due to land having been sold to Lee Brothers Company. On motion of Commissioner Higginbotham, seconded by Commissioner Warner and carried, the City Manager was authorized to attend a meeting on the proposed Police Retirement system in Tallahassee. Elton Moughton and Melvin Siskind next proposed for a Public Off-street Parking Lot an" area between 3rd and 4th Streets and Sanford am Cypress Avenues at an estimated cost of $25,000.00, and after discussion and on motion of Commissioner Higginbotham, seconded by Commissioner Warner and carried, the proposal was rejected. After considerat'bn, moved by Commissioner Warner, seconded by Commissioner Higgin- botham and carried, approving a'water service agreement withthe Sanford Housing Authority.
