060859-Regular Session 508 MINUTES City Commission, Sanford, Florida, June 8 at 8 P. M. 1922 The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on June 8, 1959. Present: Commissioner A. Williams The meeting was called to order by the Chairman. The first order of business being a Public Hearing to consider vacating and abandon- ing a portion of a public utilities easement in accordance with the following notice published in tte Sanford Herald on May 19, 1959: TO WHOM IT MAY CONCERN: You will take notice that the City Commission of the City of Sanford, Florida, at 8:00 P. M. on June 8, 1959, at the City Commissioners Room in the City Hall in the City of Sanford, Florida, will consider and determine whether or not the City will close, vacate, renounce, disclaim and abandon any right of the City and the public in and to the land de- lineated upon a plat as a public utilities easement, which said public utilities easement is more particularly described as follows: THAT CERTAIN PUBLIC UTILIrrIES EASEfiIENT EXTENDING FROM THE SOUTHERLY PROPERTY LINE OF LOTS 2 ABD 7, TO THE NORTHERLY PROPERTY LINE OF LOTS 1 AND 6, ALL IN BLOCK 13, TIER 9, E. R. 'l'RAb'FORD' S MAP OF SANFORD. Persons interested may appear and be heard at the time and place above specified. CITY COMMISSION OF THE CITY OF SANFORD BY: H. N. TAMM, JR., City Clerk The Chairman then announced that the G,ommission would be glad to hear from anyone in favor of, or against closing, vacating and abandoning that portion of the certain utilities easement as described in the foregoing notice. There being no objections registered, Commissioner Warner moved that that portion of said utilities easement be vacated and abandoned as advertised. Seconded by Commissioner // Higginbotham and carried. Request next submitted by James Burke, 1809 W 15th Street, to vacate and abandon the west 7 feet of an unnamed street between 15th and 16th Street lying adjacent to N 1/2 of Lot 48, Block A, of M. M. Smith's Second Subdi.vision, and on motion of Commissioner Higginbotham, seconded by Commissioner Brown and carried, the request was denied. After consideration, and on motion of Commissioner Higginbotham, seconded by Comm., Warner and carried, the City Attorney was authorized to prepare an agreement with Brailey Odham of Odham & Tudor, for permitting a sewer tie-in with the Sunland Estates se~ge collection system, said agreement to embody: 1. Title to pass to the City, upon approval of the system by the City. 2. Moved by Commissioner Higginbotham, seconded by Commissioner Warner and carried, ",..,.. to designate all City equipment with proper lettering. The City Manager next submitted plans and estimates of $7,900.00 for material and $2,100.00 for labor and equipment, for proposed 6" water pipe line to better serve South / Sanford Avenue and Pinecrest areas, and on motion of Commissioner Brown, seconded by Comm., Higginbotham and carried, the Commission approved aforementioned line to be paid from the ./' Water & Sewer Renewal & Replacement Fund. ! Municipal Judge E. A. Olliff, next appeared to recommend suspension of the balance of a straight time sentence of 30 days against Johnnie Lee Morgan, Case #61206, dated June 1, 1959, and on motion of Commissioner Higginbotham, s~bonded by Commissioner Warner and carried, the sentence was suspended. Philip Zeuli, developer, next appeared to request that San-Sem Knolls 1st Section be designated as an area for annexation, an~on motion of Commissioner Higginbotham, seconded by Commissioner Baker and carried, the request was approved. On motion of Commissioner Higginbotham, seconded by Commissioner Warner and carried, the Mayor and City Clerk were authorized to execute a lease agreement with Fred Williams for a public parking lot on lots 9 and 10, Block 5, Tier 2. Ordinance No. 676, entitled: ,/ r- AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA ESTABLISHING RATES FOR SEWER SERVICE OF THE CITY OF' SANFORD FOR CUSTOMERS BEYOND THE COR- PORATE LIMITS OF SAID CITY, AND PROVIDING AN EFFECTIVE DATE. introduced and placed on first reading a regular meeting or May 25, 1959, was next placed on final reading. AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA ESTABLISHING RATES FOR SEWER SERVICE OF THE CITY OF SANFORD FOR CUSTOMERS BEYOND THE COR~ PORATE LIMITS OF SAID CITY, AND PROVIDING AN EFFECTIVE DATE. On motion of Commissioner Higginbotham, seconded by Commissioner Brown and carried, transfers were authorized as follows: I, (a) Account #,2201, Police-Salaries Account #4101, Parks-SAlaries From Contingency Fund Acc't #8150, to cover special services for night baseball games at Municipal Stadium. (b) Account #3001, Public Health-Salaries Account #3002, Public Health-Gas & Oil Account #3061, Public Health-Pound Expense From Contingency Fund Acc't #8150, to cover 8 weeks full time work of dog catcher. LJ._v., V.lJ,OUUlJ, .1' lV.lJU;:;c, On motion of Commissioner Higginbotham, seconded by Commissioner Warner and carried, the Commission authorized the purchase of a carload of clay for baseball fields and to transfer $290.00 from Contingency Fund Account #8150 to Parks-Little League Fields vi' Account #4167. On motion of Commissioner Higginbotham, seconded by Commissioner Warner and carried, current invoices and payrolls next approved, as evidenced by General Fund Sanford Atlantic National Bank Vouchers Nos. 4579 thru 4725, General Fund Florida State Bank Vouchers Nos. 2430 thru 2467, and Water & Sewer Sanford Atlantic National Bank Vouchers Nos. 328 and 329. On motion of Commissioner Higginbotham, seconded by Commissioner Baker and carried, action of the Commission of meeting of May 4, 1959 was recinded to abandon and vacate the North 2 feet of 3rd Street adjacent to Lot 5, Block 4, Tier 5, Traffords. ./ After consideration, moved by Commissioner Higginbotham, seconded by .Commissioner Brown and carried, the Thrifty Service Station located on 2nd Street and Palmetto Avenue, was permitted to rehang a sign on a standard on the parkway.
