041160-Regular Session MINUTES City Commission, Sanford, Florida, A~ril 11 at 8 p. m. The City Commission of the City o~ Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on A,pril 11, 1960. Tatum, Jr. Police Chief R. G. Williams T:he meeting was called to order by the Chairman. Application next submitted by Mrs. Argenia Constantine, for permit to Sell beer and wine for consumption on premises at 412 Sanford Avenue, and on motion of Commissioner Wilson, seConded by Commissioner Crapps and carried, same was approved on the recommendation of the Chief of Police. Recommendation next submitted by Municipal Judge E. A. Olliff, Jr., .and moved by COmm., Crapps, seconded by Commissioner Wilson and carried on the following: After serving 93 days and upon the payment of $204.00 fines ann costs, the balance of the sentence of $100.00 or 60 days in docket cases # 62526/28 against Luke Williams, was suspended. A~lso, balance of sentence imposed upon Henry Grady MOore in docket case # 60230/32 and # 62681, was next suspended. Commissioner Brown next introduced Ordinance No. 710, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING CHAPTER 11, THE CODE OF THE CITY OF SANFORD, FLORIDA 1954, SECTION 11.13 THEREOF, SUCH SECTION IMPOSING A FEE FBR THE COLLECTION OF REFUSE, AS DEFINED THEREIN, PRESCRIBING THE AMOUNT OF SUCH FEE AND DEFINING USEAGES UPON WHICH SAID FEEl IS BASED, AND PROVIDING FOR THE METHODS OF BILLING FOR THE SAME, AND PENALTY FOR FAILURE TO PAY SUCH FEE, SAID AMENDMENT CHANGING THE FEE FOR BUSINESS OCCUPANCY AS PRO- VIDED IN SUBSECTION (e) AND (g), AND PRESCRIBING COLLECTION FEES FOR SUCH OCCUPANCY. and same was Placed on its first reading and read in full. Commissioner Brown then moved the waiver of the requirement of the second reading of~ Ordinance No. 710, and that same be placed on its final passage and adoption. PORTION OF PACE ACRES, ACCORDING:TO THE PUBLIC RECORDS OF SEMINOLE COUNTY, FLORIDA, AND MORE PARTICULARLY DESCRIBED HEREINAFTER; PROVIDING AN EFFECTIVE DATE FOR SAID ANNEXATION AND FOR THE RIGHTS AND PRIVILEGES FOR CITIZENSHIP IN THE CITY OF SANFORD, FLORIDA. and same was placed on its first reading and read in full. On motion of Commissioner Brown, seconded by Commissioner Baker and carried, W. E. Kirchhoff, Jr. was reappointed to serve on the Commission of the Sanford Housing Authority for a 4-year term effective May 20, 1960. On motion of Commissioner.Baker, seconded by Commissioner Crapps and carried, the COmm., approved transfer of funds as folloWs: From - Contingency Fund Account No. 8150 To - Building Repair & Maintenance Account No. 4621 From:': .... Unappropriated Revenue from sale of Recreation Bus To - Contingency Fund Account No. 8150 $3oo.oo 600.00 On motion of Commissioner Baker, seconded by Commissioner Brown and carried, the COmm., $ 221.00 541.0o 238.00 approved transfer of funds as follows: To - Park-Salaries Account 4101 Park-Utilities Account 4123 Police-Salaries Account 2201 From - ContingenCy Fund Account 8150 $1,000.00 On motion of Commissioner Brown, seconded by Commissioner Wilson and carried, minutes of regular meetings of March 14 and March 28, 1960, next approved. Request next submitted by Mrs. Frank Lieske, 404 Palmetto Avenue, to retain the present underground serviced street lights in this area in lieu of the newer type light and standard. After discussion of the increased efficency of the new light and the economic advantage of the Florida Power & Light Company providing maintenance for the newer type lighting, moved by Commissioner Brown, seconded by Commissioner Baker and carried, to deny the aforesaid request Request next submigted by Sam Lawson, contractor, for the City to construct sewers in St. Johns Village subdivision for an estimated cost of $2,500.00, actual costs to be guaranteed by a personal note and repaid on~a pro-rata basis of the number of lots serviced and upon con- struction of a house upon said lot, provided however, that any balance due on the face of the note shall be paid within two years from the date of issuance, and on motion of Commissioner Brown, seConded, by Commissioner Baker and carried, same was approved. On motion of Commissioner Crapps, seconded by Commissioner Baker and carried, the COm- mission next Zpproved the proposed construction of a double reverse curve in the continuation of ScOtt Avenue. On motion of Commissioner B~own, seconded by Commissioner Wilson and carried, current invoices and payrolls next approved, as evidenced by General Fund Sanford Atlantic National Bank Vouchers Nos. 7716 thru 7759, General Fund Florida State Bank Vouchers Nos. 3225 thru 3276, and Water and Sewer Revenue Fund Sanford Atlantic National Bank Vouchers Nos. 395 thru 399. ~- After discussion and on motiOn of Commissioner Brown, seconded by Commissioner Baker MINUTES City Commission, Sanford, Florida, A~pril 11 at 8-P. M. .19 60 the Studio officials acknowledging responsibility for acts of their agents and upon posting a $1,000.00 performance bond, and on compliance wi.th other applicable ordinances. On motion of Commissioner Wilson, seconded by Commissioner Brown and carried, the City Manager was authoOized to attend annual City:Managers' Short Course in Tallahassee and Director H. N. Tamm, Jr., was appointed acting City Manager during his absence from the City on April 24 thru 27, 1960. Commissioner Brown next introduced Ordinance No. 713, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING SECTION 3, OF ORDINANCE NO. 256, PASSED AND ADOPTED ON THE 28th DAY OF JUNE 19j7, SAME BEING AN ORDINANCE REGULATING THE; MANUFACTURE, DISTRIBUTION AND SALE IN THE CITY OF SANFORD, FLORIDA, OF BEVERAGES CONTAINING MORE THAN ONE (1%) PER CENTUM OF ALCOHOL BY WEIGHT, AS AMENDED BY ORDINANCE NO. 360, AND ORDINANCE NO. 392, AND ORDINANCE NO. 471, and ORDINANCE NO. 536, SAID SECTION 3 DESIGNATING A ZONE IN WHICH THE BUSINESS OF DISTRIBUTING OR SELLING SAID BEVERAGES MAY BE ENGAGED. and same was placed on its first reading and read in full. Commissioner Brown then moved the waiver of the requirement of the second reading of Ordinance No. 713, and that same be placed on its final passage and adoption.
