021361-Regular Session MINUTES City Commission, Sanford, Florida, February 13 at 8 P. M. The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in .the City of Sanford, Florida, at 8:00 o'clock P. M. on February 21, 1961. Present: Commissioner Joe B. The first order of business being a Public Hearing to consider rezoning the property as proposed and described in the following legal "Notice" published in the Sanford Herald on January 24, 1961. NOTICE OF PUBLIC HEARING ON PROPOSED CHANGES AND~ AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCES OF THE CITY OF SANFORD, FLA. Notice is hereby given that~a Public Hearing will.be held ht the Commission Room in the City Of T~Sanford, Florida, at 8:00 o'clock P. N., February 13, 1~61, to consider the following changes and amendments to the Zoning Ordinance of the City of Sanford, Florida. The property located between Sanford Avenue and Grandview Avenue and 25th Place and 26th Street is proposed to be rezoned C,~ (Commercial-Retail) District. Said property being more particularly described as: Lots 1 thru 36, Block 2, Palm Terrace, and Lot lA', Seminole Heights. A~ll parties in interest and citizens shall have an opportunity to be heard at said hearing. By order of the City Commission of the City of Sanford, Florida, this 9th day of January, 1961. s/ H. N. The Chairman then announced that the Commission would be glad to hear fmn~anyone in favor of, or'against re~oning the ~roperty as proposed and described in the foregoing notice. Clarence L. Wynn~ 2606 Grandview Avenue, owner of a portion of aforesaid property, appeared in ~avor of said rezoning, and further stated that he had contacted all of the abutting property owners and had received no objections to said rezoning. There being no objections registered, Commissioner Higginbotham moved that the property described be rescued as advertised and to authorize the City Attorney to prepare an ordinance for adoption for same. Seconded by Commissioner McDonald and carried. Application next submitted by C. C. Flowers for permit to sell beer and wine for consumpt~ off premises at 501 French Avenue. Max Bass, next appeared in objection to said request, and further stated that in Septembe~ 1960 he had purchased a store at 805 W Third:Street from Mr. Flowers, with the agreement that Mr. Flowers would not enter into competition with him. After discussion and on motion of Commissioner Crapps, seconded by COmmission ~cDona~d and carried, the request was tabled for further consideration. The City Manager and Consulting Engineers, Leffler & Bush, next submitted a tabulation of bids which were opened publicl~ at 2:00 o'clock P. Below 400 feet, this Price becomes $6.50 After discussion and on the recommendation of the Consulting Engineers Leffler & Bush Commissioner Wilson moved the acceptance of the low bid of Central Florida Well Drillers, MINUTES City Commission, Sanford, F16rida, February 13 ,at 8 P. M. 1'17 Orlando, Florida, on Contract "A" and "B", and authorized, the Engineers to negotiate for a com- pletion time of 60 days in Contract "A" in lieu of 90 days as set forth in the bids. Application next submitted by Joseph Gazil for per~it to sell beer and wine for consump- ~ion.~off premises at 1116 Celery Avenue, and on motion of Commissioner Higginbotham, seconded by Commpissioner Crapps and carried, same was approved on recommendation of the Chief of Police. Request next submitted, for street lights to be installed in San Sem Knolls, First Addm., and on motion of Commissioner Higginbotham, seconded by Commissioner Wilson and carried, one 1,000 lumen street light was authorized to be installed at the intersection of 19th Court and Patrick Place. Request next submitted from J..Martin Gainer, Acting Manager Planning Department, Florida Development Commission, for payment of third and final installment of $2,000.00 on contract for services of George,W. Simons, Jr. Planning Consultant. After consideration and on motion of Commissioner Higginbotham, seconded by Commissioner Wilson and carried, action on the aforesaid request was tabled pending satisfactory completion of all phases of the contract. Request next submitted by C. H. Robertson from Florida Liquified Petroleum Gas Ass'n for support of a "local" bill to be introduced to the Florida legislature to place kerosene and fuel oil under the present municipal utility tax law, and same was taken under advisement. Commissioner Higginbotham next introduced Ordinance No. ?44, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, CLOSING, VACATING AND ABANDONING THAT CERTAIN NORTH-SOUTH ALLEY BETWEEN SEMINOLE BOULEVARD AND COMMERCIAL STREET AND SANFORD AND PALMETTO AVENUES, IN THE CITY OF SANFORD, FLORIDA~, LESS THE SOUTH 158.