031361-Regular Session MINUTES City Commission, Sanford, Florida, March 13 at 8.P.M. The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 P. M. On March 13, 1961. Present: Commissioner Joe. B. Williams Absent: City Clerk H. N. Tamm, Jr., The meeting was called to order by the Chairman. The first order of business being a Public Hearing to consider vacating, closing and abandoning a street in acc~ordance with the following legal "Notice" published in the Sanford Herald on February 23, 1961. NOTICE OF PROCEEDING FOR VACATING, CLOSING AND ABANDONING A STREET TO WHOM IT MAY CONGERN You will take notice that the City Commission of the City of Sanford, Florida, at 8:00 P. M., on the 13th day of March, 1961, in the City Commissioners' Room at the City Hall in the City of Sanford, Florida, will consider and determine whether or not the City will close, vacate and abandon any right of the City and the public in and to the street hereinafter des- cribed, to-wit: ELEVENTH STREET FROM ITS INTERSECTION WITH BAY AVENUE ON THE WEST, EAST TO ITS INTERSECTION WITH MELLONVILLE AVENUE. 'Persons interested may appear and be heard at the time and place above specified. CITY COMMISSION OF TNE CITY OF SANFORD BY: H. N. Tamm, Jr., City Clerk Commissioner Higginbotham moved to table action as a result of the Public Hearing until the next regular meeting. Seconded by Commissioner Crapps and. carried. Warren J. King, 253& Park Drive, next appeared to present a petition requesting fire hydrants to be installed in closer proximity to commercial property in this vicinity of Park Drive, and on motion of Commercial Higginbotham, seconded, by Commissioner Wilson and carried, the City Manager was authorized to continue with plans for installation of three fire hydrants on Park Drive as soon as feasible. Request next submitted by Charles Young, Post No. 207, American Legion for a beer and wi~ license at 1~16 W 13th Street for consumption on premises, and on motion of Commissioner Higgin~ botham, seconded by Commissioner Wilson and carried, same was approved on recommendation of the Chief of Police. Commissioner Wilson moved to authorize the City Tax Assessor to exempt home civilian defense shelters from assessment and to waive the building permit fee, provided that all plans submitted to the City Engineer for approval to meet the specifications of Civil Defense Bulletin MP15, and all suc~ exemptions to be subject to review by the City Commission. Seconded by Commissioner Higginbot~'~am and carried over the dissenting vote of Commissioner McDonald. Commissioner Higginbotham next introduced Resolution No. 9~0, and after being read in ful moved its passage and adoption. Seconded by Commissioner Wilson~and carried unanimously. MINUTES City Commission, Sanford, Florida, March 13 at 8 P.M. 19_61 Said Resolution No. 940 being in words and figures as follows: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA IN RECOGNITION OF FORTY YEARS OF SERVICE BY MACK N CLEVELAND . WHEREAS, Mack N. Cleveland has Completed forty years of continuous service in the City of Sanford, Florida with the Fire Department and has been Fire Chief of the City of Sanford since 1925, and WHEREAS, Mack N. Cleveland in rendering said forth years of service and has worked diligently and unselfishly for the betterment and welfare of the people of this City and the Fire Department of this City, and has devoted to such service time and effort far beyond the call of duty, a~d WHEREAS, it is the feeling and desire of the present City Commission that proper recog- nition and apDrecia~ion be expressed to MaCk N. Cleveland for the conscientious effort and de- votion to duty he has shown in his capacity with the Fire Department of the City of Sanford, Florida. NOW THEREFORE, be it resolved by the City Commission of the City of Sanford, Florida that t~e sincere commendation and appreciation of the City Commission both for itself and in behalf of the people of the City of Sanford, Florida, be and the ~ame is hereby expressed to Mack N. Cleveland for forty years of outstanding service. BE IT FURTHER RESOLVED that Mack N. Cleveland be presented with a gift in further recognition of his services, and that this Resolution be spread upon the minutes of the City Commission and copies thereof be