",..-, ! , The Ctty Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on October 12, 1959. Present: Commissioner A. L. Wilson, Mayor ft Joe B. Baker · Robert S. Brown · Earl Higginbotham n Merle Warner City Attorney W. C. Hutchison, Jr. City Manager W. E. Knowles City Clerk H. N. Tamm, Jr. Police Chief R. G. Williams The meeting was called t'o order by the Chairman. Letter next presented from Attorney A. Edwin Shinholser, representing Mrs. Ruth S. Rockey, requesting closing and vacating of the north 6 inches of the East 124 .feet of the East-West alley in Block ), Tier 8, E. R. Traffords Map, and moved by Commissioner Higgin- botham, seconded by Commissioner Warner and carried,. to hold a Public Hearing on November 9, 1959, to consider same. The next order of business being a Public Hearing to consider zoning the property as proposed and described in the following legal 'Notice" published in the Sanford Herald on September 25, 1959. r-- NOTICE OF PUBLIC HEARING ON PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCES OF THE CITY OF SANFORD, FLORIDA. f, Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida at 8:00 o'clock P. M. October 12, 1959, to consider the following changes and amendments to the Zoning Ordinance of the City of Sanford, Florida. (a) To provide for a District R-IC (Single-family), said District to conform with requirements of District R-IB (Single-family), ex- cept the minimum building site area shall be 6,500 square feet and each side yard shall not be less than 7 1/2 feet in width. (b) All property located in subdivisions platted as Country Club Manor, Units One, Two and Three, is proposed to be zoned R-IC Single-fami ly) District. (c) The property located north of 27th Street between Elm Avenue and Myrtle Avenue is proposed to be zoned R-l (Single-family) District. Said property being more particularly described as Lots 451, 453, 455, 457 and 459, F. L. Woodruff's Subdivision. (d) That area bounded on the North by the Country Club Road and on the south by 25th (Geneva) Street, and on the East by Hardy Avenue and on the west by the Lake ~1ary Road, is proposed to be Zoned C-l (Commercial-retail) District. There being no objections registered, Commissioner Higginbotham moved to establish a zone as described in paragraph (a) and that the property descri~ed in paragraph (b) be zoned as advertised. M. 19 59 1 QP Ice ua There being no objections registered, Commissioner Brown moved that the property described in paragraph (c) be ,zoned as advertised. Seconded by Commissioner Baker and carried. The Chairman then announced that the Commission would be glad to hear from anyone in favor of, or against the zoning as proposed and described in paragraph (d) in the fore- going notice. There being no objections registered, Commissioner Higginbotham moved that the ~ property described in paragraph (d)' be zoned as advertised. S~conded by Commissioner Warner and carried. Cmdr. I. M. Rowell, Jr., 2440 Oak Ave., next appeared in protest of the activities of the Food Fair Shopping Center across the street f~om his residence, and specifically objected to debris being carried by the wind into his yard, the lights from automobiles using the parking areas shining into his windows, the heavy trucking on Oak Avenue, the noise of the refrigeration equipment, and the noise made by the City trash crews in making the pick-up in this area. After discussion and on motion of Commissioner Higginbotham, seconded byComm., Baker and carried, the City Manager was authorized to,prepare a comparison of the cubic yards of trash picked-up at retail establishments and revenues derived from this service. On motion of Commissioner Brown, seconded by Commissioner Higginbotham, and carried, the City Attorney was authorized to prepare an ordinance prohibiting trucks from using Oak Avenue except to make home deliveries. Earl Moxley, 2446 Oak Ave., next appeared in support of the objections as out- lined by Cmdr. Rowell. Request next submitted by John D. Carlton for transfer from Robert and Irene McIntosh, d/b/a Goldsboro-Georgia Store, 1317 W 13th Street, of permit to sell beer and wine, and on motion of Commissioner Higginbotham, seconded by Commissioner Brown and carried, same was approved on recommendation of the Chief of Police. Request next submitted by Clyde Ellison, d/b/a Clyde's Grill, 206 S Sanford Ave., for permit to sell beer and wine, for consumption on and off premises, and on motion of Commissioner Higginbotham, seconded by Commissioner Warner and carried, same was approved on recommendation of the Chief of Police. On motion of Commissioner Brown" seconded by Commissioner Higginbotham and carried, / Harry Lee was re-appointed to the Civil Service Board, effective July 1, 1959. Consideration next given to adopting the Southern Standard Building Code, Part III, Plumbing, 1957-58 Edition, and on motion of Commissioner Higginbotham, seconded by Comm., / Brown and carried, action was tabled until next meeting. Recommendation next s.ubmitted by the Zoning and Planning Commission to rezone the Southwest corner of the intersection of Mellonville Avenue and Celery Avenue from R-l District to C-l (Sing1e-fami1Y)/%BXe~ix(Commercia1-Retail) and C-N (Commercial'~eighborhood Shopping) District, and moved by Commissioner Higginbotham, seconded by Commissioner Warner and carried, to hold a Public Hearing on November 9, to consider same. Commissioner Higginbotham next introduced Ordinance No. 693, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA AMENDING CHAPTER 14, SECTION 14-13 THEREOF, THE ~ODE OF THE CITY OF SANFORD, FLORIDA 1954 ENTITLED SCHEDULE OR OCCUPATIONS AND LICENSE i J \ 561 ! Commissioner Brown then moved the waiver of the requirement of the second reading of Ordinance No. 693, and that' same be pla.ced on its final passage and adoption. Municipal Judge E. A. Olliff, next appeared, to recommend stispensicm.of balance of sentence imposed against Quay Darlington Swartz,Docket Case No 61745, on September 4, 1959, and on motion of Commiss;ioner Higginbotham, seconded by Commissioner Warner and carried, same was approved, upon his good behavior and not to appear back in City of Sanford. After discussion and on motion of Commissioner Higginbotham, seconded by Camm., Warner and carried, the City Manager and City Attorney were authorized to go to Jacksonville to obtain copies of pertinent data from the State Board of Health, so as to proceed with .v/' plans for further study o~ a sewage disposal plant. On m~tion of Commissioner Higginboth~,seconded by Commissioner Baker and carried, current invoices and payrolls next approved, as evidenced by General Fund Sanford Atlantic National Bpnk Vouchers Nos. 5188 thru 5324, General Fund Florida State Bank Vouchers Nos. 2576 thru 2600 and 2651 thru 2663, and Water and Sewer Sanford Atlantic National Bank Vouchers Nos. 356 thru 359. On motion of Commissioner Brown, seconded by Commissioner Baker and carried, minutes of regular meeting of September 28, 1959 next approved.
