041061-Regular Session MINUTES City Commission, Sanford, Florida, April 10 at 8 P. M. 19 61 The City Commission of the City of Sanford, Florida, met in regular session at the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on April 10, 1961. Present: Commissioner Joe B. Baker,. Mayor " J.H. Crapps "~ Earl Higginbotham " Thomas McDonald "' A.L. Wilson City Attorney Wm. C. Hutchison, Jr., City Manager W. El. Knowles City Clerk H. N. Tamm, Jr., Deputy Clerk Rosa M. Rotundo Police Chief R. G. Williams The meeting was called to order bY the Chairman. Francis Roumillat, Chairman of Downtown Merchants Committee of Seminole County Chamber of Commerce, appeared and requested the City Commission to adopt a Resolution urging the legislative delegation to support the proposed local Urban Renewal bill. He further em- phasized the need to retain the downtown area as the primary shopping center of the City and stressed his belief tha~ the proposed Bill would be helpful in cases Where individuals would not cooperate to bring their structures into proper repair and therefore making it necessary for public action to be taken to enforce the repair of these structures. Kenneth Leffler, .Attorney for said Committee, next stated that in his opinion, the proposed Bill would be effective when used on a basis of a particular area, but questioned its effectiveness when applied to individual structures. City Attorney Wm. C. Hutchisou, Jr., concurred with Mr.'Leffler's views. The Commission commended this Committee for their efforts and accomplishmentS achieved toward the rehabilitation and repair of the downtown business properties. After discussion, Commissioner McDonald Moved to authorize the City Attorney to prepare a Resolution to the Legislative Delegation recommending support of the proposed Urban Renewal Bill. Seconded bY Commissioner Wilson. The roll was called, and vote as follows: Commissioner Baker Naye " Crapps Naye " Higginbotham ~ Yea " McDonald Yea " Wilson ~ Yea Commissioner Higginbotham stated that as there existed some question as to whether or not this Bill was the solution to the efforts ~to rehabilitate particular structures in the downtown area, and further, that he felt that any Resolution submitted to the Legislative Delegation should have the unanimous support of the Commission, that therefore, he requested that his "yea" vote be withdrawn and cast with the "Naye" votes. The Chairman then announced that the motion had failed for lack of a majority. The next order of business being a Public Hearing to consider vacating, closing and abandoning a park and a street as proposed in the following legal "Notice" published in the Sanford Herald on March 23, 1961. NOTICE OF PROCEEDING FOR VACETING, CLOSING AND ABANDONING A PARK AND A STREET. TO WHOM IT MAY CONCERN: You will take notice that the City Commission of the City of Sanford, Florida, at 8:00 o'clock P. M. on the 10th day of April, A. D. 1961, at the City Commissioners' Room at the City Hall in the City of Sanford, Florida, will consider and d~termine whether or not the City will close, vacate, and abandon any right of the City and the public in and to that certain park and street hereinafter described, to-wit: MINUTES tSS · City,Commission,_.Sanford,,FlOrida,, April 10 a.~..8 Pt.,~M. 19_61_ (a) That certain park located at the southeast corner of Block 7, Wynnewood Subdivision and at the intersection of Key Avenue and Foreet Drive. (b) That certain unnamed street abutting aforesaid park and lying within an area between Block 7 and 60 feet north of the north- erly boundary of Block 8 and 60 feet west of the westerly boundary of Block 9, all in Wynnewood Subdivision. Persons interested may appear and be heard at the time and place above specified. CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA. s/ H. N. Tamm, Jr. City Clerk The Chairman then announced that the Commission would be glad to hear from anyone in favor of, or against vacating, closing and abandoning the property as proposed and described in the foregoing notice. There being'no objections registered Commissioner Wilson moved that the property described be vacated closed and abandoned as advertised and to authorize the City Attorney to prepare an ordinance for adoption for same. Seconded by Commissioner Crapps and carried. Philip Boyd, owner of the Leilani House of Beauty, 2501 $, Elm Avenue, next appeared and requested his property to be rezoned from R-1 (Single family) District to C-N (Commercial Retail-Neighborhood