The first order of business was a Public Hearing to consider rezoning the property as proposed and described in the following legal "Notice" published in the Sanford Herald on ,... ! I October 23, 1959. NOTICE OF PUBLIC HEARING ON PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCES OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. November 9, 1959, to consider the following changes and amendments to the Zoning Ordinance of the City of Sanford, Florida. ,... The property located on the west side of Mellonville Avenue between Celery Avenue and Fourteenth Street, extended, is proposed to be rezoned C-I (Commercial- Reta~l) District. William Messner, Attorney for Charles G. Medlin, n~xt appeared to request vacating closing and abandoning of that portion of Third, Fourth and Fifth Streets between Persimmon Avenue and the west City limits. -I 1 Moved by Commissioner Brovrn, seconded by Commissioner Baker and carried, to hold a Public Hearing on December 14, 1959, to consider same. County Commissioners to request State Road Department to install a pipe line to replace open ditch at time Geneva Avenue is reconstructed, and if not approved, the County will install the pipe at time of said re- construction, however, if no reconstruction is under- taken the pipe line will be installed by the County Commissioners within 3 years from date of the resol- ution. r- After consideration and on motion of Commissioner Higginbotham, seconded by Comm., Warner and carried, the City Attorney was authorized to prepare a resolution as set forth above. City Attorney Wm. C. Hutchison, Jr. stated there is not any legal way to enforce action as set forth in the proposed resolution and performance rests entirely on the inte- r grity of the County Commissioners at such time it is deemed necessary for said action. W. W. Dietrich, Realtor, next appeared in interest of having lots 58, 60, 62, and 64, F. L. Woodruff's Subdivision, rezoned from R-l (Single-Family) to C-N (Commercial- Neighborhood Shopping) District. He stated said request had been submitted to the Zoning & Planning Commission and had not been approved. After consideration and on motion of Commissioner Baker, seconded by Commissioner Brown and carried, the Commission authorized a joint meeting with the Zoning & Planning ./,. Commission on November 19, to further discuss said request. w. K. McRoberts Next appeared and gave an accounting of the finances of the Sanford Greyhound' Class liD" Baseball team for the past season, and stated the Kansas City Athletics Tea ~ would probably sponsor the Sanford Team during the next season, and requested the City to fur- nish the lights, field & caretakeri and policemen, as was furnished the past season. Moved by Commissioner Higginbotham, seconded by Commissioner Warner and carried, approving the request over the dissenting votes of Commissioner Baker and Commissioner Brown. Application next submitted by The Hildon Company,D/B/A Pit House, 1919 French Ave., for permit to sell beer and wine for consumption on premises, and on motion of Commissioner Higginbotham, seconded by Commissioner Warner and carried, same was approved on recommenda- tion of the Chief of Police. On motion of Commissioner Higginbotham, seconded by Commissioner Brown and carried, the City Attorney was authorized to prepare an ordinance for the proposed adoption of the Southern Standard Building Code, Part III (Plumbing) ~957-58 Edition, as amended. Proposals next submitted to duplicate the 1951 State Board of Health survey of Lake Monroe to determine the present pollution levels of various areas of the lake: Thornton Laboratories, Inc., Tampa, Fla. $3,000.00 t 10% 6,200.00 r- Law engineering Testing Company, On motion of Commissioner, seconded by Commissioner Brown and carried, Thornton vi' Laboratories, Inc., were authorized to perform the survey, Commissioner Higgi flbotham next introduced Ordinance No. 697, entitled: r AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, A~1ENDING ORDINANCE NUfv1BER 362 OF SAID CITY, AS AMENDED, SAID ORDINANCE BEING AN ORDINANCE ESTABLISHING A ZONING PLAN WITHIN THE CITY OF SANFORD, FLORIDA, SAID AMENDMENT PLACING CERTAIN TERRITORY IN DISTRICT R-3, SINGLE FAMILY DISTRICT. and same was placed on its first reading and read in full. Commissioner Higginbotham then moved the waiver of the requirement of the second reading of Ordinance No. 697, and t!lat same be placed on its final passage and adoption. On motion of Commissioner Warner, seconded by Commissioner Higginbotham and carried, an Ad was authorized in the Seminole High School annual for sum of $25.00. On motion of Cqmmissioner Warner, seconded by Commissioner Brown and carried, the Mayor was authorized to attend a hearing on the application of Tamiami Trail Tours Company for Bus service from Jacksonville to Miami through Sanford, to be held at Jacksonville, Fla. On motion of Commissioner Warner, seconded by Commissioner Baker and carried, a transfer of $121.00 was authorized from Accou~t No. 8150 Contingency to Account 1412 Office Furniture, to cover purchase of license file cabinet. On motion of Commissioner Higginbotham, seconded by Commissioner Warner and carried, the City Attorney was authorized to prepare a resolution to the County Commissbners setting forth the desire that if any County drainage program is ct~stituted, that it will be set-up on a drainage district basis. r""'- On motion of Commissioner Higginbotham, seconded by Commissioner Warner and carried, payment of $80.00 was authorized upon execution of release to be made to Joseph Riggins, 522 E 6th Street, as a result his claim of having hurt his leg by falling in an uncovered meter box at NW corner of 5th Street and Cypress Avenue on October 27, 1959. - On motion of Commissioner Higginbotham, seconded by Commissioner \varner and carried, trle Commission authorized the distrubution of flags and staffs to local merchants to be used on display in front of their establishments and authoriz.ed City Manager to obtain a flag and a flag pole for use at the City Hall. ~/ .~ On motion of Commissioner Higginbotham, seconded15y Commissioner Warner and carried, the Commission authorized an extenstion of agreement, which expired on October 15, for /.. ,." . SRD No. 140 SECTION 77510-2602 STATE ROAD S-427, Seminole County. R-E-S-O-L-U-T-I-O-N ON MOTION by Commissioner Warner, seconded by Commissioner Brown, the following Resolution was adopted: WHEREAS, the State Road Department of Florida has located and proposes to construct and/or improve a portion of Sta.te Road S-425 Section 77510, in the City of Sanford, Florida, and WHEREAS, right of way for said road will be required over and across certain lands hereinafter described, title to which is vested in the City of Sanford, and the State Road Department having requested the City of Sanford to execute a Quit Claim Deed in favor of the State of Florida, in and to said lands required for said road right of way, and said request having been considered, BE IT RESOLVED BY THE CITY COMMISSION of the City of Sanford that the request of the State Road Department be granted, and that the Mayor and City Clerk of the City of San- ford be, and they are hereby aut1'lOrized and directed to execute and deliver to the State Road Department a Quit Claim Deed in favor of the State of Florida in and to said lands owned by the City of Sanford required for said road right of way, being the following des- cribed lands in the City of Sanford, Secminole County, Florida, to-wit: That part of: Lot 16 of Frank L.