delivered to Mack N Cleveland and the local press. On behalf of the City Commission, Mayor Baker at this time presented Police Chief Williams with a .38 caliber gold plated pistol in recognition of his forty years service.to the City· On motion of Commissioner Higginbotham, seconded by Commissioner Wilson and carried, the City Attorney was authorized to prepare a Resoltuion to the 5th District Road Board Chairman, Max Brewer, and send copy to the Chairman of the Board of County Commissioners requesting that State Road ~6 from French Avenue west to the interchange of Federal t'{ighwaY No. ~ to be placed at the top of priority for primary road funds. Seconded by Commissioner Wilson and carried. The City Manager reported that Mr. Gaede of Sanford Gas Company had offered to sell the property abutting t}qe City Repair Shop on Iq Sixth Street for approximately (~10,000.00 and on motion of Commissioner Hi~ginbotham, seconded by Commissioner Crapps and carried, the offer was declined· Commissioner Higginbotham moved to authorize the City Attorney to prepare an ordinance exemption all political subdivisions from the municipal utility tax, and. same died for lack of a second. Commissioner McDonald next introduced Ordinance No. 750, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, ANNEXING TO AND INCLUDING WITHIN THE CORPORATE AREA OF THE CITY OF SANFORD, FLORIDA, THE AREA KNOWN AS A PORTION OF M. M. SMITH SI~DIVISION, ACCORDING TO THE PUBLIC RECORDS OF SEMINOLE COUNTY, FLORIDA, AND MORE PARTICULARLY DE- SCRIBED HEREINAFTER; PROVIDING AN EFFECTIVE DATE FOR SAID ANNEXATION AND FOR THE RIGHTS AND PRIVILEGES FOR CITIZENSHIP IN THE CITY OF SANFORD, FLORIDA. AND SAME WAS PLACED ON ITS FIRST READING AND READ IN FULL. Consideration next given to Legislative program prepared by the Florida League of Municipalities as follows' Commissioner Crapps moved to support an amendment increasing the cigarette tax levy to six cents per package. Seconded by Commissioner Mcdonald and carried. Commissioner Higginbotham moved not to support an amendment whereby the state would bear the cost of securing :~?ighB-0f-ways on state roads through municipalities. Seconded by Commissione~ McDonald and carried. Commissioner Higginbotham moved not to support an amendment whereby th~ State would pay the cost of relocating utilities on state highways as a part of cost of road construction. Seconded by Commissioner McDonald and carried. Commissioner McDonald ~ moved to support an amendment permitting municipalities and counties to perform as a unitary body certain functions of local government. Seconded by Commissioner Wilson and carried. Commissioner Wilson moved not to support a bill amending Section 62~.0318 clarifying the right of municipalities to continue to impose occupational license taxes on insurers. Commissioner Crapps moved to support the study of the methods in effect in ot?~er states, and methods used throughout Florida for the annexation by municipalities of cont~igo~s territory. Seconded by Commissioner Wilson and Carried. 7. Commissioner Crapes moved to supP°rt the opposing of any legislation to tax municipal property or inco~e. ~ Seconded'by Commissioner McDonald and carried. On motion of Commissioner Wilson, seco~nded by Commissioner McDonald and carried, current invoices and payrolls next approved, as evidenced by General Fund Florida State Bank Vouchers Nos. &936 thru .5099, and General Fund Sanford Atlantic Nati_onal Bank Vouchers Nos. 8230 thru 8277, and Water and Sewer Revenue Fund Sanford Atlantic National Bank Vouchers Nos ~68 thru &?3, and Water and Sewer Hevenue Renewal and Replacement Fund Florida State Bank Voucher No. 73. On motion of Commissioner Higginbotham, seconded by Commissioner Crapps and carried, a Public Hearing was authorized to be held on April ~0, 196[ to consider vacating, closing and abandoning a twenty-five foot street and a park abutting Block 7, Wynnewood Subdivision at the intersection of Forrest Drive and Key Avenue. Consideration next given to position offered by National Pool Equipment Company to Ronald Perry, Recreation and Parks Director. Commissioner Crapps moved that in view of the fact the City is unable to compete with private industry in the advancement of Mr. Perry~ to accept his resignation with regrets.