Shopping) District, due to the fact that he operated a beauty shop as a home occupation and employms outside assistance. The City Manager reported that the Zoning & Planning Board had recommended that the request be denied. After discussion and on motion of Commissioner Crapps, seconded by Commissioner Higginbotham and carried, over the dissenting vote of Commi.ssioner McDonald, a Public Hearing was authorized to be held on May 8, ,1961, to consider aforesaid rezoning of Lots 1 and 15, Block 3, Dreamwold Second Section. Recommendation next submitted from the Zoning and Planning Commission, that due to the traffic hazard created by the Clock located in the center of the intersection of First Street and Park Avenue, that it be removed, and further that it had not been kept in proper repair and the Sanford Atlantic National Bank had received a permit to erect a clock and ther- mometer on their building at the same location. Morris Moses, next appeared and stated that his father, Abe Moses, had donated this clock, and requested that it be left in place, and that he felt that he could get it repaired and put in good running condition. Commissioner McDonald moved to authorize the removal of the clock, and to give Mr. Moses 60 days in which to find ~ suitable place on which t~e City would reinstall the clock, with the provision that the City would not be responsible for the maintainence. Seconded by Commissioner Higginbotham and carried over the dissenting vote of Commissioner Crapps. David L. Remley~ Secretary-Treasurer of the Capri Restaurant, next appeared with regards to his request submitted on March 27, 1961 for an extension of time in which to sell liquors for consumption on premises at 2544 Park Avenue, said request to be on Sundays from 4:30 P. M. until midnight. After consideration and on motion of Commissioner Crapps, seconded by Commissioner McDonald and carried, the request was denied. Seconded by Commissioner Cr~pps and carried. Request next submitted from C. C. Flowers for transfer of beer and wine license for consumption off premises, at 501 French Avenue to William Graham, and also for a new beer and wine license, for consumption off premises, at 1201W First Street, and on motion of Comm., Higginbotham Seconded by Commissioner McDonald and carried, same was denied. Commissioner Higginbotham next introduced O~dinance No. 749, entitled: AN ORDINANCE OF THE' CITY OF SANFORD, FLORIDA, AMENDING SECTION 23-8, THE CODE OF T~E CITY OF SANFORD, FLORIDA,~ 1954, as amended, SAID SECTION PROVIDING FOE THE IM- POSITION OF A TAX BY THE CITY OF SANFORD ON UTILITY SERVICE, SAID AMENDMENT EXEMPTING GOVERNMENTAL AGENCIES FROM SUCH TAX. and same was placed on its first reading and read in full. Commissioner Higginbotham then moved the waiver of the requirement of the second reading of Ordinance No. 749, and that same be placed on its final passage and adoption. M. SMITH'S SUBDIVISION, SAID AMENDMENT CORRECTING THE DESCRIPTION THEREIN. Resolution No. 942, next introduced and after being read in full, was passed and adopted by the following vote of the Commission: Commissioner Baker Yea " Crapps Yea ~ Higginbotham Yea " McDonald Yea " Wilson Yea Said Resolution No. 942 being in words and figures as follows: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA REQUESTING THE BOARD OF COUNTY COMMISSIONERS OF SEMINOLE COUNTY, FLORIDA FOR JOINT PARTICIPATION WITH THE CITY IN ELIMINATING THE PUMP BRANCH CREEK HEALTH PROBLEM. WHEREAS, a drainage and helth problem exists in Pump Branch Creek from Third Street to Fifth Street in the City of Sanford, Florida, and WHEREAS, substantial quantities of storm water from county areas and roads are dj- verted into said creek to the extent that the same serves both the interests of the residents of the city and the residents of the county, and WHEREAS, the Board of County CommissioNers of Seminole County have her. etofore been requested to purchase approximately 340 feet of 96-inch pipe in order to help~relieve said drainage and health problem, with the City of Sanford having the responsibility for the labor and material necessary iu order to cover said pipe, NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY 0F'SANFORD, FLORIDA, that the Board of County Commissioner of Seminole County, Florida, be and they are hereby re- quested to participate in, on a mutual basis with the City of Sanford, Florida, the Pump Branch Creek project in order that a dangerous drainage and health problem affecting