&9 FEET THEREOF and same was placed on its first reading and. read in full. Consideration next given to the requirement of health cards for itinerant solicitors, and on motion of Commissioner Higginbotham, seconded by Commissioner Wilson and carried, the Commission authorized continuance on the same basis as now set forth by Ordinance. Request next submitted by Department of Public Instruction of Seminole County to vacate close and abandon, Eleventh Street between Bay Avenue and Mellonville Avenue, and on motion of Commissioner McDonald, seconded by Commissioner Wilson and carried, a Public Hearing was authorized to be held on March 1,. 1961, to consider same. On recommendation df the City Manager and on motion of Commissioner Crapps. secpmded by Commissioner Wilson and carried, salary reclassification was authorized as follows; A. P. Hittell, Jr. 17C ($75.54/Wk) to 17-D ($77.73/Wk) After consideration of the repairs necessary to the City's grader, moved by Commissioner Wilson, seconded by Commissioner McDonald and carried, to authorize the City Manager to advertis~ for bids for a used grader of not less than 120 H P, and not used over 6 months, with trade-in of the present City grader ..... Consideration next given to the present plan whereby t~e City's property and liability insurance coverage is handled through one central agency, an~this agency retains 40% of the premiums and distributes 60% to other participating agency i~ the ~ity. In view of the services performed by the central agency, moved by Commissioner Higginbotham, secondSd by Commissioner McDonald and carried, to authorize this central agency to retain ~O% ~f the premium and distri- bute 40%, of the premiums. Request next submitted for area of Praver Ho~es Subdivision and to the City Limits to be designated as an area from which petitions for anneXations would be received and same was taken MINUTES City Commission, Sanford, Florida, February 13 at 8 P. M. 1961 under advisement for further consideration. The ,Commiss~n next authorized the City's 10 acre "Borrow Pit" on West 24th Street to be used as a sanitary IAnd fill area. Commissioner McDonald next introduced Ordinance No. 745, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, ADOPTING SOUTHERN STANDARD BUILDING CODE 1960-196i, REVISED EDITION, INCLUDING ALL FEES AND CHARGES THEREIN, AS THE BUILDING CODE OF THE CITY OF SANFORD, FLORIDA, EXCEPT SECTION 105.1 (d) THEREOF and same was placed on its first reading and read in full. Request next submitted by Wm. H. & Inez K. Cook for transfer of permit for sale of beer and wine, for consumption on premises, from R. C. Sproul, d/b/a Cook's Corner, 2617 Orlando Drive, and on motion of Commissioner McDonald, seconded by Commissioner Wilson and carried, same was approved on the recommendation of the Chief.of Police. On motion of Commissioner Wilson, seconded by Commissioner Crapps and carried, current invoices and payrolls next approved, as evidenced by General Fund Florida State Bank Vouchers Nos. 4?67 thru 4935, and General Fund Sanford Atlantic National Bank Vouchers 8183 thru 8229, and Water and Sewer Revenue Fund Sanford Atlantic National Bank Vouchers Nos. 462 thru 467, and Water and Sewer Revenue Renewal and Replacement Fund Florida state Bank Vouchers Nos.,?l and ?2. On motion of Commissioner. Wilson,~ seconded by Commissioner Crapps and carried, minutes of regular meeting.of January 23 and January 30, and special meeting of February 4, 1961, next approved. Request next submitted by First Baptist Church for 2 parking spaces on Fifth Street to be designated for a "loading zone", and on motion of Commissioner McDonald, seconded by Oomm., Wilson and. carried, ,same was approved.