both the residents of the City and the County might be eliminated, and that such participation on the part of the County will consist of the aforesaid purchase in any event not to exceed the sum of Seventeen Thousand and 00/100 Dollars ($17,000.00) and the participation by the City of Sanford will con- sist of labor and material necessary to install and cover the aforesaid pipe. BE IT FURTHER RESOLVED that this Resolution be spread upon the minutes of the City Commission of the City of Sanford, Florida and copies thereof delivered to the Board of County Commissioners of Seminole County. Crapps As the City Commission of the City of Sanford, Florida On motion of Commissioner Wilson, seconded .by Commissioner Higginbotham and carried the City Manager was ~uthorized to replace the engine at the downtown auxiliary fire system with a 140 H. P. engine at an estimated cost of $450.00 to $500.00. Recommendation next submitted from Zoning and Planning Commission that property owuer~ requesting rezoning be required to pay a fee of $10.00 to cover expenses of registered letters to all property owners whose property would be affected by rezoning, and on motion of Commissione Wilson, ~econded by Commissioner Crapps and carried, same was approved. Recommendation next submitted by the Zoning and Planning Commissioner° zone Blocks 73 thru 78 and 88 thru 90, M. M. Smiths Subdivision to R-3 (Single Family) District and ou motion of Commissioner Wilson, seconded by Commissioner Higginbotham and carried, a Public Hearing was authorized to be held on May 8, 1961, to consider same. After considerable discussion regarding an easement across the westerly twenty-five feet of Nork Manufacturing. Company property on highway 17-92 at the well field site, Comm., Higginbotham moved to authorize the City Manager and the City Attorney to request an easement from them without restrictions, and als0 to authorize the purchase of material for an eight inch pipe line from No. 7 well to Highway 17-92 to be paid from Renewal & Replacement Fund. SecOnded by Commissioner McDonald and carried. On motion of Commissioner Higgiubotham, seconded by Commissioner Wilson and carried, the Commission authorized the installation of a six foot fence around the well next to the American Legion property on 17-92. Letter next submitted from John Krider, manager of Seminole County Chamber of Com- merce, regarding solicitors and suggesting that a Solicitation Endorsement Council be establishe( and. Commissioner Higginbotham moved that the City Commission go on record in favor of the progra~ Seconded by Commissioner McDonald and carried. Request next submitted by Jack Demetree, subdivision builder, for the City to con- struct sewers in first section of San Lanta Third Section for an estimated cost of $11,537.48 actual cost to be guaranteed by a personal note and repaid on a pro-rata basis of the number of lots serviced and upon construction and sale of each lot, provided .however, that any balance due on the face of the note shall be paid within two years from the date of issuance, and on motion of Commissioner Higginbotham, seconded by Commissioner McDonald and carried, same was approved. After discussion and on motion of Commissioner McDonald, seconded by Commissioner Higginbotham and carried, the Commission authorized the replacement of the pump at Suuland Estates sewer lift station at an approximate cost of $4,300.00. On motion of Commissioner Higginbotham, seconded by Commissioner Wilson and carried, the Florida State Bank was authorized as the depo~sitory for papers of the General Sanford Memorial Library. City C xmunissi'on; Sanford~ Florida, April 10 .a..t 61 19-~ The question next occured as to the Commission's interpertation of "home occupation" regarding the hiring of employees not living in the home, and Commissioner Higginbotham moved to allow all "home occupations" to continue in business that now have licenses, and that no additional businesses be permitted in residential districts. Seconded by Commissioner McDonald and carried. On motion of Commissioner Higginbotham, seconded by Commissioner Crapps and. carried, minutes of regular meeting of March 27,1961, and current invoices and payrolls next approved, as evidenced by General Fund Flo~Z~g St~tezBank Vouchers Nos. 5100 thru 5150, and General Fund Sanford Atlantic National Bank Vouchers Nos.~5640 thru 5769 and 8278 thru 8322, and W~.ter and Sewer Revenue Fund Sanford Atlantic National Bank Vouchers Nos. 474 thru 477.
